AGREEMENT
THIS AGREEMENT made and entered into this /a day of
NOVA bvi. , 1974, by and between the BOARD OF COUNTY
COMMISSIONERS OF COUNTY OF PITKIN, COLORADO (hereinafter
referred to as "County "), and the ASPEN SANITATION DISTRICT,
a quasi- municipal corporation, and ASPEN METROPOLITAN
SANITATION DISTRICT, a quasi- municipal corporation, (herein-
after referred to as "Districts').
WHEREAS, the COUNTY OF PITKIN and the ASPEN SANITATION
DISTRICT and ASPEN METROPOLITAN SANITATION DISTRICT in their
efforts to achieve a proper and necessary disposal of sewage
wastes desire to provide facilities for emergency dumping of
digested sewage sludge, and the normal depositing of grit or
scum waste generated by the Districts' sanitation plants.
NOW, THEREFORE, for good, valuable and mutual consider-
ations, the parties hereto agree as follows:
1. The County shall provide for the use by the Districts
an emergency sludge disposal area located at the City- County
solid -waste center consisting of three (3) ponds, and the
County shall maintain a road thereto.
2. Further, the County shall permit the Districts to
deliver and dump digested sludge in said ponds (in emergency
conditions only), and to deposit grit or scum waste at a
place to be designated by the County on a continuing basis
generated from the Districts' sanitation plans at the solid
waste center at a cost to the District of Five ($5.00) Dollars
per load.
3. It shall be the responsibility of the Districts to
prepare and maintain the emergency facility (3- ponds) utilized
by them for the emergency deposit of sludge generated by the
Districts' sanitation plants. In the event the emergency is
a prolonged one, the Districts will construct terraces as
provided in Briscoe - Maphis Sanitary Land Fill Study in place
1 of the ponds. In event of the necessity to construct
terraces, the parties will review fees.

4. This Agreement shall be in effect for a period of
one year and is subject to yearly renewals in writing;
provided, however, that this Agreement shall be contingent
upon the approval and execution by the parties hereto of
a septic tank waste disposal agreement.

ASPEN SANITATION DISTRICT
RESOLUTION
WHEREAS, the ASPEN SANITATION DISTRICT and the ASPEN
METROPOLITAN SANITATION DISTRICT, quasi - municipal corporations
of Pitkin County, Colorado, have submitted an application for
special review to the Board of County Commissioners of the
County of Pitkin for a Sludge Disposal Site Certification on
a parcel of property designated as a solid waste disposal site
and facility pursuant to Section 26 -23 -5, C.R.S. 1963, as
amended.
AND WHEREAS, the Board of County Commissioners for
Pitkin County, Colorado, has adopted a Sludge Disposal Site
Certification by its' Resolution No. 74 -95 dated November 18,
1974.
NOW, THEREFORE, BE IT RESOLVED by the ASPEN SANITATION
DISTRICT that the Sludge Disposal Site Certification granted by
the Board of County Commissioners of Pitkin County, Colorado, by
its' Resolution No. 74 -95 and the terms therein, be and hereby is
approved and accepted by this District.
