The board of County Commissioners of Pitkin County, Colorado, met at 7:30 P. M. Monday
September 8, 1941 with the following members present: Orest A. Gerbax, Chairman; George W.
Smith, Commissioner; M. Y. Neihardt, Clerk.
Commissioner Smith presented the following resolution:
R E S O L U T I O N
WHEREAS,_ By the death of Hon. Edt rd ". Tay!or, Congressman from the Fourth Congressional
District of Colorado, a vacancy has occurred in said office,
WHEREAS, The law provides that it is within the duties of the Governor of the State of
Colorado to call a special election for the filling of, vacancies in such offices,
WHEREAS, It has been established by custom that such call may be deferred from time tth time,
until such vacancy shall have been filled at a Regular. General Election,
WHEREAS, The expe.iae or such special election would be a very heavy burden upon the Counties
embraced within this Congressional District,
WHEREAS, No provision has been made in the budgets of the several Counties for the expenditure
of money for election purposes, no levy has been made therefor and many financial and legal
difficulties would arise in the appropriation of moneys for such purpose,
NOW, THEREFORE, BE IT RESOLVED,, By the Board of County Commissioners of Pitkin County, Colorado,
in Special Session assembled, that, for and on behalf. of the Citizens and Tax - Payers Infi rtdx
of said Pitkin County, we hereby petition His Excellency, Ralph L. Carr, Governor
of the State of Colorado, not to call such Special Election for the filling of
said vacancy.
Regularjly introduced, considered and passed by the Board of County Commissioners of
Pitkin County, Colorado, in Special Session assembled, at the. Court House in Aspen, this 8th
darer September A. D. 1941.

A telegram g'rom Commissioner King giving his complete and hearty concurrence and approval
to the Resolution (a copy of which had previously been mailed to him at Denver) was submittet
in lieu of his signature.
The Clerk was instructed to send a tcl.,gra,u to Governor Carr on the morning of the 9th
of September, protesting the calling of said election and to mail the resolution on the
mail - of that date.
