GRANTING THE GODFREY /LANDIS SUBDIVISION EXCEPTION/
LOT LINE ADJUSTMENT
Resolution No. 87 -
WHEREAS, Wayne Landis and Peter Godfrey (hereinafter
"Applicants") are the owners of real property in the portion of
Pitkin County known as Little Texas; and
WHEREAS, the applicants have proposed a lot line adjustment
consistent with Section 4- 2.2(a)(1) of the Pitkin County Land Use
i Code; and
WHEREAS, the Board of County Commissioners considered the
applicants request at a regularly scheduled public meeting on
October 13, 1987.
NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of
County Commissioners that it hereby grants a Subdivision Excep-
tion/Lot Line Adjustment to the applicants pursuant to Section 4-
2.2(a)(1) of the Pitkin County Land Use Code subject to the
following conditions:
i 1) The portion of the driveway depicted on Exhibit 1 which
crosses the Landis parcel will be shown as a 20 foot
wide driveway easement on the final plat.
2) The lot line adjustment plat should include a note
restricting the driveway to a one laned road.
3) The plat should be prepared consistent with the
language regarding plats in Appendix A of the Land Use
Code.

Dear Debbie:
I am enclosing the original mylar of the Godfrey- Landis
Subdivision Exemption Boundary Line Adjustment Plat which
has been signed by Peter Godfrey and the Landises and the
surveyor, Ken Wilson. This subdivision exemption was
approved by the Board of County Commissioners on October
27, 1987 by Resolution 87 -92. The Landises had difficulty
obtaining a parcial release of deed of trust of the
exchange parcel. That partial release was recently
recorded at Book 568, Page 770, and the various exchange
deeds between Godfrey and Landis were placed of record on
August 4, 1988, in Book 570, Pages 206 - 210. Please have
the appropriate representative of the Board of County
Commissioners execute the Plat and have it recorded with
the County Clerk and Recorder. I have also enclosed my
check for $10.00 made payable to the County Clerk and
Recorder for that purpose. If you need anything further in
order to complete this plat recording, please advise.

I picked up a copy of the proposed Resolution at the
Planning Office. I have the following comments:
1. Condition No. 1 states that the driveway depicted
on Exhibit 1 (which was not attached) is to be shown as a 20
foot wide driveway easement. It is my understanding from our
various telephone conversations and from the Planning Office
memorandum of October 13, 1987, that only a portion of the
driveway would be a 20 foot wide access easement along the
upper road and the east side lot line of the Landis parcel
and then west approximately 60 feet. The language of
Condition No. 1 seems to state that the 20 foot easement
encompasses the entire driveway, although this is inconsis-
tent with the Planning Office memorandum. Perhaps you could
reference the plat that is being revised by Schmeuser,
Gordon, Meyer. In any event, the Resolution should be clear
that only the first portion of the driveway is required to be
20 feet wide.
2. Regarding Condition No. 2 stating that the plat
should include a note restricting the driveway to a one lane
road, it was my understanding that the notation would
restrict the easement to a one lane road unless any widening
is approved by the county engineering department. It is my
understanding that your concern was that we not be able to
cut into the bank of the road to widen it without having an
engineer's report on the stability of the bank and some plan

for retention of the bank in the event of any stability
problem. Please let me know if this is not consistent with
your understanding.
3. Finally, it was my understanding that the approval
was given on October 13, 1987 rather than October 27, 1987 as
stated in the form of Resolution.

INTRODUCTION
The purpose of this application in to complete a lot -line
adjustment and exchange of equal sized parcels for the purpose of
resolving an easement dispute between two neighbors.
APPLICANTS: Wayne and Marjorie Landis and Peter Godfrey
ZONING: AF -1
APPLICANT'S REPRESENTATIVE: Joe Edwards and Joe Krabacher
LOCATION: Little Texas Subdivision

1) Planning Engineer - The applicants have shown 10 and 20
foot wide access easements on their proposed plat. As
noted in Tom Newland's referral memorandum (see
attachment 1), the County standards require driveway
easements to be 30 feet wide. Subsequent to the time
that the referral memorandum was written, Tom, Joe
Edwards and I visited the site to see if the 10 foot
and 20 foot wide driveway easements would be adequate
to serve the Godfrey, Landis and Newton properties that
would be accessed by the driveway. The situation has
been resolved provided that the small portion of the
driveway easement outlined on Attachment 1 is expanded
to 20 feet in width and there is a condition placed on
the lot line adjustment plat limiting the driveway to a
one lane road.
PLANNING OFFICE COMMENTS:
Section 4- 2.2(a) (1) of the Land Use Code establishes a procedure
for a lot line adjustment as a subdivision exemption. A lot line
adjustment is permitted provided that the following five criteria
are met:

1. The adjustment creates not more than the original
number of lots.
2. The purpose or effect of the lot line adjustment is not
the creation of a new lot or parcel for development or
resale purposes.
3. In the case of conforming lots and parcels, any result-
ing lot or parcel shall conform to the minimum require-
ments for area or width established by the provisions
of the Code.
4. In the case of existing nonconforming lots or parcels,
any resulting lot or parcel shall not increase in
nonconformity.
5. All laws relating to the amendment of recorded plats
are complied with.
The subject parcels are existing non - conforming lots. Equal size
parcels are being exchanged. The non - conformities of the lots are
not being increased. The applicant will prepare a plat that
meets the County standards.
The proposed application benefits both of the applicants because
it resolves a dispute between the property owners. The Planning
office recommends approval subject to the following three cond-
itions.
1. The portion of the driveway depicted on attachment 2
which crosses the Landis parcel should be shown as a 20
foot wide driveway easement on the final plat
2. The lot line adjustment plat should include a note
restricting the driveway to a one lane road.
3. The plat should be prepared consistent with the
language regarding plats which is found in appendix A
of the Land Use code.

I have reviewed the application submitted by Joe Erabacher on
behalf of his client, Godfrey /Landis and would like to forward
the following comments to you:
Roadway design and construction: The application submitted, it
appears that the applicants propose to open a new access on Upper
River Road that will service 2 or possibly 3 residents. Section
2.24 Driveways of the Pitkin County Road Standards and Specifi-
cations (see attached) states that a 30' wide access easement
shall be granted to adjacent owners. However, if the easement is
to follow an existing driveway, and a 30' width is not easily
obtainable (as determined by the County Attorney), a 20' easement
may used if the Owners agree to:
in -road burial of any future utility placements;
retention of side slopes as necessary;
I am slightly familiar with the site from the Newton 1041 review
conducted last year. The access proposed does cross a relatively
steep slope as it travels from the Godfrey parcel to the County
road. If the applicants cannot obtain a 30' wide easement, the
existing road must be reviewed by a certified engineer for
placement of retention structures, if necessary.
The 10 -foot wide access to the river level for the Godfrey parcel
and the owners of tracts in Little Texas doesn't conform to the
above mentioned Driveway standard. The use of this access is
unknown. An inspection of the site should be performed to
determine the applicability of the driveway standards to this
access. The portion of the 10' access between the proposed
addition to the Godfrey lot and the shared property line of the
parcels should have a 20' wide access easement.
Other driveway standards require that the access approach the
county right -of -way in a perpendicular fashion, have a driving
surface that is between 8 and 16 feet wide, and provide for
adequate drainage ofthe road ditch.

Effects on Road System: The proposal will open another encroach-
ment on to Upper River Road. The road presently carries ? ? ??
vehicles per day, but this number will reduce significantly with
the removal of gravel truck traffic next spring. It has been the
policy of the county to limit encroachments on to the county road
system whenever possible.
Plat Requirements: All the necessary language required by
Appendix A of the Land Use Code has been accurately placed on the
Plat.

In roadside design, attention is to be given to the preser-
vation of natural ground covers and desirable growth of
shrubs and trees within the right -of -way. While specific
design determinations are needed, such steps to mold the
cross - section to fit the areas to be preserved contribute
much to maintenance economy and the refinement of the whole
highway.
2.24 Driveways
Driveways aie roads that serve one to three residential or
agricultural uses and have a traffic volume of less than 25
vehicles per day. If the driveway serves more than one
owner and is new construction, a thirty -foot (30 easement
shall be granted to adjacent owners. If a driveway serves
more than one owner and an existing driveway is to be used
and a thirty -foot (30 easement is not reasonably obtain-
able, as determined by the County Attorney, a twenty -foot
(20 easement may suffice, provided the owners agree to
retain side slopes as necessary and agree to in -road utility
burial. An encroachment permit (and, possibly, a U.B.C. ex-
cavation and grading permit) is required for all driveway
construction.

This letter is submitted pursuant to Article 4, Section
4- 2.2(a)(2) of the Pitkin County Land Use Code for a subdivi-
sion exemption and lot line adjustment of two parcels of
property situated in Little Texas Subdivision, Pitkin County,
Colorado. With this letter we are enclosing the following:
1. Land Use Application form completed by the Appli-
cants.
2. Ownership reports prepared by Stewart Title of
Aspen and Pitkin County Title, Inc. establishing proof of
ownership of subject parcels.
3. Copy of Settlement Agreement authorizing the filing
of this subdivision exemption application by the owners of
the subject parcels.
4. Proposed amended plat containing vicinity map.
5. Application fee of $825.00.
The balance of this letter will address the provisions
of Pitkin County Code §4- 2.2(a)(2)(A) -(E) and §4 -2.3. As an
initial matter, approval of this subdivision exemption is in
the public interest because it resolves a long- standing
dispute over access to the Little Texas Subdivision for all
affected owners, including the Applicants. The resolution of
this matter will guarantee access for the Applicants as well

as other adjacent property owners. It will also serve to
eliminate pending litigation that is not in the public
interest due to the drain upon County resources such as the
court system and members of the public who contribute to the
court system both as taxpayers and as jurors or prospective
jurors.
1. The purpose of the present application is to adjust
the lot line between adjacent parcels under separate owner-
ship. The adjustment will not create more than the original
number of lots or parcels because the adjacent property
owners are exchanging parcels of equal size and are not
creating any new lots or parcels. Therefore, the provisions
of §4- 2.2(a)(2)(A) are satisfied.
2. The purpose of the lot line adjustment is to settle
pending litigation in Pitkin County District Court Case
No. 86CV241, Wayne R Landis and Marjorie A. Landis v. Peter
E. Godfrey. Jr. and Jack Pate The parties are exchanging
respective parcels that are of equal square footage, so the
lot line adjustment is not being accomplished in order to
create a new lot or parcel that has substantially different
size of dimension. Accordingly, the provisions of
§4- 2.2(a)(2)(B) are satisfied.
3. The resulting lots or parcels are presently
nonconforming, so the provisions of §4-2.2 (a) (2) (C) are not
applicable.
4. The existing lots or parcels are presently noncon-
forming. The land exchange and lot line adjustment will not
increase the nonconformity of the lots because the lot sizes
will remain exactly the same and the lots will continue to be
used for single- family residential purposes. The number of
off - street parking spaces will remain unchanged, and the lot
line adjustment will not change the minimum set backs.
5. All laws relating to the amendment of recorded
plats are complied with by virtue of the enclosed proposed
Godfrey /Landis Subdivision Exemption Plat that contains the
legal descriptions of all of the relevant parcels, the
certificate of the clerk and recorder, the surveyor's
certificate, and necessary approvals.
6. Pursuant to §4 -2.3, enclosed are certificates from
licensed title insurance companies setting forth the names
and addresses of all owners and including all mortgages,

judgments, liens, etc. of record affecting title to the real
property. The applicants are the owners of the property and
by virtue of that ownership have the right to use or deal
with the subject properties. A proposed plat map indicates
the location of the parcels, the acreage of each parcel, the
existing and proposed lot lines and easements, existing and
proposed roads, and has been prepared and certified as to
accuracy by a registered land surveyor. Accordingly, the
application has complied with the provisions of Code g4 -2.3.

THIS SETTLEMENT AGREEMENT is entered into
F F L'P ,2z_ 2 la 1987, by and among Wayne R. and Marjorie A.
Landis ( Landises), Peter E. Godfrey, Jr. (Godfrey), and
Jack Pate (Pate), sometimes collectively referred to herein
as the parties. .
RECITALS
A. The parties are parties to a lawsuit presently
pending in the District Court, Pitkin County, Colorado,
Case No. 86CV241.
B. The pending lawsuit involves, among other things,
the issue of rights to use of a middle roadway and an upper
roadway for access to and from the parties' properties in
Little Texas, Woody Creek, Pitkin County, Colorado.
C. The parties have reached an oral agreement
settling and disposing of all of the issues in the pending
lawsuit described above and desire to set .forth their
agreement in' writing in pursuance of a settlement and
disposal of the pending lawsuit.
NOW, THEREFORE, subject to the provisions of paragraph
5 below, the parties agree as follows.
1. The Landises agree not to use the middle
roadway for access for ingress and egress to their proper-
ty. The Landises' access to their property shall be via
their easement along the upper roadway as described in
their deed recorded in Book 500 at Page 77 of the Pitkin
County records.
2. Godfrey and Pate shall have a perpetual
non - exclusive easement across the property of Landises for
access for ingress and egress to their property via the
upper roadway.
3. Rick Newton, the owner of property to the
north and west of Landises' property, may, at the option of
the Landises, be granted a ten -year renewable non - exclusive.
license for ingress and egress to one single- family dwell-
ing located on his property via the upper roadway, provided
he agrees to abide by such reasonable conditions on use
thereof as the Landises may impose, including a requirement
that he share costs of improvement, maintenance and snow
plowing of the upper roadway with the Landises. Godfrey
and Pate represent that they can and shall obtain the
approval in writing of Leora Pate Andrew and any other
landowners necessary to give Rick Newton a valid license
for access along the upper roadway.
4. The Landises shall have the right within the
limits of the easement to improve the upper roadway and to
perform any construction or maintenance work on the upper
roadway from time to time as shall be reasonably necessary
or desirable to maintain the road in acceptable condition
for use for access. This shall include, but not be limited
to, the right to regrade, excavate, widen, resurface,
gravel, oil, pave, straighten or realign the roadway,
provided that any such work shall be done at a reasonable
time and in an efficient manner so as to minimize interfer-
ence with use of the road and be the sole responsibility
and expense of the Landises and Rick Newton, in the event
he agrees to and does use the roadway.
5. Landises may apply for issuance by the
Pitkin County Road and Bridge Department of a permit for a
new road cut from the upper roadway to the county road and
perpendicular thereto just west of the existing access to
the county road. Godfrey and Pate agree to cooperate fully
with the Landises in their efforts to obtain such permit.
This agreement is expressly contingent on approval by the
County of the land trade set forth in paragraph 6 below as
an exemption from county subdivision regulations.
6. Landises and Godfrey agree to enter into a
land trade whereby Godfrey shall convey by warranty deed to
Landises free and clear marketable title to a quadrangular
parcel of land near the river level as shown on Exhibit A
contiguous to and to the east of the Landises' parcel
subject to the ten- foot -wide existing access road for the
use by Godfrey and other owners of parcels in-the Little
Texas area for access to the river level of their parcels;
and Landises shall convey by warranty deed to Godfrey free
and clear marketable title to a generally quadrangular
parcel of land of equal area as approximately located on

Exhibit A contiguous to and west of the portion of the
Godfrey property adjacent the as -built Godfrey cabin. The
exact boundaries of the parcel to be conveyed to the
Landises by Godfrey is shown on Exhibit A. The exact
boundaries of the parcel to be conveyed to .Godfrey by the
Landises shall be determined by Godfrey provided such
parcel on its westerly end shall abut the east side of the
upper road easement in a manner to allow auto turning
radius access from the upper road to such parcel. The
parcels being exchanged shall be of equal area. The
exchange parcels shall be surveyed and a legal description
thereof prepared by Schmueser and Associates, Engineers.
7. Landises and Godfrey hereby agree to be
responsible for and to each pay one -half of the costs of
the survey work by Schmueser and Associates. If Schmueser
& Associates requires any retainer or advance on their
estimated fee, the Landises shall deposit one -half thereof
and Godfrey and Pate shall deposit one -half thereof.
8. The Landises' attorney shall prepare the
deed for transfer to Godfrey and Godfrey's attorney shall
prepare the deed for transfer to Landises. Landises c+Rrmw
attorney shall prosecute the application for subdivision
exemption for the common boundary line adjustment between
adjacent landowners.
9. The parties acknowledge that the case is
still pending before the court. On full execution of this
agreement, the parties will vacate the current trial date.
On execution of the transfer documents referred to in this
agreement, the parties agree to and shall sign a stipu-
lation for filing with the court dismissing the pending
case with prejudice. In the event the approvals referred
to in paragraph 5 above have not been obtained or this
agreement has not been fully performed by the parties on or
before June 1, 1987, or such later date as may reasonably
be required to obtain the county approvals referred to in
paragraph 5 above, this agreement shall be null and void;
and either party may set the pending case for further
proceedings. The terms and conditions of this settlement
agreement shall.not be made known to the court until such
time as the agreements and transactions contemplated herein
have been fully performed unless the court so requires as a
condition of vacating the trial date.
