Meeting was called to order by temporary chairman John R. Williams. The following members were present: Commissioners G. B. Brown, Louis Vagneur, John R. Williams, Clerk M. M. Neihard . Being the first meeting of the new Board, the Board of County Commissioners was reorganiz by the unanimous election of B. B. Brown as Chairman. Upon motion it was decided that the Board did not-think it advisable to send the Count Assessor to the West Side District Conference at Grand Junction Jan. 14 -15. Unanimous. Matter of the division of the money from the U. S. Forest Reserve was deferred. R esolution favoring the construction State Highway between Gypsum and Highway 84 at - E1Jebei of Cattle Creek passed unanimously. The petition of 14 citizens concerning the division of Forest Reserve money 95% to the schools and 5% to the roads on condition that all classes in Dist No. 1 be accommodated in the High School Building; otherwise the division be reversed was not acted upon as being with out the jurisdiction of the Board. Unanimous. e Dr. W. H. Twining was elected County Physician at a salary of $50.00 per month, during the pleasure of the Board. Unanimous. On motion and. second C. C. Wieben wps allowed $25.00 for relief. Unanimous. Motion made seconded and carried that the Board approve the Deputies appointed by the County Officers: viz: Clarence E. Johnson, Deputy County Treasurer; William R. Wheeler, Deput' County Assessor: Henry A. Back, Deputy County Clerk and Recorder; and that their salaries be plaeed at one dollar ($1.00) per month. Unanimous. The appointment of Janitor and under - sheriff was deferred till next meeting. On motion and second it was decided That the Road Overseers be let off subject to call. Carried. WHEREAS, The attention of the State Board of Equalization of: the State of Colorado has beer . directed to the fact that the existing depression has seriously affected all industries and that taxes as levied by all taxing authorities, including state, county, municipal and sohoo] districts, have become an extreme burden upon the taxpayers of, this state; and WHEREAS, The State Board of Equalization is oonvinced that such conditions require, for the good of the state and the taxpaying public, that there be a drastic reduction in taxation an that economy should be praotieed by all publio officials; and , WHEREAS, The State Board of Equalization and other taxing authorities have reduced certain valuations, particularly farm and town properties, for the purpose of equalizing assessed values among classes, of property, as , by law . requires; and WHEREAS, The State Board of Equalization has reduced the state levies one -tenth of a mill ;rnd WHEREAS, The relief given by the State Board of Equalization can be suooesaful and of praoii- cal benefit to the taxpayers only in the event other taxing authorities in counties, munioipal• sties and school districts likewise curtail their respeotive budgets; NOW, THEREFORE, BE IT RESOLVED: -That the State Board. of Equalization hereby urges and ream- mends to all tax - levying authorities, including counties, municipalities and school districts, that no mill levies be increased above the 1930 schedules and that, if possible, said levies be decreased, so that the burden of taxation may be substantially reduced for the benefit of • all taxpayers in the State of Colorado. CIRCULAR NO. 5- SERIES OF 1931 VALUATIONS 1931 A' To all County Assessors and to All Boards of County Commissioners: Repeated/ calls upon this Commission by Assessors and others interested for advice and in- struc3tions in regard to the recent attempted actions of the State Board Df Equalization to rare some and lower other valuations seem to make it advisable that this Commission should attempt to clarify the situation so far as is possible at the present time. Last week the State Board of Equalization was about to send•out certain Notices and Instruct- ions to Assessors, relating to that Board's actions, but were restrained from doing so by three cases brought in the District Court of the Denver District, to restrain the State Board from tak- ing further action. After a two days' hearing on Demurrers filed by the Attorney General to each of these three aetions the District. Court to -day has overruled the Demurrers and sustained the temporary restraining Order which was issued. This restraining Order therefore remains in effect until such time as the matter is taken up to our Supreme Court, a step which we understatd will be taken forthwith. In the meantime it would seem that Assessors have no legally established valuations to certify to County Commissioners, municipalities and sehooldistriots and that County Commissioners and School Boards therefore have no legally established valuations on which levies can be made. We therefore advise that Assessors make no attempts to .certify any valuations, and that County Commissioners, municipalities and school districts make no attempt to fix any levies until suvh time as you are advised of the outcome and final result of the litigation which will shortly be pending in the Supreme Court, and of the result of which you will be duly advised. In case any Assessor has certified any valuations, or extended 1931 valuations on his tax roll, this action should be cancelled and withdrawn until the final decision "of the Supreme Court.
