Since the tape machine did not work during the meeting, there is no taped record of these proceedings. CASELOAD: 05 -2010 Kelsey, James 1150 Capital Creek Road Bob Walker, representing the applicant, was present to request a 45 foot and a 50 foot Front Yard setback variance where 100 feet is required for two small additions to a single - family residence. The parcel contains 38+ acres and is zoned RS -30. Walker presented the Affidavit of Posting. There were no members of the public present to comment on the request, and no objections were filed with the Zoning Office. Walker presented a model of the proposed house and the site plan of the property; he expounded on the history of the property, a history of the house and a history of the vested rights. Walker made clear that the house was outside of the 100 foot stream setback and went on to explain that the homeowner wanted to add a dining area downstairs and an upstairs bathroom that is why two different Front Yard setback variances were necessary. Additionally, Walker pointed out that for any work to be done on this house they would need a variance as the entire house was in the setback. Head asked if the adjoining piece of property had been abandoned. Walker answered that someone could probably someday build on the adjoining piece; however, if that were the case, the building which they are adding on to would have to be reduced to 1000 square feet. Walker went on to say that the property owners had no intention of building another structure if they were able to do an addition to the current structure. sty rLi ;5 A Head asked the square footage of the current structure. Walker said approximately 2800 square feet. Head commented that the hardship was overlapping restrictions. Throm commented that he was familiar with the property and moved to approve the request based on the topography of the property. Brewster - McLeod seconded the motion and the vote was 4 -0, with all in favor. 06 -2010 Lazy Glen Homeowner's Association 101 Lazy Glen, Snowmass Chris Trautner was present to request a 4 foot height variance where a maximum height of 20 feet is allowed for the construction of a structure to contain a 60,000 water tank and pumping station. Trautner presented the Affidavit of Posting. Tom Parry and Roger James, both residents of Lazy Glen, were in attendance to speak in favor of the height variance request; no members of the public were present to oppose the request and no objections were filed with the Zoning Office. Trautner explained that Lazy Glen, per Resolution #049 -2008, is required to install a new fire suppression pump system. He explained the new system had been engineered to sit next to the existing water pump system which is next to the existing well and the Lazy Glen pond. He went on to explain they were raising the grade in the pond to accommodate the building, but because of the way that Pitkin County measures height, to the most restrictive grade, the building requires a variance. Trautner clarified that the building would not appear too high; that it will sit exactly at road level. Trautner explained that the system had been engineered with a big tall tank rather than a short squat tank because the system needed a certain amount of head pressure. McAllister questioned the height of the building in comparison to the existing grade and asked if they could build in a different area or a different configuration. Trautner responded with an affirmative; however, he said, they would be in the pond and have to berm around the building so that the building would not sit in the water. He explained that this was not affordable or even reasonable. McAllister asked if the pond was the emergency backup in the event of a fire. Trautner explained the dry hydrant. Tom Parry explained that the dry hydrant was to be used in case of a fire until the required system was built. t U :6 McAllister wanted to know why this building could not be built in the pond and wanted to know if the existed building was going to be demolished or utilized. Parry explained, no, because a booster pump will be placed in the existing pump house and the existing pump was to be removed. McAllister asked if this pump house could be built at another place on the property. Trautner repeated that no, it could not be placed elsewhere and the building would not be taller than anything else out there. Throm commented that it could not as the new building needed to be built by the well as the water for the system comes from the well. McAllister pressed asking again if this system could be placed anywhere else on the property. Brewster - McLeod pointed to the map of the property and asked if you could put it in a certain place. Trautner replied, no, as the pipes would become too long and the head pressure would be reduced. Throm made a motion to approve based on domestic water supply necessity for fire protection and water distribution. McAllister added topography to the motion and seconded with the topography modification. The variance request due to topographic hardships and water for fire suppression/distribution passed 4 -0. MINUTES: Brewster - McLeod' made a motion to approve the March minutes, McAllister seconded. The motion was approved by 4 -0. There being no further business, the meeting was adjourned. We understand some concerns have been expressed about the height of the Pump Station. The required capacity of the storage tank is 60,000 gallons, per the Basalt & Rural Fire Protection District. A bolted steel tank of this (or any) size can vary in terms of height and diameter, based on the panel sizes of each manufacturer. The most economical size is one where the height and diameter are similar, as is the case with the proposed 22 ft. diameter and 24 ft, high tank. Also, the system's hydraulics are improved with a higher tank, resulting in less energy (and cost) needed for pumping. As shown by the site plan, there were limited options available for locating the Pump Station. To the north is an asphalted road, to the east is another road and two large pine trees, and to the west is an existing well, which presently pumps water to the distribution system of the HOA. The result necessitated we locate the Pump Station to the south of the existing pumphouse. The Pump Station is roughly 37 ft. x 27 ft. in area, and not any larger or taller than is absolutely necessary to enclose the tank, while still providing adequate access to it A larger diameter tank would have reduced the height of the tank; however, it would have required a larger building footprint, and thus more infill of the pond at a greater cost to the HOA and environment. Additionally, moving a wider tank further south would not likely have changed the overall distance between the top of the Pump Station and the existing grade since the existing topography quickly slopes down closer to the pond. In summary, we took account of all factors in the design of the Water Improvements Project, including cost, accessibility, performance, safety and environmental impact. It is our professional judgment that the resulting dimensions of the Pump Station are most desirable to responsibly account for these factors.
