DETERMINATION OF THE HEARING OFFICER OF THE COMMUNITY DEVELOPMENT
DEPARTMENT OF PITKIN COUNTY, COLORADO, REGARDING
THE KANN 1041 HAZARD REVIEW AND CONCEPTUAL
RECITALS
Thomas and Michelle Kann, hereafter "Applicants ", have applied to the Pitkin County Hearing
Officer, hereafter "Hearing Officer ", for a 1041 Hazard Review and Conceptual Submission to
establish a building envelope to accommodate for the construction of a sun porch and any
future expansion to the existing residence.
2. The property is located at 8389 Upper River Road and is specifically described in Exhibit `A'.
3. The property is zoned RS -20 and contains approximately 1.494 acres.
4. The Hearing Officer heard this application at a public hearing on August 20, 1998 at which
time evidence and testimony were presented with respect to this application.
NOW THEREFORE, BE IT RESOLVED by the Pitkin County Hearing Officer that
approval is hereby granted to the Kann 1041 Hazard Review and Conceptual Submission, subject to the
following conditions:
Prior to the issuance of a building permit, the Applicants shall submit an amended 1041 site
plan to the Community Development Department for approval and recording. The site plan
shall also be submitted in digital format for integration into the County's GIS system. The
site plan shall include the follow:
A. The site plan shall be identified as "Kann 1041 Hazard Review."
B. The building envelope shall be delineated on the site plan as amended by staff. The
setbacks for the building envelope shall include a 30 foot front yard setback, 20 foot side
yard setbacks, and a 30 foot rear yard setback.
C. A vicinity map shall be included on the face of the site plan.
D. The appropriate signature blocks shall be included on the face of the site plan.
E. The following 1041 Hazard Review warning and disclaimer shall be placed on the site
plan:
"The provisions of these regulations do not in any way assure or imply that areas outside
of the designated hazard area will be free from hazards, or that approved mitigation
measures will guarantee the safety of any property. "
2. No development, including grading, landscaping, vegetation removal or disturbance, shall
occur outside of the approved building envelope, except for utility and driveway extension
and maintenance.

3. The Applicants shall comply with the following standards for development on slopes of
greater than 15 %:
A. Adequate mechanical support shall be provided for cut slopes.
B. Adding water which may decrease slope stability shall be avoided.
C. Adding weight to the top of the slope shall be avoided.
D. Disturbed slopes must be contoured so that they can be revegetated.
E. Steepening of existing slopes shall be avoided.
F. Confine cuts, fills, grading and excavation to the minimum area needed for construction.
4. The Applicants shall removed the lower limbs of the vegetation to the east of the house to
eliminate ladder fuels.
5. A fireplace /woodstove application must be filed and approved by the Environmental Health
Department prior to the issuance of a building permit.
The future replacement of the existing septic system shall comply with the County's septic
regulations and be designed by a registered professional engineer.
Prior to recordation of the 1041 site plan, the applicant shall be granted lot line adjustment
approval for the deck encroachment, or the deck encroachment shall be removed.
8. Any additions or modifications to the out - building requires further County review and
approval.
Prior to the issuance of a building permit, the Applicants shall submit either an access permit
or a road encroachment permit to the County Engineer for review and approval for the
proposed modifications to the existing driveway. The proposed driveway entrance shall not
encroach into slopes of greater than 30 %. Due to the limited site distance, during driveway
modifications, the Applicants shall provide signage along Upper River Road for the
construction activity.
10. All material representations made by the Applicants in the application or in public meeting
shall be adhered to and considered conditions of approval, unless amended by other
conditions.

MEMORANDUM

DATE: August 20, 1998
REQUEST: The applicants are requesting a 1041 Hazard Review and Conceptual Submission approval to
establish a building envelope in order to accommodate the construction of a sun porch on the southeast
portion of the existing residence and any future expansion.
APPLICANT'S: Thomas and Michelle Kann
LOCATION The property is located at 8389 Upper River Road.
ZONING /SIZE: RS -20 /approximately 1.95 acres
REFERRAL COMMENTS: Referral agency comments are incorporated throughout this memorandum,
and are attached for reference. Referrals were received from Environmental Health, Colorado State Forest
Service, Zoning Office, County Engineer, Woody Creek Caucus and the Aspen Fire District. The Colorado
Division of Wildlife, County Wildlife Biologist, and County Attorney did not provide comments.
STAFF COMMENTS
1041 HAZARD REVIEW
Wildlife: The subject parcel does not lie within any mapped wildlife area.
Wildfire: Vince Urbina of the Colorado State Forest Service has rated the wildfire hazard on the property
as low to medium. Mr. Urbina has noted that the existing vegetation on the site consists of irrigated turf,
landscape plants and parking on three sides of the home. The only problem area identified by Mr. Urbina is
above the house to the east. The vegetation is Gambel oak and serviceberry. Although this vegetation is
not within 20 feet of the house, Mr. Urbina recommends that the owners remove the lower limbs to
eliminate ladder fuels.
GENERAL SUBMISSION
Water /Air Quality: The Environmental Health Department (EHD) has indicated the addition of a sun
porch will not impact the water and air quality. The existing well and septic system are located within the
proposed building envelope.
Sewer: The lot is serviced by an individual septic system. The proposed sun porch is located on the
opposite side of the house from the septic system, however, EHD had noted that caution should be taken
that construction vehicles do not drive over the leach field. EHD has also indicated that the according to

their records, the septic system was installed in 1975. The owner should be aware that the average lifetime
of an septic system is 15 -20 years.
Access: Access to the property is off of Upper River Road. The driveway is fairly step with a blind egress
onto Upper River Road. The applicants are requesting approval to widen the base of the driveway to allow
for a larger turning area. The widening of the base of the driveway may result in the encroachment of
slopes of greater than 30 percent. Bud Eylar, County Engineer has reviewed the application and has
indicated that the applicants shall submit for an access permit for the road cut/encroachment. Upon
approval and construction, the applicants shall be required to post signage along the road regarding the
construction activity due to the limited site distance.
Geologic: The proposed sun porch will be constructed in an area of slopes of greater than 15 percent, but
less than 30 percent. This area of slopes was previously excavated, back -filled and landscaped. The
applicants have indicated that the cut into the slope area will be minimal and immediately contiguous to the
existing structure. The retaining wall is being designed by Brian Kutz, a structural engineer.
The applicant will be required to comply with the standards of Section 3- 80- 050(C) of the Land Use Code
regarding the construction on potentially unstable slopes.
Other Issues: The required setbacks for the property are 30 foot front yard, 20 foot side yard and 30 foot
rear yard. Joanna Schaffner, Zoning Officer, has reviewed this application and has indicated that that
proposed building envelope should not encroach into the 30 foot rear yard setback or the 20 foot side yard
setback. In addition, development within the required setbacks is not allowed without Board of Adjustment
approval.
The Woody Creek Caucus has reviewed this application and has forwarded in an attached letter their
concerns.
Ed Van Walraven, Fire Marshal, has reviewed this application and has indicated that the project shall meet
all of the applicable codes and requirements of the Aspen Fire Protection District.
To comply with the required setbacks of this parcel and to eliminate areas of slope than encroach into slopes
of greater than 15 percent, staff has modified the proposed building envelope. In the modification of the
building envelope, the existing deck and three fourths of the outbuilding lie within the 20 foot side yard
setback of the property. Staff is requiring that the applicant receive approval for a lot line adjustment prior
to the issuance of a building permit or the encroachment portion of the deck shall be removed. In addition,
as mentioned by the Zoning Officer, development within the setback requires approval from the Board of
Adjustment.
RECOMMENDATION: Staff recommends that the Hearing Officer approve the Kann 1041 Hazard
Review and Conceptual Submission, subject to the conditions of approval in the attached Hearing Officer
Determination.

The following are comments pertaining to the Kann 1041 Hazard Review from
this department:
Our files indicate that a modification to the building envelope and the addition of a sunporch will
not impact the air or water quality issues that this department reviews. The existing well and
septic system will still be located within the building envelope. The proposed sunporch is on the
opposite side of the house from the septic system, although caution should be taken that
construction vehicles do not drive over the leach field. Adding a sunporch will not trigger an
increase in the size of the septic system, unless this department determines that the room could
be used as a bedroom during the lifetime of the home.
According to our records, the septic system was installed in 1975. The current owner should be
made aware that the average lifespan of an individual septic system is 15 -20 years.
If the owner intends to install a fireplace device, a fireplace application must be filed with this
Department.

I read the application and visited the site with the owners and their representative
on August 3 This parcel can be accessed from River Road. The owners are
proposing an addition on to the existing structure. The existing vegetation
consists of irrigated turf, landscape plants and parking on three sides of the
home. The only problem area is that above the house to the east. This
vegetation is Gambel oak and serviceberry. Although it is not within twenty feet
of the house I recommended that the owners remove the lower limbs to eliminate
ladder fuels. They had already removed the lower limbs on some Gambel oak
left in the landscape. I would rate the wildfire hazard as low to medium.
The owners had also cut down some Gambel oak to reduce the wildfire hazard
south of the existing landscaped area. Based on what I observed at this
property and my conversations with the owners I am confident they will follow
through with my recommendations to remove the ladder fuels on shrubs above
the house.

Dear Tamara:
We hope that you will address the following issues:
The property has a very limited building site; the existing footprint with decks appear to already
extend beyond the legal limits. The driveway is extremely steep with blind egress (as applicant
stated) onto a very busy county road.
Question the one -step process when no building envelope exists with a request for an addition.
Will there be a public hearing? Proper notification must be received by neighbors.
Where is the sewer and septic currently located?
There are many encroachments and easements for utilities, KN Energy, Holy Cross, US West,
fiber - optics, public right -of -way, Rio Grande, driveway, county road, water, sewer, unstable
steep slopes, and neighboring properties, to name a few, that must be considered in the review
process.

In further discussion with the Zoning Officer, it has been determined that the rear
property line is the south property line (deck side). The setback should be 30'. The front
property line is the access side of your property. Therefore, the front yard setback is not
from Upper River Road, the front yard is the north property line. The side yards setbacks
are the east and west property lines. The side yard setback is 20'. Sorry for the
confusion. I have tried to show you the change on the attached sheet.
In addition, you are not required to go through Board of Adjustment for the outbuilding.
However, further review and approval is required by the County if the building is
modified. I will sent out an amended resolution to reflect this change.

We propose to add a small addition to the existing single family
residence. To accomplish this we must delineate a building
envelope in conformance with a 1041 hazard review.
Plans for the addition are attached. This sunporch addition
projects into a previously excavated and then backfilled and
landscaped hill which is addressed in this 1041 review
application.
We ask for a hearing officer review Section 3- 80.10. We ask for
a one -step review procedure Section 4 -50.
Section 3- 80.50.0 Potential Unstable Slopes. The sunporch
addition cuts into a slope which was previously excavated,
backfilled, and landscaped. We cut into the slope minimally and
immediately contiguous to the existing structure. We have had
our retaining wall designed by Brian Kurtz, structural engineer,
design and detail sheet attached. This location has been
previously disturbed. We cut into what has been backfilled
against the existing house. No water will be added as no
landscaping will be added. We will regrade and revegetate the
contiguous slope to it's existing contours. The existing slope
is less than 30 %.
Section 3- 80.70.B Low and Medium Hazard Wildfire Areas. Lance
and Gabe, during a site visit, noted that we have a minor hazard
due to oak brush and vegetation. Our building site avoids most
of the hazard. We are in the process of establishing a
"defensible space. We have already begun to remove all brush
within 10' of all structures. Our building envelope flat ground
is an irrigated lawn. The sloped portion of the site is barren
rock.

2. APPLICANT understands and agrees that Pitkin County Resolution
No. 96 -52 establishes a fee structure for Planning applications and the payment of
all processing fees is a condition precedent to a determination of application
completeness.
3. APPLICANT and COUNTY agree that because of the size, nature or
scope of the proposed project, it is not possible at this time to ascertain the full
extent of the costs involved in processing the application. APPLICANT and
COUNTY further agree that it is in the interest of the parties to all APPLICANT to
make payment of an initial deposit and to thereafter permit additional costs to be
billed to APPLICANT on a monthly basis. APPLICANT agrees he will be
benefited by retaining greater cash liquidity and will make additional payments
upon notification by the COUNTY when they are necessary as costs are incurred.
COUNTY agrees it will be benefited through the greater certainty of recovering its
full costs to process APPLICANT's application.
4. COUNTY and APPLICANT further agree that it is impracticable for
COUNTY staff to complete processing or present sufficient information to the
Planning Commission and/or Board of County Commissioners to enable the
Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior
to decision.
