APPLICANT'S REPRESENTATIVE: Peter Dobrovolny REQUEST: Pursuant to Land Use Code Section 3 -1.13 and Ordinance 90- 07, the Applicant requests approval of an administrative scenic overlay review for an addition a single family residence. Section 3- 1.13(D)(1) of Ordinance 90 -07 authorizes the Planning Director to approve development within the mapped scenic overlay area when development is found to have an insignificant impact on the visual quality of the ridgeline or overlay area. The Planning Director may approve development with conditions upon a finding that: a. Development cannot be seen from the designated corridors as defined in Section (B)(1), or b. In the case of additions or remodels of existing homes, visible development is thirty percent (30 %) or less, of the existing square footage of the structure, or C. For areas not mapped within the Scenic Overlay but included in Ridgeline mapping, such as development shall not break a ridgeline. PROJECT DESCRIPTION: The Applicants propose an addition of a sitting room and an exterior deck to their 3,996 square foot home. In the process of remodeling, 31 square feet will be removed at the Lower Level and 242 square feet will be added to the Main Level, for a net increase of 211 square feet. The proposed deck will be 216 square feet in size. The existing residence breaks a ridgeline (see attached drawing). The structure was built in 1983 and predates Ordinance No. 90 -07, Scenic Foreground Overlay and Ridgeline Review. The residence is within the ridgeline mapping, therefore, the proposed addition is now subject to review under said Ordinance. 000-002 t M E M O R A N D U M TO: Rick Magill, County Planner FROM: Joanna S. Schaffner, County Zoning DATE: October 25, 1993 RE: Mullen /Bielec Scenic Overlay Review I have reviewed the above referenced application, and offer the following comments. ZONE: AF -1, ten acre minimum lot size This parcel is non - conforming in size. SETBACKS: Required setbacks for this parcel are: 100 foot front yard setback 30 foot side and rear yard setback It is not clear whether the proposed addition encroaches into the required 30 foot rear yard setback. The applicant states that the deck will encroach into the rear yard setback. Board of Adjustment approval is required before a building permit can be issued for development within required setbacks. There appears to be an existing encroachment onto Lot 11. HEIGHT: Although this structure has not been measured for compliance with County height regulations, it does not appear to exceed the maximum height limit. FLOOR AREA: This parcel is permitted 15,000 square feet of floor area before Special Review is required. Mullen Rosa Bielec 2653 Juniper Hill Drive Brush Creek Village, Pitkin County 923 -3890 Submitted on behalf of the Owners by Peter Dobrovolny 927 -3369 October 12, 1993 OULJ06 Property Description Brush Creek Village is a subdivision whose County approval predates Ordinance No. 90 -07, Scenic Foreground Overlay and Ridgeline Review. The subject property and its improvements are visible from the Highway 82 and Brush Creek corridors, as seen in the attached photographs, taken from the parking lot at the intersection of these two corridors. The existing residence breaks the ridgeline as viewed from both corridors. The first residence constructed on this property was built in 1978. A major remodel with significant square footage added was constructed in 1983 - the structure appearing in the photographs. Proiect Description The current owners propose relatively insignificant remodelling and additions to the existing residence. Included with this request are drawings describing the existing building and the improvements to be made. Included also is a Title Commitment Policy and an Improvement Location Certificate. Request For Administrative Review Request for Administrative Review is made pursuant to the following item of Ordinance No. 90 -07: (D) Planning Director Sign-Off (1) The applicant shall demonstrate that development within the mapped scenic overlay is insignificant and will not impact the visual quality of the ridgeline or overlay area. In this case the Planning Director may approve development with conditions upon a finding that: b. In the case of additions or remodels of existing homes, visible development is thirty percent (308) or less, of the existing square footage of the structure, As described in the floor plan drawings, the existing residence contains 3,996 square feet. In the process of remodelling, 31 square feet will be removed at the Lower Level and 242 square feet will be added at the main level, for a net increase of 211 square feet, representing an increase in floor area of 5.3%, well below 30%. The added deck will be 216 square feet and will require a Board of Adjustment variance. By way of explanation, building setbacks have changed since the date of the first construction. The deck is designed so that the current encroachment into the current setback will not be increased. Though not falling within the definition of building square footage, if the deck area were added, the total increase in floor area would be 427 square feet, or an increase of 10.7%, still well below 301. Mullen - Page 2 Response to Scenic Overlay and Ridgeline Review Criteria The following are item by item responses to the review criteria for development with the Scenic Overlay and Ridgeline mapping: (1) Being remodelling to existing development, the use of existing topography or natural vegetation for screening is not proposed. See the included freehand sketches, developed from the photographs included, which show the addition. The location, on the southwest corner of the existing residence, adds little to the bulk of the building breaking the ridgeline. (2) No innovative architectural techniques are proposed as the intent is to make the minor addition architecturally compatible with the existing building. Exterior finishes will be synthetic stucco, identical in color to the existing residence. See also (1) above. (3) The additional development has minimal effect on the existing visibility of the height and bulk of the building. (4) The existing building breaks the ridge line as viewed from the public corridors below. The addition is located so as to minimize extent by which the building breaks the ridge line. (5) See (4). (6) See (4). (7) The proposed remodelling and additions contemplate no changes to natural vegetation as they are within the basic footprint of the existing building. (8) No facade or landscaping lighting is proposed. Light fixtures to be added for illumination of the new deck will be selected such that the light source is shielded from view. (9) No land forms or earthmoving are proposed. See (7). (10) There is no scenic viewplane identified in the vicinity. (it) No 1041 review is required. In summary, the existing residence breaks the ridgeline as seen from the view corridors below. The remodelling and additions are well within the guidelines of (D) (1) b., as described above. The remodelling and additions are as compatible with the intent of Ordinance 90 -07 as is the existing structure, which predates this ordinance.
