Dear Rick,
I have researched chain of ownership of the Brad Miller
Property described on "Exhibit A" attached. The property, owned
by Bradley Robert Miller and Mollie Favour was "created ", split
from a larger parcel by Deed recorded August 13, 1965 in Book 214
at Page 510 as Reception No. 121463. A copy of this Deed, the
prior Deed, and subsequent Deeds are enclosed.
From my review of our records after August 13, 1965, I found
that none of the owners of the Miller lot have owned any other
property in Section 16, Township 9 South, Range 85 West.

J Dear Ms. Favour:
I have reviewed the Flood Insurance Study for Pitkin County
prepared by the Federal Emergency Management Agency as it relates
to your property on the Roaring Fork River in the Twining Flats
Subdivision.
A summary of my review is contained in this letter and on the
attached map, which delineates the approximate boundaries of the
flood plain under a 100 year frequency flooding event.
As you can see, the proposed building envelope is beyond the
limits of the flood plain. As shown, your new house will be
situated at a floor elevation of 7300 The water surface
elevation during severe flooding would crest at 7280 allowing
you 20' of freeboard. Even if you were to install a full
basement, you should be free from stream flow related flooding.
If you decide to install a new on -site waste disposal system, you
should locate it in areas above the 7290 contour line to avoid
potential problems..

The topography of the site consists of a 'Large, high bench,
and a smaller, lower bench, carved out of a previously gently
sloping, sagebrush-covered hillside toward the physiographic
floodplain of the Roaring Fork River below. The lower-most
flat bench which will contain most of the proposed home, is
approximately 15 feet above the physiographic floodplain and
therefore well out of the 100-year flood (see plate 10 of the
Floodplain Information Report on the Roaring Fork River,
Aspen to Basalt). There are numerous large cottonwoods at
the base of this 15 foot slope in the floodplain"
The bedrock geology in this area consists of the Cretaceous
age Mancos Shale covered to various thicknesses by a
Quaternary age glacial outwash material. In many areas, this
consists of silts, sands, cobbles and boulders, but on this
site, consists of gray clays and silts of Mancos-derived
soils visible in the several cuts on the property.
Because of the proposed location of the eastern-most side of
the home with respect to the 15 foot steep slope down to the
floodplain, site specific soils engineering will need to be
performed for proper foundation design, even though that
slope shows no signs of instability" This soils report will
be especially necessary because of the presence of Mancos-
derived soils, which may be either compressible or have a
swell/shrink potential. The upper bench will probably have
similar properties to the lower one. There are no other
potential geologic hazards which could affect this site,

It is my understanding that water is already available to the
structure to be used as a gallery, but that a waste disposal
system will be necessary. Ordinarily, terrace material is
permeable enough to insure that a standard septic system with
accompanying leach field may be utilized; however, because of
the soils visible at the site, a search should be made north
of the homesite for an area which has suitable permeability.
Because of the position of the home with respect to the
potential septic site, pumping will be required. If the
percolation rates are not suitable, then a Wisconsin Mound
type system may be necessary, but the Pitkin County
Sanitation Engineer should he consulted for his specific
recommendations. Access to the site will have to be gained
through a minimal cut off the Twining Flat Road near the
northwest corner of the property where the bank is only
several feet high.
This should be a suitable site for the development of a
single family home if the waste disposal issue can be
resolved. The exact placement of the home to within perhaps
six feet of the 15 foot high slope to the floodplain, will be
based on the results of the soils engineering study, which
should also include recommendations for a perimeter drain
system around the building site. If there are further
questions, please do not hesitate to contact me"
