Brown No. 1; Louis Vagneur, No. 2; Boyd R. King, No. 3; M. M. Neihardt, Clerk. The Official Bond of Boyd R. King, duly approved by John T. Shumate, Judge of the Ninth Judicial District was presented. Having taken the Oath of Office the Bond was away filed with the clerk and M. King was admitted a member of the Board. G. B. Brown was elected temporary Chairman. Louis Vagneur was unanimously elected Chairman of the Board for the year 1935. On Motion the following bonds were approved as to form and sufficiency and having taken the Oath of Office the said officers were declared duly inducted into office. At the request of Federal Relief agencies the members of the Board agreed to co-operate "-, with the Relief Agencies, as a Board, to the extent of tools and transportation at the expense of the County. The Bill of $585.20 Aspen Insurance Agency for Bond Premiums was allowed from the Ordinary County Revenue Fund. y The Aspen Times was designated as the offioial newspaper for 1935. Dr. W. H. Twining was elected County Physician for the year 1935 at a salary of 4400.00 ' Motion made and seconded that B. R. Kobey be elected County Attorney for three months at the rate of 4400.00 per year. No: Brpwn. i The following resolution was passed: Resolution WHEREAS, The Board of County Commissioners find that the present wage scale of $2.00 per day is inadequate to meet the necessary expenses; of living THEREFORE, BE IT RESOLVED, That the wage scale for the coming year be set to oon- '' form with that of other Counties, similarly situated, and BE IT FURTHER RESOLVED, That the Commissioners or their Attorney,or both, be represented at the County Association meeting to be held in Denver Jan. 16, 17 & 18, 1935, and ascertain the prevailing wage scale, and to attend to such other business for the good of the County. Emery Arbaney was unanimously elected Road Overseer for Hwy 133 and Rook Creek Region. For Emma District Everett Gerbaz was nominated by Mr. Brown and Joe Dossigny by Mr. Vagneur. On vote, Mx. Dossigny was elected. Henry Hoaglund was re- elected. The above to remain overseers for 1935 or during the pleasure of the Board. Motion made,, seconded and unanimously carried that the wage scale be as follows for road workers and that the same be retro- active to Feb. 1, 1935. The Chairman stated the purpose of the meeting to be to disburse relief to unemployables forthe month of July, stating that the amount of 010.00 had been received. fromthe State of Colorado for that purpose. It was moved, seconded and carried that a fund be established to be known as State Special Relief Fund and that all moneys received from the State for that purpose be ipxn nxzHnz placed in said fund and payments be made from it for unepiployable relief. The following letters relative thereto were read and filed: FROM OFFICIAL COLORADO STATE RELIEF COLu.il'1'TEE: July 15, 1935. To the Board of County Commissioners M.M,Neihardt, Clerk Pitkin County Aspen Colorado. Gentlemen: The allotment for care of unemployables in your County for the month of July has been fixed by the Official Colorado State Relief Committee at 010.00. Check for this amount will be sent within a few days by the State Auditor to the County Treasurer, who will also receive details as to the accounting of the fund. Allotment has been made by the Committee on a uniform basis of need in accordance with the reports sent in by the various counties. This money is available from funds collected under the sales tax law and is to be expended In your counties for the "purpose of relieving distress and suffering among the Indigent un- employable residents of this State, pursuant to law now or hereafter enacted, and under such rules as may be adopted from time to time, by this Committee. The meaning of the words "unemployable residents" is open to several constructions, One county has adopted the following definition of an unemployable which in the opinton of this Committee for present purpose will suffice: "An unemployable person is one who permanently cannot engage in an occupation at a rate of pay sufficient to maintain himself and his legal dependants because of age, some physical, mental or emotional disability; or as the head of a family who is needed at home to care for minors or disabled dependants." The word "resident" Is also subject to many constructions, but the Committee refers you to the definition pre- scribed by the statute of the State of Colorado in the Settlement Act. In addition to the funds allotted above, your county will also receive your proportion of the Old Age Pension Funds for the month of July from the proper state officials. In this connection, we wish to call your attention to the fact that many of your relief clients who are being turned back In your county from F.L.P..v. and who now become a county responsibility can be classified under the Old Age Pension Act. You are referred to Chapter 171 Session Laws if 1935 for the revised construction of thos falling under this classification and the statutory requirements for their care. Other funds are also available for care of unemployables and County Officials are urged not to overlook the benefits of Mothers' Compensation and Blind Care, and to make classi- I fication accordingly. j In handing over the relief funds to the Counties, we are keeping in mind the picture of the State as a whole and that the County Corrunissionors are deeply Interested in the proper conduct of their office and their duty to the electorate of their respective countied. The County Commissioners are imposed with specific duties under the poor relief act of the State. The Official Colorado State Relief Committee does not wish at this time to embarrass the County Commissioners in the distribution of these funds. ,e do, however, advise you that the money which is now made available is for relief purposes only, and is not to be used for administra- tive salaries or expenres of any kind. More definite rules and regulations will be transmitted, to you from time to tiem covering various problems of the counties when and if brought to the attention of the Cotrnittee. Tuesday Sept. 3, 1935 (the preceding Monday being a legal holiday), with the following members present: Louis V °neur, Chairman; G. B. Brown, Commissioner, Boyd R. King, Commissioner: Benj. R. Kober, County Attorney; M. M. Neihardt, Clerk. The meeting was declared to be concurrently a meeting of the Board of County Commies- ( ioners and of the County Board of Equalization. The minutes of the meeting of August 5th and 6th were read and approved. At the request of Mrs. Helen Trainor it was moved seconded and carried that the Count nay not to exceed $13.00 for glasses for her son. The offer of Jas Dolan of the sum of $25.00 for tax sale certificate and taxes un to and including 1933 was accepted. On Lot F itt Block 51, Asnen. The offer of the sum of $27.48 for tax sale certificate and taxes up to and includ- ing 1933 on Lots E & F in Block 59 Aspen was accepted contingent upon the same pur- chaser paving 1934 taxes in the amount of $13.52. (D.A.Shinnick) As a Board of Equalization the following complaints end renueats were heard and Laid upon the table until the next meeting of the Board of Equalization on Sent. 17 and 18, 1935: George E. Rohrbaugh stated that he was assessed at $29.00 an acre while J.E. Hunter whose land lies contiguous, whose land is of the same quality but whose water rights were prior to Rohrbaugh's was assessed at $21.00 and $83.00. He stated that his water, being from Elk Creek, had been shut off about the 4th of July each year for 12 years owing to Hunter's priority of right and the insufficient amount of water. The Wafter Commissioner's certificate presented showed that usually the water was shut off in June and that in his opinion Mr. Rohrbaugh's land should be classifiedk as grazing or dry farming land. Mr. Rohrbaugh asked a lower rating. • John Larson stated that he was assessed at $21,00 per acre (Total 2160.00) he gets no water or very little water. Asks that his 100 acres be cut to $525.00. John L. He stated that compared with the other summer cottages in the neighborhood, name- ly those•ot Bigelow and Bowles Bros and compared with the Armory Hall in Aspen, the cottages and dance hall are entirely out of proportion and entirely too high. He asks that the valuations be equalized as follows: Land $345,00: Improvements $5000.00; Furnishings (including Light Plant) $200.00. R. Kobey for the owner, Bertha W. Kobey, of Drug Store Cornet and the Kobey Building stated that the valuation formerly was $1660.00, was rained to $32265.00 He stated the same were out of proportion to others and cites Aspen Block $1310.00, Elks Building $1920.00, Brand Building $1680.00 or $2000.00, Keene Block was de- stroyed by fire and there remains only Drug Store. The Kobey Building was stated to be in poor condition with roof practically gone, so much so that it can't be repaired; second story burned and most of it in bad state of repair; foundation weakened and on account thereof many glasses in windows cracked; floor space only a fraction of that of Aspen Block, Elks Building or Brand Building. $1660.00 really too high. Requested reduction. As Board of County Commissioners: The Board of County Commissioners approved the County Clerk's report for the month of August 1935. The appointment of Clarence E. Gentlemen: Out attention has been oalled to a oomplaint made by the Monument Investment Company who are the owners of a private resort looated at Morrie on which our investi- gator, Mr. $aakenson, placed a valuation of some $9,000 for the year 1934. The basis of oomplaint is not against the valuation but is based upon the laok of equalization on other similar properties,eituated in Pitkin County. ,, We believe that this Company has oalled.your attention to this matter and agreed to a valuation this year of approximately $3,000, with the understanding that if all other property is appraised on a similar basis next year they will be willing to stand thher pro rata share of the inorease in valuations. After due deliberation by this Commission this seems to us to be a fair settlement in vie •0 of the fact that other properties are apparently very muoh under - assessed in your county, and we believe that your Board, when sitting as a Board of Equalization, oould properly I make the adjustment, and this year base your action upon lack.of equalization throughout - the county. The basis of eomplai,nt,is not against the valuation but is based upon he lack of equalization en other similar properties situated in Pitkin County. We believe that this Company has palled your attention to this matter and agree& to a valuation this year of approximately $3,000, with the tnderstanding that if all other prop- erty is appraised on a similar basin next year they will be willing to stand their pro rata share of the increase in valuations. After due deliberation by this Commission this seems to us to be a fair settlement in view of the fact that other properties are apparently very much under - assessed in your county, and we believe that your Board, when sitting as a Board of Equalization, could properly make the adjustment, and this year base your action upon lack of equalization throughout the county. It seems to us imperative that arrangements be made for a complete reappraisal of Pitkin 1 County for 1936, as our Investigator reports conditions deplorable in your county, so far as equalization is concerned. Testimonies were received from the members , of the Board, the County Assessor and others as more fully set forth in the transcript l made by the Stenographer which are now on file in the Colorado Tax Commission's offices. An agreement was reached as follows: That Clarence E. Johnson should be employed in the office of the County Assessor for the remaining part of 1935 and that an outside appraiser should be sent in by the Colorado Tax Commission during 1936 to re- appraise the properties in Pitkin County, the County to pay for such services. Hillberg was not properly olassed', as a resident of Pitkin County and the Clerk was instructed to so notify them. The suggestion of the Colorado Tax Commission that a W2P.A.Projeet be obtained for re- appraisal of buildings in the County was considered and it was decided that such project was not feasible for this County. 1 The letter from V.D,Woodward, Attorney at Law written in the interests of F.A.Brewster regard- ing the Snowmass road through his properties was considered and the Clerk instructed to advise that the matter had been taken up with his tenant C.I.I.Reed and that Mr. Reed said what the County did was O.K.; that the Surveyor had nat. turned instate; that when he shall do so, the County will send deed for signature. Liclnroy, n If n TV Mr. W.F.Scherer, Assistant Attorney General The Commission, after hearing the evidence and argument of counsel, and being fully advised in the premises, finds: I 1 - That the records and files of the Assessor's office of Pitkin County, are inadequate, incomplete and erroneous; 2 - That in order to complete the tax roll within the statutory period, it is necessary that a deputy be appointed to assist said Assessor; 3 - That gross irregularity and inequality in assessments exist in said County; 4 - That in order to correct said inequalities a complete reappraisal of the property values of said. County is imperative. Therefore; It is the suggestion and recommendation of this Commission, that the Board of County Commissioners of Pitkin County 1 - employ a deputy at once to assist the Assessor in completing the tax roll; 2 - appropriate such Hinds as are necessary to equip the Assessor's office with the necessay books, records and files; 3 - Employ a competent appraiser, who is to be selected and whose salary is to be fixed by the Colorado Tax Commission, to conduct a reappraisal and survey of the taxable properties of said County, said reappraisal to be made as soon as practicable, after January 1, 1936; 4 - That the suggestions and recommendations herein made, be adopted and spread upon the I minutes of the next meeting of the Board of County Commissioners of Pitkin County.
