The Applicant proposes to deed restrict the proposed caretaker dwelling unit pursuant to Section 9- 110- 041(c)(2) of the Land Use Code. 4. The Director finds that the Cronenberg Detached Caretaker Dwelling Unit complies with applicable standards of the Land Use Code Sections 3 -210 and 9- 110 -041 and has recommended approval of the request based upon compliance with these sections. APPLICANT: Robert Cronenberg REPRENSENTATIVE: Same LOCATION: 1960 Juniper Hill Dr. ZONING/LOT SIZE: AFR- 10/2.07 PROCEDURE/PROCESS: The Community Development Director may approve a detached Caretaker Dwelling Unit subject to the standards in Sections 3 -210 and 9 -110- 041 of the Pitkin County Land Use Code. STAFF COMMENTS: The applicant's proposal abides by the standards set forth in Sections 3 -210, Special Review, and 9- 110 -041, Caretaker Dwelling Units, of the Pitkin County Land Use Code. Any and all square footage utilized for the proposed CDU will be counted against the overall square footage of the parcel. REFFERAL COMMENTS: The application was referred to County Attorney, Housing and the Brush Creek HOA. No comments were received from the County Attorney or the Brush Creek HOA. Thank you for all your help getting to this point. DESCRIPTION OF PROJECT The property is owned by Robert and Susan Cronenberg and located at 1960 Juniper Hill Road. The applicants seek approval to construct a 700 square foot one bedroom caretaker dwelling unit with above a two -car garage of the same size below. They also request approval for a second access from Juniper Hill Road at the location of the proposed caretaker dwelling unit. The legal description is Lot 4, Block 8, Brush Creek Village Subdivision - Filling 1, Pitkin County, Colorado. It is 2.07 acres with the front side being approximately 520 feet having an existing dwelling of approximately 2000 square feet and located in the southeast area of the lot. The suggested location of the caretaker dwelling would be at the opposite end of the lot, approximately 250 feet from the primary dwelling. The caretaker dwelling will have a second access with sufficient space for parking and the ability to turn around to eliminate any need to have to back out of the driveway onto Juniper Hill Road. The caretaker unit will need a second septic system also on that side of the lot. COMPLIANCE WITH CARETAKER DWELLING UNIT REQUIREMENTS This application request approval of a detached 700 square foot caretaker dwelling with a second access to Juniper Hill Road through the special review and standards and criteria of section of the Code, Ordinance No. 99 -53, Section 3 -150 -130 Caretaker Dwelling Units. OLM06 B. The Community Development Director, pursuant to the procedures of section 440, may permit Caretaker Dwelling Units up to seven hundred (700) net livable square feet on any size lot in the R -30, AFR -2, AFR -10, RS- 20, RS-30 and RS-160 zones, unless there is a timely objection pursuant to section 5- 80- 010(.) in which the Board may approve or deny. The Community Development Director may permit Caretaker Dwelling Units up to four hundred (400) net livable square feet on any size lot or parcel of land in he R-6, R -15 and R -15A zones districts, and any other zone district where caretaker dwelling units are listed a s a Special Review use, unless there is a timely objection pursuant to section 5- 80-(.) in which the Board may approve or deny. All such units may be attached to, or within, the principal dwelling; within a properly approved outbuilding, or detached. All such units may be approved under the following conditions and limitations: 1. The floor area of the caretaker unit shall be included in the total allowed floor area for the lot or parcel of land. The subject is located in an AFR -10 zone district in Brush Creek Village. The caretaker unit will be included in the total allowable floor area for the entire lot. According to the Assessor's records, currently there is approximately 3884 total square feet in the primary residence including the unfinished basement and the garage. A caretaker dwelling unit of seven hundred (700) square feet plus a garage under it of the same size would still be less than the allowable 5750 square feet. 2. There shall be provided one (1) off - street parking space for each bedroom within the principal dwelling and one (1) off - street parking space for each bedroom in the caretaker unit. The primary residence has two (2) bedrooms and a two (2) car garage with additional off - street parking for at a minimum two (2) more cars and the caretaker dwelling unit will have one bedroom and a two car garage below it with additional parking for at a minimum one (1) off - street parking space. There will be more than ample parking for the caretaker dwelling unit because it will have a separate access. There will always be more than ample parking for the principal dwelling and the caretaker dwelling. 3. The applicant shall by deed restriction or other permanent commitment running with the land, guarantee that the caretaker unit shall not be required to be rented; not be sold or otherwise conveyed or separated from the original parcel regardless of the ultimate form of ownership of the caretaker unit; be limited to occupancy by not more than two (2) adults, and related children, who qualify as (and have been found by the Housing Authority to be) employees of the community under such guidelines as may be from time to time established by said Authority; be rented for terms not less than six (6) months if rented. The caretaker dwelling may be occupied by 00O j07 members of the immediate family even though they may not qualify as employees of the community. "Immediate Family" shall mean a person related by blood or marriage who is a first cousin (or closer relative) and his or her children. The applicant understands that the caretaker unit is not required to be rented. The applicant agrees that the caretaker unit will not be sold separately from the principal residence, that the occupancy limitations and conditions listed above will be met, and that the unit will not be rented for terms less than six (6) months. It is also understood that an immediate family member may reside in the unit, even if he or she does not qualify as an employee of the community. 4. The caretaker dwelling unit restriction may be removed by the property owner upon approval of the Community Development Director, subject to the requirement that the dwelling is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a Dwelling Unit and must meet otherwise applicable Code requirements. The applicant is aware that the caretaker dwelling unit deed restriction may be removed if the unit is removed or is modified so that it is no longer capable of occupancy and otherwise meets applicable Code requirements. ACCESS The county engineer has visited the area to be designated for the caretaker dwelling unit and is of the opinion that the circumstances dictate that a second access would be feasible. It would have less impact on the area than connecting the access to the existing driveway on the opposite end of the lot. There will be a topo survey to follow as soon as it is completed. SUMMARY This letter hopefully address all the concern identified in the Pre - application Conference Meeting and Summary Sheet and applicable sections of the Code for application for approval for a detached Caretaker Dwelling Unit.
