The Board of County Commissioners of aitl.in County, Colorado, met at 10:00 A. M. Monday,
February 3, 1941, with the following members present: Orest A. Gerbaz, Chairman; George W.
Smith, Commissioner; Boyd R. King Commissioner; M. P.I. Neihardt, Clerk. .
The minutes of the meeting held January 14, 1941 were read and approved.
The Resolutionwas unanimously adopted to authorize the sending of patients to the Colo-
,.. rado General Hospital when deemed advisable by a majority of the members of the Board, on
the signature of the Chairman of the Board that such majority of members approved.
The Clerk was instructed to present a bill to the Selective Service Board No. 72 in the
amount of $)2.50 for night'latch placed upon the door to the room furnished them.
The following Official Bonds were approved as to form and sufficiency:

A resolution was unanimously passed to rent the Maintainer to the City of Aspen for
plowing city streets e $)10.00 per day with operator, the said City to pay gas and oil.
The County Treasurer was authorized and instructed to transfer the sum of $)1,000.00
from the State Special Road Fund to the Special Roads (Highway) Fund.
The ;,lotion was made seconded and carried to get along without a County Attorney for
the year 1941.
The Repptt of the County Clerk for January 19 was approved.
The reports of the County Judge and Clerk of the District Court for January 1941 were
presented and filed.

The following resolution was passed Unanimously:
RESOLUTION
Whereas by an Act of the second extraordinary session of the 29th General Assembly of the
State of Colorado, amending Section 8796 of the Compiled Laws of Colorado, 1921, as amended,
and approved January 11th, 1934, and relating to the deposit of public funds in banks by
County Treasurers, and providing "That in all Counties in this State, the County Treasurer
shall deposit all the funde: and moneys of whatsoever kind that shall come into his possess -
ion by virtue of his office as such County Treasurer do one or more responsible banks located
in the State of Colorado which have heretofore been approved and designated by written reso-
lotion duly adopted by a majority vote of the Board of County Commissioners, which shall be
entered in the 'minutes "; and
:There-as, it is the intent and purpose of this resolution to comply with the iv, and to ha? e-
by approve and designate banks in accordance with the law;
THEREFORE, BE IT RESOLVED, That, until further or other written resolutions duly adopted,
whereby other or different bank or banns ' are approved and designated by the Board of County •
Commissioners of Pitkin County, Colorado, there are hereby approved and designated the fol-
lowing named banks, all located in the State of Colorado, and being: ' •
The Aspen State Bank, Aspen, Colorado.
The First National tank of Glenwood Springs,Glenwood Springs, Colorado
The First National tank of Denver, Denver, Col&rado
in which said banks the Treasurer of Pitkin County, Colorado, shall de-
posit all the funds and moneys of whatsoever king that shall come into hia possession by
• virtue of his office as such Count; Treasurer, in his name as such Treasurer, as provided

3E IT FURTHER RESOLVED, That this resolution be, and is hereby ordered entered in the minutes
of the proceedings of this Board, and that a duly certified copy hereof by the Clerk of this

DELINQIIrIIT TAXES 01" CAR LINE COMPANIES
To All County Treasurers:
At a recent conference held by the members of this Commission with representatives of
various Car Lines which are taxed in Colorado, it developed that considerable delinquency
now exists with respect to a large number of Car Lin, Companies•operating in this State, and
• from information obtained, it seems an utter impossibility to collect these delinquent taxes •

plus penalties and interest. .
An offer of 25% of the original tax his been made in order -to clean up this matter, but
the Colorado Tax Couuaission did not feel that it could order the various counties to make
•
this settlement, but did advise the companies that we would oom°:unicate with each County
Treasurer, and if they felt that this was a fair settlement and would forward abatement
petitions, approved by the Board of County Commissioners of each of the sixty-three countied,
to this Commission, we would be inclined to approve the abatements.

It seems to us that, on account of the manner in which the Car Line Companies are assessed i kkisxsixat
this State and distribution made in small amounts to the various counties through which they
opevute, *e will be confronted with more or less delinquency in taxes imposed upon these
companies.
We believe that legislation should be enacted whereby the Colorado Tax Conunissi on could
make the assessment of all Car Line Companies, collecting the tax thereon, and distributing
the proceeds to the counties in proportion to the number of miles traveled by these cars in
each county, using the same method that is applied by this Commission in the collection and
distribution of ownership taxes on Class A Motor Vehicle Carriers.
If you believe that a bill should be drawn, to be presented at the next session of Nam our
Nooty-
Legislature, to make this change we will welcome your comments and endorsement thereof of yo r
County Treasurers' Association.
We enclose herewith copy of letter received from Attorneys Worth Allen and fir. Frank P.
Lynch, Jr., setting forth their request, together with the taxeu which are delinquent for

Gentlemen:
The undersigned represent various specialty car companies, a list of which companies and
the taxes owed by each of said companies, in each county of the state, is attached hereto
for your information.
These various car companies have in years past, due to financial difficulties and neglig;e.
management, failed to nay taxes which were levied against them in this state. All of these
companies in the last year or two have undergone, in one form or another, a financial reorgai
ization; and in most instances the bondholders have assumed the control, if not the actual
direction, of the companies. It is their desire to attempt to pay out, to the extent of their
ability, the tax liabilities of each. company. one of the companies are in a position to pee
the full amounts of the delinquent taxes, to say nothing of the interest and pe alties owed.
On the other hand, due to the apportionment system provided by statute in this state, the
di.fficnities of collection is such that, in most instances, the delinquent taxes would. be lot
to the counties and the state unless some method can be worked out between the Tax Conliaissio ,
various Boards of Count;; Commissioners and the car companies.
To accomplish: this purpose the various car companies have authorized us to request the
Tax Commission and the various Boards of County Commissioners, to accept an offer of 25% of
the principal amounts of the delinquent taxes.
The figures in the schedule furnished you herewith were supplied by the various County
Treasurers and show the amount owed by each car company in each county, according to our in-
formation, and we respectfully request if this offer is acceptable to you, that it be for-
warded to each of the counties involved within this state, with the recommendation of the
Tax Commission, together with our statement showin the amounts oared, in order that the County
Treasurers may approve these figures, and either accept or reject the offer herein contained
It is the sincere desire of the directorates of each of these companies to'wipe out all of
the old tax indebtedness, and to keep all future taxes in a current condition, We have there 1
fore effected compromise agreements in 12 states, and have paid the amounts agreed upon. In
all other states in which t .ac companies do business, we are at the present time attempting
to effectuate a similar agreement, and expect to do wo within a short time.

The petition of WORTH ALLEN and FRANK P. LYNCH, jr. Attorneys for various specialty car
companies Address E & C Building, Denver, Colorado. respectfully shows that the taxes asses--
ed against your petitioner for the years A.D.1939 and prior thereto should be abated. The ca
companies involved and the amount of tax levied against each company has been heretofore for
warded to your county, together with a letter signed by ':Worth Allen and Frank P. Lynch,, Jr.,
dated August 1, 1940, and together with the Corcular letter No. 8, dated August 8, 1940, of
the Colorado Tax Commission. The grounds for the abatement are more particularly stated in
the letter of August 1, 1940, which said letter is incopporated herein by reference and made
a part hereof. The -car companies hereby respectfully offer twenty -five per cent (25%) of
the principal amounts of the delinquent taxes for the years 1939 and all years prior thereto.
