The Contractor shall assume fiill responsibilzty fo�• any damage to any such land or ae•ea, oz• to tl�e County or occupant thei•eof oi• of any land or areas contiguaus thereto, resulting fi•om the pei�fof•mance of the Project. Shouid any claim be made against the County or the Proc�tremeiit Officer by any such owner or occupant because of the performance of the Projeet, Contractor shall pronnptly settfe with such other paz-ty. Tlie Contractor sl�ali, to the fullest extent permitted by Laws and Regulations, indemnify and hold the County harniless from and against all claims, damages, losses and expenses (including, but not limited to, fees of engineers, architects, attorneys and other professionals and court costs) � arising directly, indirectly ar consequentially out of any action, tegal or equitable, brought by any such other party against the Couniy or t1�e Procu�•ement Officer to the extent based on a claun arising out of the Contractor's performance of the Project. 2. During the pz•ogress of the Project, the Contractor shall keep the premises free from accurnulations,of�vaste materials, rubbish and other debris resi�tting fr•om the Project. At the completion of the Project, the Cantractor shall remove all waste materials, ivbbish and debris fi•om and about the premises as well as all tools, appliances, construction equipment and machinery, temporary structures, stumps or portions of trees, and suiplus matei7als, and sliall teave the site clean and ready far occupancy by the County. The Contraetor shall restore ta original condition all property not designated for alteration by this Contract. 3. Safety and Protection, . a. The Cozitractor s3�a11 be solely responsible for initiating, mau�tauung and supervising a1! safety precautions and programs in connection �vith the Pi•oject. Tl�e Cantractor shall take all necessary precautions for the safety of, and shali provide the necessaiy protection to prevent damage, injury or loss to: a, All employees in the Project ac•ea and other persons and organizations who may ba affected thereby; b. All tlie Project materials and et�uipment to be incorporated therein, whether in starag�on ox off the site;and c. Other property at the site or adjacent thereto, including treess stu•ubs, lawiis, walics, pavements,road-ways, structures, utilities and underground facilities not designated for removal, relocatian or replacement in the course af consti-��ction. Shop Drawings and Samples. l. After checking and verifying all field measurements at�d after co�nplying with applicable proeedures specified in this Contract, the Conteaetor shall submit to the Procurement �ffice� for review and appraval in accordance with the approved schedule of shop drawing subnussions, three {3) copies (unless otherwise specified} af all shop dcawings, which will bear a stau�p or specific written indication that the Conti�actor has satisfied ttie Confractor's respansibilities under this Cantracf with respect ta the review of the submission. All submissions wili be identified as the Procurement O�cer ulay require. The data shown on the shop drawings will be complete with respect ta c�uantities, dimensians, specified pei�foi�rnance and design criteria, materials and sin�itar data to enaUle the Procuremeut Officer to review the infoi�niation as required. 2, The Contractor sha(1 also submit fo the Procueement Officer for review and approval with such promptness as to cause no delay in Projeet, a!1 satnpies required 6y this Contract. Where a shop drawing or sample is requii�ed by the specifications, no related Project work shali be commenced prior to the Procurement Officer's review and appraval of the shop drawing ox•samples. 6. The cost of fur�ishing all shop drawings and samples shall be borne by Contractor. V. Performance and Pavment Band. A. The Contractor shall perform anc� coordinate its activities with otl�er contractors to avoid conflict and minimize diszllptions. B. The Conti•actor shall afford each utility owner anci other contractor who is a party to such a direct cantract (or the County if the County is pei-Forming the additional work with the County's employees} proper and safe access to the site and a reasonable opporh►nity for the inh•oduction and starage of mate�•ials and eqtiipment anc� the execution of st�ch work, and shall properly connect and coordinate the work with theirs. G If any part of the Contractar's Project depends for proper execution ar results upon the work of any stich other cantractor or util'ety owner(or the County), the Contractor shail inspecf and promptly repoi�t to •the Procurement Officer in writzng any delays, defects or deficiencies in such work that render it unavailable or unsuitable for such proper execution and resutts. The Contractor warrants and gi�arantees to the Caunty that all Project work, whether supplied, fiirnished, installed, provided, or performed by Contractor, a subcontractor, or si�pplier,will be in accordance with this Cont�•act and will not he defective and that all Project work shall be pei�fo�med in a skillfi�l and workmanlike manner.
