ZONING: AF -2 REQUEST: Mary Anne Bosely is requesting approval of a minor 1041 Environmental Hazard Review /Category 2 Exemption. She is proposing a building envelope for construction of a single family home on a lot which is 2.5 acres in size. The site is characterized by two distinct potential building envelopes. The first building envelope is located on a dry bench between Liberty Lane and a slope which drops off to a heavily wooded area adjacent to the Roaring Fork River. The second potential building envelope, (preferred by the applicant), is located between the slope and the Roaring Fork River floodplain. An existing driveway links the two potential building envelopes. The lot is currently vacant. The second envelope described is the subject of this review. 1041 REVIEW The site is impacted by slopes in excess of 30% and floodplain hazards. In addition, it is located within mapped deer winter range. Finally, while the site does not contain mapped wildfire hazard, the applicant has been asked to address wildfire hazard, due to the existing density of the vegetation within and adjacent to the proposed building area. Vegetation on the site consists primarily of willows, evergreen trees and aspen trees. There is some juniper and scrub oak located on the slope and some sage on the upper bench. The applicant agrees to minimize the amount of vegetation removed from the site. However, all of the vegetation within the building footprint and some of the underbrush and trees obstructing views of the river from the building footprint will be removed. The applicant indicates that riparian vegetation will not be disturbed. Staff notes that the applicant will be required to establish a 20 foot stream setback, which is to be maintained in it's natural state. The setback is to be measured horizontally from the mean identifiable high water mark of the River. The setback will be noted on the site plan. M While wildfire is not mapped as a hazard, the applicant intends to mitigate possible wildfire hazard by adhering to the following wildfire safety guidelines: The applicant agrees to: 1. Maintain a minimum 10 foot fire break between combustible structures and vegetation; and 2. Bury power and telephone lines. Though the site is mapped as deer winter range, Randy Cote has indicated that mapping for the Woody Creek quadrant is inaccurate. New mapping, which has yet to be adopted by the County, was recently submitted by the Division of Wildlife to the Planning Office. The updated map has deleted lands located between the Roaring Fork River and Upper River Road from wildlife habitat areas. Based upon discussions with Mr. Cote and new mapping, it is concluded that wildlife is not a concern on this site. The proposed building envelope is located outside of the mapped slope and floodplain hazard areas. The existing driveway crosses steep slopes. If the driveway does not currently meet County driveway standards, improvements to meet standards will be necessary prior to issuance of a building permit. Current standards require a driving surface of 8 to 16 feet, with a grade which does not exceed 12 %. If improvements are necessary, and can be made without impacting slopes exceeding 30 %, a "major" 1041 review will not be required. If improvements impact said slopes, a "major" review will be required. It has been determined that wildlife is not an issue on the site. While wildfire is not a mapped hazard, the applicant has agreed to mitigate potential wildfire hazard to some extent. BUILDING PERMIT EXEMPTION REVIEW Pursuant to Section 18 -2.5 of the Code, the applicant has addressed proposed water supply and waste water disposal for the site. Bob Nelson, having reviewed the site, indicates that either an engineered septic system or a leach field on the upper bench will be required. The applicant commits to install a system which meets the approval of the Environmental Health Department. The site qualifies for a residential exempt well, and Mr. Nelson has indicated that water should be reached with a shallow well. The applicant agrees to have well water quality and quantity reviewed and approved by the Environmental Health Department. FINDING: 1) The proposed building envelope is located outside of 1041 2 ��� X03 hazards which exist on site. 2) The applicant has provided a site plan for sign -off. Prior to recording, the applicant agrees to amend the site plan in the following manner: a) The 100 year floodplain elevation shall be clearly delineated, as determined by a certified engineer. b) A note shall be added which indicates that a 20' stream setback shall be established and maintained in it's natural state. Said setback shall be measured horizontally from the mean identifiable high water mark of the river. 3) The County Attorney is satisfied that the property was legally created and has not merged with any contiguous lots. 4) The applicant has addressed the category 2 exemption criteria for land use. 5) In the event that slopes in excess of 30% must be disturbed for driveway improvements, development of the site will be subject to a "major" 1041 review. Sections 5- 400.3(b) and 5- 400.5(b) of the Land Use Code provide that the Planning Director is authorized to approve a site plan and application for a Minor 1041 Hazard review. Based on the findings referenced above, Staff recommends approval of the Bosely 1041 Minor Hazard Review and Category 2 Exemption. Said approval is subject to the recommendations listed below. If you agree with Staff's recommendation, please sign this memo, which will serve as a reference document authorizing approval of said application. Planning Director's sign -off on a 1041 Review Site Plan is also necessary for completion of the administrative review process. The Site Plan shall be recorded in the Clerk & Recorder's office. A copy shall be placed in the file. OF APPROVAL: 1. The applicant shall provide the following mitigation for potential wildfire hazard: a. Maintain a minimum 10 foot fire break between combustible structures and vegetation; b. Bury power and telephone lines 2. Prior to issuance of a building permit, the applicant shall install a waste disposal system and water well which meets the approval of the Environmental Health Department. 7 �vu,�64 T � r 3. Hyman Ave., Suite B Aspen, Co. 816U RE: Bosely 1041 Dear Alice: This letter is to provide additional certification and information regarding floodplain mapping and driveway configuration for the Bosely parcel in Woody Creek, Colorado. F000dplain I have reviewed the 1041 Site Plan generated for the parcel by Aspen Survey Engineers Inc. dated April 12, 1990 (Job #6123). I also spoke with surveyor Dave McBride who demonstrated the methodology used to determine the 100 year floodplain boundary. Within the limitations of the methodology used, (the 100 year flood elevation was derived from the Federal Emergency Managment Agency (FEMA) flood profiles for their Flood Insurance Study dated June 4, 1987) relating flood elevation to the elevation of the stream thread, I do certify the "approximate" 100 year flood boundary shown on the Aspen Survey Engineers map. I would note that: 1. The flood boundary actually continues to the north and south property boundaries. 2. Any residential structure on the site should have a lowest habitable floor elevation at least 2 feet above the base flood elevation. 3. A more precise flood boundary could be determined by a site - specific river - section survey and Hec -II computer analysis. The FEMA profiles are generally accepted for flood insurance and local regulatory purposes. Driveway Again, based on elevation information provided by Dave McBride of Aspen Survey Engineers Inc., I find that: 1. The driveway intersection with the local street meets all Pitkin County requirements related to grade (maximum 2% for the first 20 feet) and sightlines. 2. The driveway meets County grade standards for the next 150 feet from the intersection (under 12 %). The unimproved subject site is located adjacent to the Roaring Fork River in Woody Creek as depicted on the vicinity map (refer to Attachment 1) . The site is approximately 2.5 acres in size and is zoned AF -2. The parcel is characterized by two distinct potential building envelopes. The first building envelope is located on a dry bench between Liberty Lane and a slope which drops off to a heavily wooded area adjacent to the Roaring Fork River. The second and preferred potential building envelope is located between the slope and the Roaring Fork River floodplain. An existing driveway links the two potential building envelopes. Minor 1041 Environmental Hazard Review The site is impacted by slopes in excess of 30 per cent and floodplain hazards. You also requested that the applicant address wildfire and wildlife hazards. As depicted on Attachment 2, the proposed building envelope is located outside of the mapped slope and floodplain hazard areas. The driveway crosses steep slopes, however since the driveway has been in existence for more than 20 years, a 1041 review for the driveway is not a development consideration. The proposed building envelope as depicted on Attachment 2 is located within a mapped deer winter range. Despite the mapping, wildlife habitat should not be a factor in the 1041 environmental review. In a discussion with Randy Cote of the Colorado Division of Wildlife, he indicated that the mapping for the Woody Creek quadrant is inaccurate. Based upon our discussions with Randy and the new mapping, wildlife hazards do not affect the subject site. Vegetation on the subject site consists primarily of willows, evergreen trees and aspen trees. There is some juniper and scrub oak located on the slope and sage on the upper bench. The applicant will minimize the amount of vegetation removed from the site. There are no plans to remove any vegetation from the upper bench or slope. All of the vegetation within the building footprint will be removed and some of the underbrush and trees obstructing views of the River from the building footprint will be removed. Riparian vegetation will not be disturbed. Due to the location near the River and based upon historical data on the area, the natural brush is not a significant wildfire hazard. Nevertheless, in order to mitigate possible wildfire hazard, the applicant proposes the following conditions which are based upon the Wildlife Safety Guidelines for Subdivision and Developments: 1. Maintain a minimum 10 foot fire break between combustible structures and vegetation; and 2. Bury power and telephone lines. Building Permit Exemption Review to Construct a Single - Family Dwelling Unit Section 18 -2.5 establishes a procedure to exempt single - family dwelling units located on meets and bounds parcels from the full building permit review procedure if a proposed building site lies outside any area of state and local interest. To qualify for such an exemption an applicant is required to address proposed water supply and waste water disposal systems. Bob Nelson of the Aspen - Pitkin Environmental Health Department indicates that either an engineered septic system or a leach field on the upper bench will be required. The applicant commits to install a system meeting the approval of the Environmental Health Department. Quality and quantity of water should be adequate as there are not any historical water problems in the area. The subject site will qualify for a residential exempt well. According to Bob Nelson, there is a plentiful water supply in the area which can be reached with a shallow well. Please refer to the following attachments to assist you in your review: 1.
