A site specific engineer designed sewage system shall meet approval of the Environmental Health Department prior to building permit issuance to assure the integrity of the adjacent potable wells. b. Information on the well as to chemical or bacteriological quality of the drinking water, the maximum pumping rate, the yield, the water main sizing, the existing or proposed water storage, and a legally recorded permit for the well construction or water use shall meet approval of the Environmental Health -Department prior to the approval of a building permit. The applicant is also requesting to be exempt from the general submission requirements of the Land Use Code. Applicant: John Beetham and George Molsbarger Applicant's Representative: Ted Guy and Associates Location: Lot 8, Little Texas Subdivision Zoning: The approximately 1/2 acre parcel is zoned AF -1. Water: There is an existing well servicing the existing cabin. It is not clear whether this is an adequate and legal water provision to the property. Sewer: The use and location of the existing septic system is unknown. The Environmental Health Department questions the adequacy of this system. Access: The property access is from Upper Woody Creek Road to an interior subdivision road. The applicant is proposing to use the existing 10 ft. access easement crossing the property. REFERRAL AGENCY COMMENTS Environmental Health- In a memo dated May 9, 1990, (attached) Bob Nelson submitted the following comments: Sewage- Due to the anticipated high seasonal groundwater table, the proximity of an irrigation well, rapid permeability of the gravelly alluvial soils and the location of the Roaring Fork River, a relatively sophisticated site - specific engineer designed sewage system is needed. Water- The existing well on the property has not been 11 �uU,.fu3 demonstrated to be an "adequate" water supply. There is not information in the submittal as to chemical or bacteriological quality of the drinking water, the maximum pumping rate, the yield, the water main sizing, the existing or proposed water storage, or a legally recorded permit for the well construction or water use. The additional increase in size of the residence on the property and the change from a seasonal summer use to year -round occupancy could substantially affect the quality of water available, particularly during low flow periods of the late winter. Air Quality- The proposed residence is allowed one fireplace and one certified wood stove. Noise- Construction hours should be limited from 7 A.M. to 7 P.M. so as not to result in the generation of annoying noise levels in or around other properties in the area. Water Resources- If the proposed changes and improvements to vegetation and roof drainage are completed, the impacts on water quality appear to be better mitigated and do not appear significant. County Engineer- In a memo dated April 30, 1990 (attached), Tom Newland submitted the following comments: Soils, Surficial Geologic Conditions and Radiation- The recommendations of Dr. Lampiris should be followed with respect to building placement and foundation design. Drainage- There is concern with the building's placement on slopes in excess of 30 %. However, as the proposed building will be replacing an existing structure, the development should not noticeably alter existing drainage patterns. Internal Road Design- The applicant is using an existing 10 -foot wide driveway easement to the development. As the driveway passes through the property to access other adjacent properties, the applicant should assure the County the free use of the road will be maintained during construction. The access roads within the subdivision are poorly defined and inadequate as to width. It is recommended that the applicant consider granting a 30 -foot wide access easement to the properties adjacent and to the south that use this road. This width of access is required under County driveway standards. If a 30 -foot wide access easement cannot be granted, a 20 -foot wide easement will suffice if the County Attorney's office concurs. Trails- It is recommended that the applicant consider K 0 granting a fisherman's easement to the County along the Roaring Fork River. This easement needs to be at least 5- feet wide as measured from the high water mark. Division of Wildlife- In a letter dated April 11, 1990 Randy Cote submitted the following comments: "My only concerns with this proposal is the riparian area." The applicant has stated that 1) no development will be done in the 100 year floodplain; 2) no vegetation will be removed outside the building envelope; 3) fences will not exceed 42" in height, 3 strand wire or 4 pole; and 4) dogs will be leashed or kenneled. STAFF COMMENTS The following provision of the Land Use Code apply to this application. Section 5 -404 Wildlife Habitat Area The site is within mapped mule deer winter range and critical habitat. Randy Cote, from the Division of Wildlife, has informed the Planning Office that the wildlife boundaries are general in nature and that this is not an area of critical habitat. The applicant's proposal should have minimal impact on the existing wildlife resources if the Division of Wildlife's recommendations are adhered to. Section 5 -401.2 Geologic Hazard Area The proposed building envelope is located on slopes exceeding 30 %. The Land Use Code indicates that: Development shall be discouraged on slopes of fifteen percent (15 %) and greater unless problems of stability and erosion can be overcome. Any development approval shall be based on a detailed site survey including geologic and engineering analysis and shall comply with the following: (A) Cuts shall not be made into slopes steeper than thirty percent (30 %) unless mechanical support is provided. (B) Cuts and fills, and grading and scraping shall be confined to the minimum area needed for construction. (C) Steepness of cut and fill slopes shall be the maximum which will insure stability and still allow revegetation. (D) Development plans shall include reasonable but adequate 3 UE.: �l� M control measures. Large tracts should be developed in small workable units without leaving large areas for long periods. (E) Use mulches or temporary cover on exposed soil areas and re- establish permanent vegetation and install erosion control measures as soon as possible. (F) Incorporate natural drainage patterns into the development plan. Culverts, sediment basins and other engineering measures should be used where necessary to control erosion. (G) Soil absorption sewage disposal systems should not be placed on slopes steeper than fifteen percent (15 %). Response: The applicant is proposing to place the structure on slopes of up to 50% instead of the flat portion of the property. There are two flat benches on the property, one within the floodplain where no development is proposed, and one where the existing house is located. The applicant is proposing to bring the house down the side of bank between the two benches. Dr. Nick Lampiris, consulting geologist, has indicated that construction on the edge of the steep hillside can be done, especially if there is a tie in to the flat area at the top of the bank where the majority of the home will be built. In this case it is very important to control surface and subsurface water in the vicinity of the home to prevent instability. Soils engineering including a factor of safety analysis is necessary for proper foundation design on this bank edge but a satisfactory result can be obtained, especially since the bank is only 25 feet to 30 feet high and has no indication of erosion on it. Dr. Lampiris's letter dated March 8, 1990 is attached. F91J51V 4 Section 5- 401(h)(2) of the Land Use Code discourages development on slopes over fifteen percent (15 %). The applicant is proposing development on slopes of up to fifty percent (50 %). There is a flat portion of the property on which a part of the house is proposed. Staff would like to direct the applicant to place the house on the flat portion of the property to keep within the intent of the Land Use Code of discouraging development on slopes over 15 %. There have been a few other homes within the Little Texas Subdivision which have been remodeled and drop slightly down the bank onto steep slopes. It is recommended that the applicant consider granting a fisherman's easement to the County along the Roaring Fork River. This easement needs to be at least 5 -feet wide as measured from 4 l,'U1,�111 the high water mark. RECOMMENDATION The Planning Office recommends to the Planning and Zoning Commission that the applicant be directed to relocate the proposed house on slopes not to exceed fifteen percent. If the Planning Commission wants to approve this 1041, Planning Staff suggests the applicant comply with the following conditions: 1) The applicant shall provide a site plan which meets approval of the Planning and Zoning Commission. 2) The applicant shall comply with recommendations made by the Colorado Division of Wildlife. They are as follows: a. Kennel or leash all dogs; b. Fences must not exceed 42" in height and three (3) strand wire or four (4) pole or less; C. (G) Soil absorption sewage disposal systems should not be placed on slopes steeper than fifteen percent (15 %). 1041.beetham 0 %., ASPEN *PITKIN 1.01 ENVIRONMENTAL HEALTH DEPARTMENT MEMORANDUM To: Mary Lackner, Planning Office, From: Bob Nelson, Environmental Health Department,/ Date: May 9, 1990 Re: Beetham /Molsbarger 1041 Hazard Review & General Submission Parcel ID #2643- 164 -01 -010 The Aspen / Pitkin Environmental Health Department has reviewed the above - mentioned land use submittal under authority of the Pitkin County Code Title II, and has the following comments. SEWAGE TREATMENT AND COLLECTION Sections 2 -7 and 5 -200: The application indicates that the wastewater for this would be disposed of by means of an individual septic system - absorption field. From our evaluation of the home site with a site inspection and by using the general conditions reported for the soil types (indicated on the Soil Conservation Service maps) it is the department's conclusion that most of lot would not be considered suitable for any type of conventional septic system under existing County Regulation. This is due to the expected high ground water tables in the lower areas of the lot, and to the placement of existing drinking water wells on the upper portions of the property which require a minimum setback of one hundred feet to septic system components. There are, however, alternative engineering designs which potentially could fit into the topography to the northwestern portion of the lot on the lower bench, and which would conform to Pitk�n County regulations. It is our opinion that the sewage system for the parcel will be of the type requiring a relatively sophisticated, site - specific engineering design. This is because of the anticipated high seasonal groundwater table mentioned, the proximity of an irrigation well, and the location of the Roaring Fork River. Also likely is very rapid permeability in the gravelly alluvial soils in the valley floor. We expect that these geologic and hydrologic conditions on the building lot will dictate that sewage system will be an engineered mound or a system of similar design. A properly engineered mound design can conform to local requirements, but is very costly. Variances from setbacks from property lines and foundations are also likely to be required. ADEQUATE PROVISIONS FOR WATER NEEDS Sections 2 -6 and 5 -205: Water is apparently to be supplied from a well serving the existing residential unit. This well is apparently constructed on the property southerly line and shown on the site map. There is no information in the submittal as to chemical or bacteriological quality of the drinking water, the maximum pumping rate, the yield, the water main sizing, the existing or proposed water storage, or a legally recorded permit for the well construction or water use. The additional increase in size of the residence on the property and the change from a seasonal Summer usage to year around occupancy could substantially affect the quantity of water available, particularly during low flow periods of the late winter. AIR QUALITY Sections 2 -17 and 5 -106: The proposed residence is allowed one fireplace and one certified wood stove. We will assume that the applicant is aware of this requirement and has an intention to comply. We have concluded that, taken alone, the amount of air pollution produced from development of this lot is not significant enough to affect air quality. However, subdivision controls or restrictions, could minimize the nuisance of road dust, and are suggested. NOISE: Section 2 -23 There will be some short term noise generated from the construc- tion of the dwelling should this proposal be approved. None of the noise is expected to be of significance, if the hours of construction are limited to 7 A.M. to & P.M. The magnitude of a small construction project should not result in the generation of annoying noise levels in or around the other properties in the area. Further, it is anticipated that any construction noise will be of relatively short duration and should not have long term impacts on the immediate neighborhood. However, should any complaints be received by this office the Colorado Noise Abate- ment Law will be the response document. Drainage: I am concerned by the building envelope's placement over slopes in excess of 30 %. However, as the proposed building will be replacing an existing structure, the development should not noticeably alter existing drainage patterns. Impacts on Road System: The proposed development will be replacing one single - family structure with another, and should not significantly impact the existing County road system. Construction at the edge of the hillside can be done especially with 75, of the foundation at grades of less than 59. For best results on testing actual soils conditions, a soils engineer will inspect the site at the time of excavation. If any modifications are recommended, they will be incorporated before construction. A 12 mil minimum vapor retarding sheet, lapped and seated at all joints, will be installed under the slab with venting if required, to prevent any potential radon leakage. All utilities for the site are existing and servicing the existing building, therefore the public will need bear no cost for extending utilities or services. 2 -5. 5 -101 DRAINAGE All drainage will follow existing patterns. The house is located equaldistant from the north slope runoff as the existing structure and is located above any runoff from the slope at the center of the site. The relative small size of the proposed structure will not adversely impact the existing drainage. Refer to attached Plan Z1. 2-6. 2 -22, 5 -107 ADEQUATE PROVISION FOR WATER NEEDS AND WATER RESOURCES IMPACT The new residence will use the well presently on the site that is feeding the existing house, no greater extent of water shall be needed. Present drainage will not be affected and natural vegetation shall be retained that there will be no deterioration to the water quality of, or withdrawal from, the ground water. 2 -7 SEWAGE TREATMENT AND COLLECTION A new leach field and septic tank will be installed at the base of the hill, type and size subject to recommendations from Bill Drueding, Aspen /Pitkin County Zoning Office.
