USE /SPECIAL EVENT PERMIT FOR THE POWER OF FOUR SKI MOUNTAINEERING
RACE
Administrative Decision No.1 - 9-2012
RECITALS
Pursuant to Subsection 4- 30 -50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ( "Director ") may approve a Temporary
Commercial Use /Special Event Permit for commercial activities or special events.
2. The Aspen Ski Company (hereafter, the "Applicant ") has applied to the Director for approval of a
Temporary Commercial Use /Special Event Permit to conduct the Power of Four Ski
Mountaineering Race. The event will occur on March 3` from 6:00 AM to 5:00 PM with setup
and takedown dates of February 29 and March 4, respectively. The Applicant has represented
that the event will bring between 250 — 500 racers.
The Event will consist of a ski mountaineering race in which participates will skin uphill and ski
down Snowmass, Buttermilk, Highlands, and Aspen Mountains. The route is as follows:
• Start in Base Village in Snowmass Village.
• Skin up Snowmass to High Alpine via Fanny Hill, Green Cabin, Sheer Bliss, and Dikes
to Elk Camp via Roberto's, Lower Ladder, and Sandy Park.
• Skin/ski the ridge trail from Elk Camp to Buttermilk.
• Skin up West Buttermilk Express.
• Ski down Tieback to the parking lot.
• From Tieback parking lot, ski across the Aspen Recreational Center bridge through the
baseball field and along the bike path that parallels Maroon Creek Road to the base of
Highlands.
• Skin up the Thunderbowl to Golden Horn to the T Lary 7 catwalk and continue up Wine
Ridge and the Face of Oly until reaching Highland Peak.
• Ski down Highlands Bowl past Deep Temerity to the Grand Reverse.
• Ski down Congo trail to Castle Creek to Midnight Mine Road.
• Skin up Midnight Mine Road to Richmond Ridge to the Sundeck
• Ski down to the upper Gondola Plaza (finish line) via Copper to Little Nell.
4. The Applicant has indicated that participants will be required to wear avalanche beacons and
carry probes and shovels. The proposal states that participants who did not reach the top of the
Congo Trail by 2:00 PM would not be able to continue the race.
5. The Pitkin County Sheriff's Office, Aspen Fire Protection District, Emergency Manager, Public
Works Department, Aspen Ambulance, Communications Department, Open Space and Trails
Department, the United States Forest Service, the Town of Snowmass Village, and the City of
Aspen, were all referred on the application. Nearly all referral agencies commented on the
application and were in support with some conditions.

6. The Applicant has successfully obtained a United States Forest Service Permit for the event. No
Open Space and Trails Department permit is needed for this race to occur. The Applicant has
provided proof of adequate insurance covering the event. Dedicated ambulance service was not
required by the Aspen Ambulance District due to the low number of participants in the event.
7. The Director finds that, to the extent applicable, the application complies with the standards in
Subsection 4- 30 -50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use /Special Event Permit for
the 2012 Power of Four Ski Mountaineering Race subject to Applicant's compliance with each of the
following conditions:
1. All material representations made by the Applicant in the application (which shall
specifically include representations made in all related supporting documents,
correspondence subsequently provided by the Applicant, and representations made by
phone), shall be adhered to, and considered conditions of approval, unless superseded by
specific conditions in this Decision.
2. The Applicant must demonstrate possession of applicable permits at all times during the
permitted activity and present such permits upon request.
3. Approval to hold this activity does not imply that extra services will be provided nor does it
place any additional liabilities on Pitkin County.
4. The Castle Creek Road crossing shall be staffed with course marshals to aid in traffic control
and assist participants across the Road.
5. Participants shall wear helmets during the event, have avalanche beacons, shovels, and
probes, and carry headlamps.
6. The Applicant shall pay $649 for the permit fee within 15 working days of this approval.
7. The Applicant shall be responsible for assuring that all areas outside the ski area resorts have
signage removed and garbage /debris removed after the event.
8. In the event of a significant emergency incident, the Pitkin County Sheriffs Office shall be
notified immediately to manage the incident.
9. The Applicant shall be in regular contact with the Colorado Avalanche Information Center
and shall reroute or cancel the event if there is a significant threat to the participants of the
event.
10. By March 1', the Applicant shall post signs at the entrance at Loges Spring Road and
Midnight Mine Road and place flyers on doorsteps of the residence along these roads alerting
them of the race.
11. Failure to comply with the conditions of approval may result in revocation of this permit.

2. DESCRIPTION OF PROPOSED ACTIVITY: This will be our 2 nd annual ski touring race
through each of the four Aspen/Snowmass mountains. It is part of the Power of Four
series we launched in 2011 that also includes a mountain bike race. We are expecting
to get 400- 500 racers and would cap registration at 500. Registration is open to the
public and is $ 170 per team of two. Spectator access is free at the base of all
mountains and for people hiking up the mountains. Spectators wishing to use the
gondola or lifts as access will be required to purchase a gondola/lift ticket.

PART II - PERMIT
1. Use under this permit shall begin on 3/1/12 (date) and end on 3/4/12 (date) The permit shall
not be extended.
2. The estimated fee for this use is $ 1,500.00. It shall be paid in advance and is not refundable.
Within 30 days of conclusion of the event the holder shall submit final records of gross
revenue collected for reconciliation for any additional fees due the United States.

3. Aspen Skiing Company (the holder) is hereby authorized to use, subject to the terms of this
permit, National Forest System lands described as shown in attached Exhibit(s) C.This
authorization covers approximately 5 acres and /or 20_ miles.
4. The holder is authorized to conduct the following activities and install the following
improvements in the permitted area:
Improvements would include dons /flags as course markers and Aid Stations.
5. The holder shall conduct the authorized activities according to the attached approved plans
and specifications, Exhibit(s) C . The holder shall not install any improvements not specifically
identified and approved above or in exhibits.
6. No soil, trees, or other vegetation may be destroyed or removed from National Forest System
lands without specific prior written permission from the authorized officer.
7. The holder shall comply with all federal, state, county, and municipal laws, ordinances, and
regulations which are applicable to the area or operations covered by this permit.
8. The holder shall maintain the improvements and premises to standards of repair, orderliness,
neatness, sanitation, and safety acceptable to the authorized officer. The holder shall fully
repair and bear the expense for all damages, other than ordinary wear and tear, to National
Forest System lands, roads and trails caused by the holders activities.
9. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous
trees, hanging limbs, and other evidence of hazardous conditions which would pose a risk of
Injury to individuals. After securing permission from the authorized officer, the holder shall
remove such hazards.
10. The holder shall be liable for any damage suffered by the United States resulting from or
related to use of this permit, including damages to National Forest resources and costs of fire
suppression.
11. The holder shall hold harmless the United States from any liability from damage to life or
property arising from the holder's occupancy or use of National Forest System lands
under this permit.
12. The holder agrees to permit the free and unrestricted access to and upon the premises at all
times for all lawful and proper purposes not inconsistent with the intent of the authorization or
with the reasonable exercise and enjoyment by the holder of the privileges thereof.
13. This permit is subject to all valid existing rights and claims outstanding in third parties.
14. This permit may be revoked or suspended upon breach of any of the conditions herein or at
the discretion of the authorized officer. Upon expiration or revocation of this authorization, the
holder shall immediately remove all improvements except those owned by the United States,
and shall restore the site within 2 days, unless otherwise agreed upon in writing. If the holder
fails to remove the improvements, they shall become property of the United States, but that
will not relieve the holder of liability for the cost of their removal and restoration of the site.
15. This permit is a license for the use of federally owned land. It does not grant any interest in
real property. This permit is not transferable. Upon approval of the authorized officer, the

holder may enter into agreements with third parties to exercise the rights and privileges
granted by this authorization.
16. The holder is required to comply with standards for adequacy and type of services set out in
the attached operating plan.
17. Gambling or gambling machines or devices will not be permitted on National Forest System
lands regardless of
whether or not they are lawful under State law or county ordinances.
18. The holder, in advertisements, signs, brochures, letterheads, and like materials, as well as
orally, shall not misrepresent in any way, either the accommodations provided, the status of
the authorization, or the area covered by it or the vicinity. The fact that the permitted area is
located on the National Forest shall be made readily apparent in all formats of the holder's
brochures and advertising regarding the use and management of the area and authorized
facilities.
19. Pursuant to 31 U.S.C. 3717, at seq., interest shall be charged on any fee amount not paid
within 30 days from the date the fee or fee calculation financial statement specified in this
authorization becomes due. The rate of interest assessed shall be the higher of the rate of the
current value of funds to the U.S. Treasury (i.e., Treasury tax and loan account rate), as
prescribed and published by the Secretary of the Treasury in the Federal Register and the
Treasury Fiscal Requirements Manual Bulletins annually or quarterly or at the Prompt
Payment Act rate. Interest on the principal shall accrue from the date the fee or fee
calculation financial statement is due.
In the event the account becomes delinquent, administrative costs to cover processing and
handling of the delinquency will be assessed.
A penalty of 6 percent per annum shall be assessed on the total amount delinquent in excess
of 90 days and shall accrue from the same date on which interest charges begin to accrue.
Payments will be credited on the date received by the designated collection officer or deposit
location. If the due date for the fee or fee calculation statement falls on a non - workday, the
charges shall not apply until the close of business on the next workday.
Disputed fees are due and payable by the due date. No appeal of fees will be considered by
the Forest Service without full payment of the disputed amount. Adjustments, if necessary,
will be made in accordance with settlement terms or the appeal decision.
If the fees become delinquent, the Forest Service will:
Liquidate any security or collateral provided by the authorization.
If no security or collateral is provided, the authorization will terminate and the holder will be
responsible for delinquent fees as well as any other costs of restoring the site to it's original
condition including hazardous waste cleanup.
Upon termination or revocation of the authorization, delinquent fees and other charges
associated with the authorization will be subject to all rights and remedies afforded the United
States pursuant to 31 U.S.C. 3711 at seq. Delinquencies may be subject to any or all of the
following conditions:

Delinquencies in excess of 60 days shall be referred to United States Department of
Treasury for appropriate collection action as provided by 31 U.S.C. 3711 (g), (1).
The Secretary of the Treasury may offset an amount due the debtor for any delinquency as
provided by 31 U.S.C. 3720, at seq.)
20. For the purpose of administering this permit (including ascertaining that fees paid were
correct and evaluating the propriety of the fee base), the holder agrees to make all of the
accounting books and supporting records to the business activities, as well as those of
sublesees operating within the authority of this authorization, available for analysis by qualified
representatives of the Forest Service or other Federal agencies authorized to review the
Forest Service actvities. Review of accounting books and supporting records shall be made at
dates convenient to the holder and reviewers. Financial information so obtained shall be
treated as confidential as provided in regulations issuded by the Secretary of Agriculture. The
holder shall retain the above records and keep them available for review for 5 years after the
end of the year Involved, unless disposition is otherwise approved by the authorized officer in
writing.
21. Appeal of any provisions of this authorization or any requirements thereof shall be subject to
the appeal regulations at 36 CFR Part 251, Subpart C, or revisions thereto.
22. This permit is accepted subject to the conditions set forth herein, including any conditions in
any exhibits attached to and made apart of this authorization.

OPERATING PLAN
This optional format is designed to identify all aspects of a recreation event held
on National Forest System lands and will help in developing an Operating Plan
for an event. Depending on the size of your event, some items may not apply.
Attach additional pages, if necessary to complete the information.
This operating plan is hereby incorporated as part of the authorization in
accordance with clauses 5 and 16 of the Special -Use Application and Permit for
Recreation Events (FS- 2700 -3c), if the proposal is accepted and the application
is approved.

FACILITIES

The Aid station(s) will have lox l0 pop up tents and tables. Only one full Aid Station
at Tiehack with water table at Castle Creek Rd.

All Aid Station water would be hauled in and would be through a water dispenser. No
bottled water to reduce waste and litter on trails.

There will be route markings and tape to help racers navigate. All marking will be
picked up when doing a trash sweep. There will be no corporate partner signage
located off of ASC permitted area. Other signage will be limited to start/finish areas.

Waste/recyling areas will be located at start/finish and Aid Stations. ASC will do a
waste sweep on the entire course. Porable restrooms will be located at the Tiehack
parking area

Disabled visitors will have access to the start/finish areas through Base Village access
and Aspen Mountain Gondola plaza access. Disabled visitors can also access the top
of Aspen Mountain for viewing via the gondola.

Multiple ASC trash dumpsters and recycling centers located at the base of each
mountain.
47. Mitigation plan to rehabilitate resource damage (i.e. closures, revegetation):
Course will only traverse snow - covered paths, thus we do not anticipate trail damage.
Also, the uphill /flat portions of the course will have skiers in the same ski tracks. For
the very small downhill portion of the section between Elk Camp and the top of West
Buttermilk skiers may not identically follow the same tracks though will be required
to stay on course and follow the well- trodden route. On the downhill via Congo Trail
the trail is so narrow it prohibits skiers from not following other skiers tracks.
48.Time frame to complete mitigation:

Land use rental fees are 5% of adjusted gross receipts for one time events and
3% of adjusted gross receipts for multiple events under one permit. Adjusted
gross receipts are the gross revenue less the cost to the holder of the permit
of prizes awarded. Only those prizes which are paid for by the holder or
come from the entry fee costs can be deducted. Donated prizes can not be
deducted.

This is a ski touring race through each of the four Aspen/Snowmass mountains. It
is part of the Power of Four series that includes a mountain bike race during the
summer. We are expecting to get 250- 500 racers and would cap registration at
500. Registration is open to the public and will be $170 per team of two. Spectator
access will be free at the base of all mountains and for people hiking up the
mountains. Spectators wishing to use the gondola or lifts as access will be
required to purchase a gondola/lift ticket.
There will be approximately 40 staff members including Aspen Expeditions, ASC
Ski Patrol, ASC events team and Aid station/support staff.
We are going to try to secure 10 volunteers at transition/aid stations.

Communication Plan:
All event, timing, medical, aid station staff will have an ASC radio that uses the
ASC repeater. Each mountain will use the "Spare" station for race communication
and the Mountain Course Marshal Captain (member of ASC Events team) will be
able to switch to Patrol channel in case of Patrol Assistance. We will follow ASC
winter ski patrol policies for communication between medics, ambulance and
hospital.
Security Plan:
ASC staff and volunteers will act as a crossing guard for street crossing on
Maroon Creek Road and on Castle Creek Road. Racers are quite spread out at this

ASC will use our winter medical plan. The first responders will be ASC Ski Patrol
(inbounds)and Aspen Expedition (out of bounds). They will be located along the
course. All ASC Ski Patrol and Aspen Expeditions will be in uniform. Please see

Safety Plan:
All racers are required to wear a helmet and carry a beacon/shovel/probe. All
racers must be in a team of 2. All safety and communication will be run throught
the aid station and aid station/medical staff.

POWER OF 4 SKI MOUNTAINEERING RACE
The Event
Course
This unique ski mountaineering race traverses all four Aspen / Snowmass ski areas: Snowmass, Buttermilk, Aspen
Highlands and Aspen Mountain. The diversity of the terrain and all- encompassing nature of the race course put this
race on the calendar as a must -do and in only its first year was one of the largest races of its kind in the US. The
race will consist of teams of two skinning, hiking and skiing the course. Each team of two racers will start in
Snowmass and head up the mountain before starting across the Government trail towards Buttermilk. Following will
be incredible ascents and descents of Buttermilk, Aspen Highlands, and Aspen Mountain. The race will have a
spectacular finish in downtown Aspen and feature over 11,000 feet of vertical gain, including summiting the Aspen
Highlands Bowl. We expect this race will attract local and regional ski mountaineers as it is part of the Colorado Ski
Mountaineering Cup (COSMIC) series. In addition to the full course we will also host a rec- course option for the more
recreational ski mountaineers that will shorten the amount of time spent on Snowmass and Aspen Highlands.

• From Tiehack parking lot the course goes over the ARC bridge and over to Highlands Base Village
• Skin up Thunder Bowl, next to Golden Horn and to T -Lary -7 catwalk
• Continue up Wine Ridge and the Face of Oly along the Bowl until reaching Highland Peak
• Ski the bowl past Deep Temerity to the Grand Reverse
• Take the Congo Trail (out of bounds) down to Castle Creek Road
• Cross Castle Creek Road and head up Midnight Mine Road
Aspen Mountain
• Take Midnight Mind Road up to the Sundeck at the top of Aspen Mountain
• Ski down to upper Gondola Plaza via Gents Ridge and Jackpot
Finish Times
• Fastest racers/teams will finish in about 6.5 hours with the slowest racers/teams finishing in about 9
hours
• Will have a cutoff point at the entrance to the Congo Trail at 2pm to assure it will not last much beyond
5:30pm

• Aspen / Snowmass, the Roaring Fork Valley and neighboring mountain communities have a large ski
mountaineering commuhity that have sold out other similar events like the Elk Mountain Traverse which finishes
in Aspen and sold out within 30 minutes

Medical response and trail evacuation will be handled by Aspen Skiing Company Ski Patrol within our ski area
boundary and Aspen Expeditions outside our boundary. Procedures will follow standard protocol (see attached)
after initial response.
Race will be self- supported with 3 aid stations located at: the base of the Tiehack lift, entrance to Congo Trail on
Highlands, near Merry- Go-Round on Highlands
Clean up crew will do a sweep after the race. Services would be provided by ASC Events, Ski Patrol, Aspen
Expeditions staff and volunteers

General
Race Staff consists of Ski Patrol (within Ski Co boundary), Aspen Expeditions (out of Ski Co
boundary) and Course Marshals (within Ski Co boundary) each of which will be equipped with a
radio (events race staff station, ski patrol station).
Racers are part of a mandatory team of two and must race close to their teammate. Each racer
is required to wear a helmet and carry a shovel, probe and beacon, which will be tested just
before starting the race.
Each competitor will be assessed as they pass the Aid Station at the base of Tiehack on
Buttermilk and each member of the race staff. Racers will be responsible for reporting any
accidents or injuries along the course to race staff. Following the race, the course will be swept
to clear the course of competitors before the race staff leaves the area.
Ski Patrol on each mountain will be fully apprized of the course and kept posted on the general
migration of racers. Though only a few Patrollers will be directly staffing the course the entire
team will be ready to be called upon in the event of an injury or accident.
Potential Hazards
The potential hazards we have identified thus far are avalanche danger in the backcountry
between Snowmass and Buttermilk along with the road crossing at Castle Creek. Aspen
Expeditions will have their trained avalanche experts on course in the days leading up to the
event to monitor the snow pack. If the terrain is deemed unsafe the race will be delayed, rerouted
or cancelled for the racers safety.
Racers will be required to report any avalanche activity during the race. In the event of burial,
racers are required to stop and assist with the search and rescue of the buried person. Race
staff will call for additional help; Ski Patrol will be notified and respond.
The road crossing at Castle Creek will be monitored by a trained traffic flagger and Course
Marshall who will have the authority to stop racers and traffic, if necessary. The road will be
signed to warn oncoming traffic of the upcoming racer crossing. Racers will be stopped if cars
are approaching the crossing.
Accident Reoortino
In the event of an injury the closest race staff will be alerted by the injured racer, teammate or
closest person. If the closest race staff is not Ski Patrol they will radio the head course marshal
for that particular mountain who will then radio Ski Patrol and will immediately head to the injured
party and follow standard ASC winter medical and, if necessary, evacuation procedures. The rest
of the race staff will be notified as necessary.
If an injury occurs out of the Aspen Skiing Company boundaries between Snowmass and
Buttermilk, Aspen Expeditions, serving as Course Marshal, will radio the head course marshal for
Snowmass (if in the first 2 /3rds of the course) or Buttermilk (if in the last 1/3 of the course) who
will then radio Ski Patrol at the respective mountain. Ski Patrol will follow standard protocol of
alerting the Sheriff before heading out to assist. Snowmass Ski Patrol will have 2 Patrollers
stationed at Elk Camp (just before the Burnt Mountain Gate) who will be prepared to respond to
any out of bounds or inbounds emergency.
If an injury occurs out of the Aspen Skiing Company boundaries between Aspen Highlands (on
the Congo trail or Midnight Mine) and Aspen Mountain, Aspen Expeditions, again serving as
Course Marshal, will radio the head course marshal for Highlands (if on Congo) or Aspen (if on
Midnight Mine) who will radio the respective Ski Patrol team. Ski Patrol will follow standard
protocol of alerting the Sheriff before heading out to assist. Aspen Ski Patrol will have a team of
Patrollers at the Sundeck and Highlands will have 2 Patrollers at the Gate to Congo who will be
prepared to respond to any out of bounds or inbounds emergency. If an evacuation is needed on

Congo Trail or Midnight Mine Road then injured party will be tobogganed down to Castle Creek
road (where an ambulance can pick -up if necessary) where another Race Staff member will be
stationed.
Regardless of injury location the Pitkin County Sheriff will be notified as soon as possible
depending on the severity of the injury.
Pre -Event Planning
In the days leading up to the event, a representative from Ski Patrol at each mountain along with
Aspen Expeditions and the Head Course Marshals for each mountain will meet to reiterate the
rules and course safety procedures.
Before the start of the race, the Event Manager will repeat the rules and regulations to the racers
as a supplement to the copy of rules and regulations they will be given at registration.
Race Start
The full course race will start at 7:15am on Saturday, March 5 (the half course which ends at the
aid station will start at 7:30am). The race will only begin as scheduled with the approval of Ski
Patrol, Aspen Expeditions, Snowmass/ Buttermilk Course Marshalls and the Aid Station team.
The Course Marshalls at Highlands and Aspen will have additional time to reach their post.
Weather and avalanche conditions must be favorable to start as scheduled.
