OF PITRIN COUNTY, COLORADO, GRANTING APPROVAL FOR 1041
REVIEW, AND GENERAL SUBMISSION FOR THE
STURM PROPERTY
Resolution No. 93- 5
RECITALS
1. The Board of County Commissioners of Pitkin County
(hereinafter "Board ") has reviewed a request by Angelica and
William Strum (hereinafter "applicants ") for 1041 Hazard Review
and General Submission for a single - family residence.
2. The property is described as Lot 2 of the Little Texas
Subdivision located in the Woody Creek area and is approximately
.5 acres in size and has legal access off of Upper River Road via
a shared access drive. The subject property is more fully described
in the attached Exhibit A.
3. The Pitkin County Planning and Zoning Commission reviewed the
applicants request at a regularly scheduled meeting on August 3,
1993 and recommended approval of the Applicant's request with
conditions.
4. The Board of County Commissioners of Pitkin County reviewed
the applicants request at a regularly scheduled public meeting on
September 28, 1993 at which time testimony and evidence was
offered by the applicant and the public.
5. With the exception of the Applicant's request to include an
area of slopes in excess of 30 percent in the proposed building
envelope, the Board of County Commissioners found the Applicant's

5. The applicant shall provide a copy of the vacated road
easement for the existing road passing through the property
and shall provide a legal description of the proposed
relocated access easement. This easement shall include
language providing access to adjacent properties as needed and
shall be review and approved by the County Attorney before a
building permit is issued.
6. The applicant shall comply with County air quality and
lighting standards in effect at the time of building permit
issuance.
7. A 20 foot setback from the mean high water line of the Roaring
Fork River shall be delineated on the site plan. The intent
of this setback shall be the preservation of the riparian area
associated with the Roaring Fork River in its natural state.
To accomplish this native vegetation shall be maintained
within this area. Thinning and pruning if this vegetation
shall be prohibited.
8. The County requests that the applicant grant a fishing
easement along the Roaring Fork River. Said easement shall
encompass the area from the centerline of the River to a point
5 feet above the high water line on the bank. The easement
could be delineated on the 1041 Plat.
9. Septic system design and location shall be approved by the
Environmental Health Department prior to building permit
application.
10. Prior to issuance of a building permit, the applicant shall
provide documentation of an adequate domestic water supply.
Quantity and quality of said supply shall meet the approval
of the Environmental Health Department.
11. No development shall occur outside of the building envelope
other than the access drive and any necessary utility
extensions.
12. Prior to building permit application the applicants shall
obtain necessary variances from the front and rear yard
setbacks from the Board of Adjustment.
13. Any new residential structure built on the property shall be
designed with adequate subfloor ventilation or gas shielded
foundation walls to prevent excessive levels of radon.
Building plans shall be reviewed and certified by a registered
professional engineer or a ventilation design expert.

request to be consistent with the applicable sections of the Pitkin
County Land Use Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that it does hereby grant approval for the 1041
Review and General Submission for the Sturm property subject to
the following conditions:
1. Prior to recordation of the 1041 site plan, the building
envelope shall be modified to eliminate all areas of slopes
in excess of 30 percent.
2. Prior to building permit application, the applicant shall
record a 24 x 36 inch mylar 1041 Review site plan which meets
the approval of the Planning Office and County Attorney.
a. The following 1041 Hazard Review Warning and
Disclaimer shall be noted on the Plat:
"The provisions of these regulations do not in any
way assure or imply that areas outside of designated
hazard areas will be free from hazards, or that
approved mitigation measures will guarantee the
safety of any property."
3. Building foundations shall be reviewed and certified by a
Colorado registered professional engineer. Foundation plans
shall be submitted at building permit application.
4. The applicant shall adhere to the criteria stipulated in
Section 5- 401.2(h) as follows:
a. Cuts shall not be made into slopes steeper than thirty
percent (30 %) in grade.
b. Cuts and fills, and grading and scraping shall be
confined to the minimum area needed for construction.
C. Steepness of cut and fill slopes shall be the maximum
which will insure stability and still allow revegetation.
d. Use mulches or temporary cover on exposed soil areas and
re- establish permanent vegetation and install erosion
control measures as soon as possible.
e. Incorporate natural drainage patterns into the
development plan.

14. The applicant shall join a road improvement district in the
event that one is formed.
15. The mobile home trailer currently located on the property
shall be removed within 90 days of the Board of County
Commissioners meeting at which this 1041 Environmental Hazard
Review was granted.
16. A Temporary Use Permit shall be obtained for the existing
cabin located on this property, in the event this cabin is to
be used or occupied during construction of a new primary
residence. Such Temporary Use Permit shall be obtained prior
to issuance of building permit for the primary residence, or
the cabin shall be demolished or rendered nonhabitable prior
to the building permit issuance.
17. All material representations made in the application and in
public meetings shall be adhered to.
APPROVED by the Board of County Commissioners at its regular
meeting on September 28, 1993.

SUMMARY: The Planning and Zoning Commission reviewed this
application at a public meeting on August 3, 1993. The Planning
office recommend approval of the Applicant's request with
conditions. The most important condition was that the building
envelope be modified to exclude all areas of slopes in excess of
30 percent. The Planning and Zoning Commission also recommends
approval with the conditions identified at the end of this memo and
in the attached draft resolution of approval. The P &Z has not
required any modification to the proposed building envelope.
REQUEST: The applicant is requesting 1041 Hazard Review and
General Submission approval for the construction of a single -

since the property is relatively small and the lower portion
of the site is unsuitable for septic systems due to high water
table and potential flooding. In addition, the septic system
must be at least 100 feet from the shared well.

Slopes
A portion of the proposed building envelope encroaches on an area
of ste ep.- s_?gpes (3fi *+P_ - rr�ent] . Sect 5 -401.2 fh) S,2A of the Code
stipulates that development shah be discouraged on slopes of 15%
and greater unless problems of stability and erosion can be
overcome. Any development approval is to be based on a detailed
site survey including geologic and engineering analysis and is to
comply with the following:
1. Cuts shall not be made into slopes steeper than thirty
percent (30 %), unless mechanical support is provided.
2. Cuts and fills, and grading and scraping shall be
confined to the minimum area needed for construction.
3. Steepness of cut and fill slopes shall be the maximum
which will insure stability and still allow revegetation.
4. Use mulches or temporary cover on exposed soil areas and
re- establish permanent vegetation and install erosion
control measures as soon as possible.
5. Incorporate natural drainage patterns into the
development plan.

There have been several lots with similar soil and slope conditions
approved in this subdivision in the last few years. These approvals
have involved development on the steep slopes. The recommendations
of the applicants consulting geologist are consistent with the
recommendations for previously approved properties.
Most recently, the Planning and Zoning Commission reviewed the
Underwood /Twiss property which is at the opposite end of the

Floodplain
While the Roaring Fork River floodplain does encroach on the
subject property, it is well below the buildin_g sit as delineated
on the site plan. The conditions of approval include a requirement
that a 20 foot stream setback be established and that no
development or vegetation alteration whatsoever be allowed with
this setback.
1041 Summary
The intent of the Code is to discourage development on slopes in
excess of 30 percent. While it appears that mitigation of the
development can be accomplished, given the recommendations of the
applicant's consulting geologist, the site includes a significant
area with slopes less than 30 percent. The position of the Board
of County Commissioners was clearly expressed during the hearing
for the Underwood /Twiss case. The Board's position was that when
a property includes areas of slopes less than 30 percent, which are
of adequate size to accommodate reasonable development, no
disruption of slopes in excess of 30 percent should be allowed.
While this position is contrary to previous approvals granted in
this subdivision in the past few years, the Board was not involved
in the previous approvals in this area and is of the opinion that
firmer enforcement of the steep slopes regulations is necessary.
GENERAL SUBMISSION
Drainage and Erosion - During the review of the Underwood /Twiss
case the County Engineer identified a drainage problem on the
access r oad for the Little Texas Subdivisioff. At - that - time, Bud
Eylar recomme do ed that a ect -of -mss problem should not
*,�'T be the sole responsibility of any one lot owner, but rather should
be resolved by the all of the lot owners who utilize the access
road, including the applicants.

Impacts to Roads - Development of this parcel will have negligible
impacts on Upper River Road.
Scenic Ouality - The building envelope on the subject property is
well below the grad of Upper River Road and the structure within
this envelope should be only sli ghtly visible from the roadway. The

Utilities - Telephone, electric and natural gas are currently
'4vailable on the property. Water and wastewater disposal are to be
handled on site by means of a shared well an on -site septic system.
Finally, while it is not required, it is requested that the
applicant consider granting a fishing easement along the Roaring
Fork River. Said easement should encompass the area from the
centerline of the River to a point 5 feet above the high water line
on the bank.
SUMMARY: The Planning and Zoning Commission reviewed this
application at a public meeting on August 3, 1993. The Planning

requested subject to the following conditions:

record a 24 x 36 inch mylar 1041 Review site plan which meets
the approval of the Planning Office and County Attorney.

6. A 20 foot setback from the mean high water line of the Roaring
Fork River shall be delineated on the site plan. The intent
of this setback shall be the preservation of the riparian area
associated with the Roaring Fork River in its natural state.
To accomplish this native vegetation shall be maintained
within this area. Thinning and pruning if this vegetation
shall be prohibited.
7. The County requests that the applicant grant a fishing
easement along the Roaring Fork River. Said easement shall
encompass the area from the centerline of the River to a point
5 feet above the high water line on the bank. The easement

The Aspen / Pitkin Environmental Health Department has reviewed the
above - mentioned land use submittal under authority of the Pitkin
County Code Title II, and has the following comments.
SEWAGE TREATMENT AND COLLECTION: Sections 2 -7 and 5 -200:
The applicant will have to obtain an individual sewage disposal
system permit from this office. It will be necessary to construct
a more expensive engineered system if groundwater is present.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2 -6 and 5 -205•
The applicant will need to provide documentation on the capacity of
the shared well to ensure that it provides adequate water.
AIR QUALITY: Sections 2 -17 and 5 -106•
This project is not expected to contribute significantly to air
quality degradation.
A condition of approval should be that the applicant agree to
construct the new house with adequate ventilation and /or design to
prevent excessive levels of radon in the house, as determined by a
registered professional engineer or ventilation design expert.
Prior to demolition of the existing house, the applicant should
have it tested for the presence of asbestos. If asbestos -

the Colorado Health Department regarding proper removal.
A report on air quality impact is required to address air quality
characteristics of the site and the proposal. This includes
addressing any special design or construction methods or

information about any special energy - conserving designs or
construction methods, or other improvement to reduce pollution from

Re: Geological evaluation of site for single - family residence,
Lot 2, Little Texas Subdivision, Pitkin County, ,Colorado.
I have completed the geological appraisal of the subject property /building
site for the required HB 1041 hazard review. The property is in the SW;,
NE;, Section 16, T. 9 S., R. 85 W., 6th PM, about seven (7) miles north
of Aspen, Pitkin County.
The subject lot stretches from the east bank of the Roaring Fork River,
eastward across a narrow, younger river terrace, thence upward and over a
west - facing 30 -ft. -high slope (35 %) onto the surface of an older, upper
river terrace. The lower and upper river terraces are entirely composed
of rounded, river- deposited boulders, cobbles, and gravel in a matrix of
porous sand. The sand is largely made up of decomposed rock fragments.
Sandy soil containing minor amounts of humus and clay mantles the whole
upper terrace level. Soil on the slope is slightly more argillaceous. Bed-
rock is not exposed anywhere on the property, or in the subdivision, but
it is probably Mancos Shale, as noted in areas immediately adjacent to the
subdivision. However, terrace gravels are at least 12 feet thick on the
lower terrace level and 42 feet thick on the upper terrace level. The
slope between the two terrace levels is presently colonized by vegetation,
mainly mature Gambel's oak and serviceberry, with immature cottonwood near
the base of the slope. Despite its steepness, the slope angle is less
than the angle of repose for the terrace gravels, and is naturally stable.
The anticipated building envelope for the residence will include up to
one -half of the upper part of the slope, from its crest downward about 15
feet, as well as an adjacent part of the flat, upper terrace level. Soil
subsoil, and underlying terrace material are practically uncompressible,
exhibit excellent internal (matrix) porosity and drainage, and contain
small amounts of non - swelling clay. Consequently, standard foundation
designs should be adequate for the substrate. However, if the upper part
of the slope is excavated for construction, care should be taken that
foundation (stem walls and footers) be designed to resist subsoil water
drainage. Particularly, excess water from the upper levels should no be
allowed to erode the base from beneath the footers.
Regarding continued slope stability, after construction, surface water
run -off should be minimized adjacent to and below the building. Further,
existing natural vegetation should be maintained where feasible, on the
slope. This will preclude excess watering of the natural xerophytic plants.

Despite the porous soils and substrate, the granitic composition of at
least 30 percent of the terrace gravels might subject the site to slight
emanations of radon gas. Adequate subfloor ventilation or gas shielded
foundationwalls should be provided to assure acceptable levels of radia-
tion within the home.
In conclusion, the homesite and building envelope are well suited for al-
most any kind of construction, provided that the above recommendations are
followed. Please feel free to contact me should any additional questions

2. All rights to any and all minerals, ore and metals of any kind and character,
and all coal, asphaltum, oil, gas and other like substances in or under said
land, the rights of ingress and egress for the purpose of mining, together
with enough of the surface of the same as may be necessary for the proper
and convenient working of such minerals and substances, as reserved in Patent
from the State of Colorado, of record.
3. Easement and right of way for road purposes being 10 feet in width as reserved
in Deed from C.C. Pate of J.F. Powell recorded August 22, 1946, in Book 166
at Page 438.
4. Easement and right of way for electric transmission line purposes, as granted by
C.C. Pate to the Holy Cross Electric Association by instrument recorded December
7, 1973, in Book 282 at Page 100.
5. Easement and right of way for telephone line purposes, as granted by C.C.
Pate, tl al, to the Mountain States Telephone and Telegraph Company by
instrument recorded November 15, 1975, in Book 302 at Page 839.

7. Encroachment by propane gas tank onto property immediately adjoining subject
