RAyBURN/RAYDO) SUBDIVISION DETAILED SUBMISSION AND FINAL
PLAT
Resolution No. 98- lc
1. Don Rayburn and Raydo, Inc., hereinafter, "Applicant ", has applied to the Board of
County Commissioners of Pitkin County, Colorado, hereinafter, `Board ", for approval of
detailed subdivision submission and final plat pursuant to the Pitkin County Land Use
Code.
2. The subject property is located along the Roaring Fork River in the Twining Flats
area, and is described on Exhibit A, attached.
3. The Planning an d Zoning Commission reviewed this application on January 6, 1998,
and recommended approval of the application subject to conditions.
4. The Board heard this application at a regularly scheduled public hearing on April 8,
1998, at which time evidence and testimony were presented with respect to this
application.
5. The Board determined that the proposed activity meets the applicable criteria
established in the Land Use Code, provided the conditions listed in this resolution are
adhered to.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Pitkin County, Colorado, that it does herevy grant approval of the Two Moon
Subdivision Detailed Submission and Final Plat subject to the following conditions:
1. The applicant shall adhere to all material representations made in the application and
in public meetings.
2. Prior to building permit application, the applicant shall record a Final Plat meeting the
standards of Land Use Code Section 5-40.
3. That all conditions of BOCC Resolution No. 97 -5 remain in full force and effect,
except condition No. 14 shall be modified to read, "The Board supports the
conveyance of the Category 4 deed restricted single family residence to the existing
tenant even if his family does not meet the current Category 4 guidelines."
4. The Final Plat shall show the fishing easement, the floodplain limits, and the DOT
right of way.

i. School and Park "Cash -in -Lieu of Land Dedicafion" requirements as per Code
Sections 3- 130 -040 (parks) and 3 -130 -080 (schools) will be required for development
of Lot 2 and shall be satisfied prior to issuance of a building permit for a residence on
Lot 2.

COUNTY, COLORADO, GRANTING A REZONING FROM AFR -10 TO AH FOR THE
RAYBURN PROPERTY

Recitals
1. Don Rayburn and Raydo, Inc. (hereafter "Applicant ") has applied to the Pitkin County Board
of County Commissioners (hereafter `Board's for a rezoning approval to create a deed-
restricted lot for employee housing.
2. The property is described on Exhibit "A" attached and consists of approximately 2.60 acres.
3. The proposed zone change is from AFR -10 (Agriculture, Forestry and Residential, 10 acre lot
size) to AH (Affordable Housing, lot size by Special Review).
4. The Planning and Zoning Commission heard this rezoning application at their regularly
scheduled public meeting on September 6, 1996, at which time they recommended approval
of the requested zoning change.
The Board heard the rezoning request at their regularly scheduled and duly noticed public
hearing on April 8, 1998, at which time evidence and testimony were presented with respect
to this application.
6. The Board finds that this rezoning application allows the owner to provide affordable
housing mitigation for the impacts of his subdivision, provides for affordable housing
opportunities in close proximity to the Aspen area, and that the Aspen Area Community Plan
and the Aspen/Pitkin County Affordable Housing Guidelines promote the housing
opportunities created by this type of application which seeks to deed restrict an existing
dwelling for affordable housing.
NOW THEREFORE BE IT ORDAINED by the Pitkin County Board of County
Commissioners that it hereby rezones the proposed 2.6 acre Rayburn/Raydo, Inc. lot from AFR-
10 to AH, as described in Exhibit A attached, subject to the rezoning being effective upon the
approval and recordation of the Final Plat for the Raybum/Raydo, Inc. (Two Moon) Subdivision.
INTRODUCED AND FIRST READ at a regular meeting and public hearing on the 8th
day of April, 1998.

REQUEST: The request is for Detailed Subdivision/ Final Plat Approval and Rezoning
for a reconfiguration of two existing metes and bounds parcels into three lots, one of
which would be rezoned to AH, and the existing house on this parcel is to be deed
restricted to Housing Authority Category 4 Guidelines.

LOCATION: Twining Flats
PROCEDURE/PROCESS: This is the Second Reading of the final step for the
approval of a Rezoning and combined Detailed Subdivision Submission/Final Plat
approval. The Planning and Zoning Commission reviewed and recommended approval of
the request on January 6, 1998.
BACKGROUND/DESCRIPTION OF PROPOSAL: The application received
approval from the BOCC for a Lot Line Adjustment, GMQS Exemption for affordable
Housing, 1041 Hazard Review, and Conceptual Subdivision Submission by Resolution
No. 97 -5 on January 8, 1997. At the time of the BOCC conceptual subdivision approval
the rezoning was discussed and alluded to in the resolution, but final rezoning can not
take place until approval of the Final Plat.
The applicant has met or agreed to meet all requirements of Detailed Subdivision and
Final Plat Submission and has addressed or agreed to comply with all approval conditions
of the BOCC Conceptual Approval (Res. #97 -5) except for the requirement that a fishing
easement be provided along the property to 5 feet above the high water line. This is the
Code requirement. The applicant asked that the easement be limited to the watercourse.
The P &Z recommended that the easement not be required to extend above the high water
mark. At First Reading the Board determined that the easement should be as stated in the
t�tjuu�l
Code and the conceptual approval; that is, the easement should be for the watercourse and
five feet above the high water mark.
At First Reading the applicant asked for clarification that the existing tenant could
purchase the AH parcel, which is to be deed restricted to Category 4, even if his family
did not meet current Housing Authority guidelines for Category 4. The Board agreed
with this request.
The Resolution of Approval has been modified to reflect these two changes.
RECOMMENDATION: Staff and the Planning and Zoning Commission recommend
that the Board approve a motion adopting the attached Resolution at Second Reading
approving the Two Moon Subdivision Detailed Submission and Final Plat.
Staff and the Planning and Zoning Commission also recommend that the Board approve a
motion adopting the attached ordinance at Second Reading rezoning a portion of the Two
Moon Subdivision from AFR -10 to AH.

REQUEST: The request is for a reconfiguration of two existing metes and bounds parcels into

BACKGROUND: The Rayburn/Raydo property received Conceptual Subdivision, 1041 Hazard
Review, and GMQS Exemption for Affordable Housing approval from the BOCC in January of
1997, pursuant to Resolution 497 -5. The P &Z approved the Conceptual Subdivision and
recommended approval of the Rezoning on September 3, 1996 (minutes attached). The
Applicants have submitted a combined application for Detailed/Final Plat approval, due to the
relatively straightforward nature of the project The Applicants have asked to change the name of
the project to the Two Moon Subdivision.
PROCEDURE: The Detailed Subdivision/Final Plat and Rezoning approval requires a

applicant has adequately addressed or agreed to comply with all approval conditions of BOCC
Resolution 997 -5 (attached) except for condition No. 13, related to the required fishing easement.
The condition requires a dedicated "fishing easement along the length of the property to include the
watercourse and 5 feet above the high water line." The applicant proposes the easement be limited
to the watercourse.

RECOMMENDATION: Staff recommends that the Planning and Zoning Commission
recommend approval of the Two Moon Subdivision Detailed/Final Plat application to the Board of

We are looking at 2 lots, 8.5 acres and 2.5 acres. There are 2 residences currently. A new free
market on the lower bench would be added and the lot lime adjustment would be acquired from the
larger parcel. A new free market residence would be added and the existing residence would have to be
demolished. The new parcel would be affordable housing. We will have three lots and end up with two
residences. There are very few issues associated with the request. Flood plane impacts and the budding

accomplished. In respect to roads, the legal status of the access needs to be clarified, Woods Road is at
the edge of the properly line.
The deeds do call out his easement for access and we need to look at that more closely. There
needs to be a fishing easement along the river. Finally, the only remaining issue the type of deed
restriction, resident occupancy with only a resale cap restriction Occupancy by a resident of the valley.
The housing office and planning staff would hike to see a category 3 or 4 deed restriction be placed on
this unit. We have a letter from the Woody Creek. Caucus who said Idr Rayburn has been a good
neighborhood, but they feel an additional lot be created and it should be category housing. Staff
recommends approval subject to the conditions in the memorandum.
Larsen: What is the number between three and four.
Horn: Category 4, I believe, is 310,000 and 3 is 145,000.

REQUEST: The Applicants own adjoining metes and bounds properties in the Twining Flats
area. A Lot Line Adjustment is requested to create a new free - market building envelope
adjacent to the Roaring Fork River. The existing residence on this parcel is adjacent to
Highway 82; rather than demolish this dwelling, the applicant requests approval of an
Affordable Housing (AH) Rezoning and GMQS Exemption to retain the existing home for
employee housing.
APPLICANTS: Don Rayburn and Raydo, Inc.
LOCATION: Twining Flats. Site plans and vicinity maps are in the application.
STAFF COMMENTS: The Applicants initial request for a Lot Line Adjustment between the
Rayburn and Raydo, Inc. properties is in compliance with Section 3- 190.30 of the Land Use
Code. The purpose of the Adjustment is to create a more attractive free - market development site
adjacent to the Roaring Fork River. The Raydo property has an existing dwelling adjacent to
Highway 82. This dwelling must be demolished to allow for the new building envelope along
the river unless it is approved as an Affordable Housing Unit.
The Applicants propose to save the p unit as,Affordable Housing by rezoning a portion of
the Raydo site to AH and subdividing anew AH zoned lot to include the existing residence.
Section 3- 150.100, Dwelling Units Constructed in the AH Zone, contains criteria for review of
proposed dwellings. The criteria and staff comments follow:
Criteria #1 Contribute to the annual housing production goal and unit mix established by the
Board of County Commissioners housing designee;
Staff Comment Detached single family homes area priority of the Housing Authority.
Criteria #2 Be comprised of dwelling units complying with category 1, 2, 3 and 4 and
occupancy guidelines of the Board of County Commissioners housing designee;
Staff Comment The staff and Planning Commission recommend a category 4 deed restriction.

S taff Commen : The existing zoning is AFR -10. Both properties are currently non - conforming
as to lot size. If the rezoning is approved, the two "free- market' parcels will continue to be non-
conforming. While it could be argued that the proposed rezoning of a portion of these properties
to AH results in an increased nonconformity in the AFR -10 zone district, the Staff and Planning
Commission believe that the Community goal of providing and retaining affordable housing
lends support to this proposal. The resulting lots will remain compatible with other
neighborhood lot sizes which range from 2 to 5 acres. The AH zone district allows for the
creation of a 6,000 square foot lot; the proposed lot will be approximately 2 acres in size.

Criteria #4 Not result in demands on public facilities, and shall not exceed the capacity of
such public facilities, including, but not limited to, transportation facilities, sewage facilities,
water supply, parks, drainage, schools, and emergency medical facilities;

Criteria #5 Not result in significant adverse impacts on the natural. environment;
Staff Comment The application avoids hazard areas.
Criteria #6 Be consistent and compatible with the community character; and
Staff Comment The resulting lot sizes are compatible with the neighborhood.

Staff Comment The retention of an affordable dwelling supports the public interest.
B. The Board shall consider:

SUMMARY: The Planning Commission and Staff recommend approval of this application for
Rezoning to AH and GMQS Exemption because it retains and deed restricts an existing dwelling
as Affordable Housing. The proposed Lot Line Adjustment and Conceptual Review for the new
free - market homesite avoids all significant 1041 Hazard areas. 1041 Hazards include the 100
year floodplain of the Roaring Fork River and a low Wildfire hazard. The new "free- market"
building envelope is located outside of the 100 year floodplain. To mitigate wildfire hazards, the
standard wildfire conditions have been incorporated into the Resolution. The staff memorandum
to the Planning Commission is attached.
RECOMMENDATION: The Staff and Planning Commission recommend that the Board
approve the Applicant's request for Lot Line Adjustment, Conceptual Submission, Rezoning to
AH and a GMQS Exemption for Affordable Housing subject to the conditions outlined in the

Don Rayburn and Raydo Incorporated is seeking combined Detailed
Subdivision, Final Plat and rezoning for the Two Moon Subdivision.
The Board of County Commissioner granted Conceptual approval for
this request pursuant to Resolution 97 -5 (see Attachment 1). This
letter addresses the conditions of approval in Resolution 97 -5 and
then the standards of Code Sections 5 -30 and 5 -40.
Resolution 97 -5
1. The Applicant met with Francis Krizmanich regarding platting
requirements. Francis instructed the applicant to prepare one
subdivision plat depicting the three adjusted lots. The plat
is submitted with this land use application.
2. Lot 2, Two Moon Subdivision, the new free - market lot contains
a building envelope which is setback 30 feet from the top of
bank of the Roaring Fork River.
3. The applicant has submitted a rezoning map which rezones Lot
3 of the subdivision to AH. The applicant will restrict the
house to the Aspen Pitkin County Housing Authority Category 4
guidelines prior to recording the final plat.
4. The Two Moon Subdivision plat has established a building
envelope around the existing house on Lot 3. The envelope is
setback 30 feet from the top of the bank, as shown on the
plat.
5. Lot 2 of the Two Moon Subdivision plat has a note indicating
that development of the lot is subject to the conditions in

14. The applicant has met with the Housing Authority to ascertain

applicant is seeking approval to convey the residence to the
existing tenants as a top priority.

Standards Report
Most of the submission materials identified in sections 5 -30 and 5-
40 are not applicable to a simple subdivision like the Two Moon
Subdivision. Two houses already exist and a 1041 Environmental
Hazard Review has already been granted for the undeveloped lot.
Electricity is already available at the vacant site. Potable water
will be provided by a well and sewage will be disposed of by a
individual waste water disposal system. There will not be an
improvements agreement because public or common private
improvements are not proposed.
The applicable standards in Sections 3 -60, 3 -70, 3 -80, 3 -110, 3-
120, 3 -130 and 3 -180 are addressed below.
Section 3 -60 Environmental and Aesthetic Standards
Section 3- 60.20, Preservation of Natural Landscape, is the only
applicable standard. The access for Lot 2 was approved at the
conceptual review stage. All driveway improvements will be located

within the driveway envelope.
Section 3 -70 water Resources
Water resources will not be affected by the development of Lot 2.
All existing drainage patterns will be maintained. The applicant
will demonstrate a potable water supply prior to building permit as
noted in the response to conditions above.
Section 3 -110 Improvements and Services
As previously noted Lots 1 and 3 are already developed.
Electricity is already available at Lot 2. Potable water will be
provided by a well and waste water disposal will be provided by a
individual waste water disposal system. There will not be an
improvements agreement because improvements are not proposed.
Section 3 -120 Impacts on Taxes and Management of Necessary Services
There will not be any significant impact on taxes and necessary
services resulting from the construction of one free - market single
family house. The standards in this section are not applicable.
