The Applicant is proposing an addition to a single - family residence located on the property identified above. The addition is approximately 1870 square feet in size and consists of a dining room, mud room, master suite, two car garage, mechanical space, and an additional exterior deck. The square footage of the addition exceeds the 1041 exemption for additions to existing structures (30% of existing floor area) . The subject property is mapped for floodplain, slopes in excess of 30 percent, and low wildfire hazard. The Applicant is also proposing to realign and extend the driveway to accommodate the new garage location. REFERRAL AGENCIES: Referral Agency comments are attached for reference. 1. The County Attorney has been advised of this application and has not commented on the proposed action. 2. The County Engineer has indicated that there will be no additional impacts on the traffic operations of Highway 82 due to the Bradley Addition and no other impacts from this project are anticipated. Bud Eylar also pointed out that, as Twining Flats Road is privately owned and maintained, the Applicant will not be required to obtain an access permit for the driveway realignment and extension. 000002 1 �� The Zoning Office has reviewed this application and has offered the following comments: Joanna Shaffner has indicated that the proposed addition lies within the 100 foot front yard setback. The Applicant will be required to obtain Board of Adjustment approval. Joanna also has some concerns relative to the potential for disturbance of the adjacent riparian habitat and has suggested that conditions be applied which will address this issue. 4. The Department of wildlife has been advised of this application and has not offered comments on this action. 5. The Floodplain Administrator has indicated that the proposed development will be removed from the 100 year floodplain, therefore, the project should not impact or be impacted by the floodplain. 6. The Environmental Health Department has indicated that the Applicant must obtain a permit to replace or relocate the septic tank, prior to any disturbance to the existing septic system. Chris Chiola also pointed out that the septic system must not be within 100 feet of the existing private well. 1041 ISSUES Slopes The subject property includes areas of steep slopes. Generally, the steep slopes are located adjacent to the Roaring Fork River. The location of the proposed addition and deck are shown on the attached site plan and are outside any areas of slopes in excess of 30 percent. Floodplain While the Roaring Fork River 100 year floodplain does encroach on the Bradley property, it is well below the building site, as delineated on the site map. The Applicant will be required to establish a 20 foot stream setback, which is to be maintained in it's natural state. The setback is measured horizontally from the mean identifiable high water mark of the River. Wildfire The subject property is mapped for "low wildfire hazard" (A). Section 5- 403.1(a) of the Pitkin County Land Use Code states that the wildfire regulations apply to only those areas mapped for "severe wildfire hazard" (either C or X). ENABLING LEGISLATION: Pursuant to Section 5- 400.5(b) (2) of the Land Use Code, the Planning Director may approve a Minor 1041 Hazard Review provided the proposed development is outside a hazard area. 0 00003 � -4 RECOMMENDATION: Planning Staff is recommending that the Planning Director approve the Bradley Minor 1041 Hazard Review subject to the following conditions: 1. The Applicant shall adhere to all material representations made in the application. 2. Prior to the issuance of a building permit, the Applicant shall obtain approval of the Board of Adjustment for a variance to the setback. 3. The Applicant shall obtain a permit for the relocation or replacement of the septic tank from the Environmental Health Department prior to the issuance of a building permit. 4. The Applicant shall submit to the Planning Office, for approval and subsequent recordation, a 24 1 lx36" mylar Minor 1041 Hazard Map which shows, in addition to the information provided on the previously submitted drawing, the following: a) topography of the entire site (contours and elevations); b) a building envelope that indicates the limits of the project. Except for driveway and utility improvements, all development, including grading, shall be located within the building envelope. There shall be no removal of vegetation outside of the building envelope; c) a note shall be added which indicates that a 20 foot stream setback be established, as measured from mean identifiable high water mark. This area shall be protected in it's natural state; d) the location of the septic system, leach field, and existing well; e) a disclaimer which states: "The provisions of these regulations do not in any way assure or imply that the areas outside of designated hazard areas will be free from hazards, or that approved mitigation measures will guarantee the safety of any property "; f) the Applicant is encouraged to grant a fishing easement to allow the use of a described portion of the property for fishing by members of the Public. 1. The plans submitted by the applicant indicate that the new addition will displace the septic tank. To relocate or replace the tank a permit is needed from this Department. This permit must be obtained before any disturbance to the system is done.
