M., Monday October 20, 1941, with the following members present: Crest A. Gerbaz, Chairman; George W. Smith, Commissioner; M. M. Neihardt, Clerk. The minutes of .the meeting held October 6, 1941 were read and approved. The following notice was read: BEFORE THE PUBLIC UTILITIES COMMISSION OF THE STATE OF COLORADO NOTICE GIVEN BY THE CRYSTAL RIVER RAILROAD COMPAiY AND TIC' CRYSTAL RIVER AND SAN JUAN RAILROAD COMPANY,, UNDER THE COMMISSION'S GENERAL ORDER NO. 15$, OF INTENTION TO DISCONTINUE AND ABANDON SERVICE AND REMOVE RAILROAD TRACKS BETWEBI CARBONDALE AND MARBLE, COLORADO. 411, APPLICATION 170. 5767 Pursuant to General Order No. 15 of the Public Utilities Commission of the State of Colorado, The Crystal River. Railroad Company and the Crystal River and San Juan Railroad Company hereby give notice to the Commission that they propose, on or after November 15, 1941, to dismantle and abandon the railroad track of the Crystal River Railroad Company from Carbondale in Gar- field County and thence in Pitkin County to Placita at approximately the boundary line of Pitkin and Gunnison Counties, Colorado, for a distance of approximately 20.66 miles; and to dismantle and abandon the railroad track of The Crystal River and San Juan Railroqd Company from Placita to Marble in Gunnison County, Colorado, for a distance of approximately 7.33 miles; and the Crystal River and San Juan Railroad Company hereby gives notice that it pro- poses on or after the said date to discontinue service and to abandon the operation of the line of railroad of the Crystal Railroad Company from Carbondale to Placita, and the operation of its line of railroad from Placita to Marble,Colorado. A certificate of public convenience and necessity to abandon the said lines of railroad and the operation thereof, as to interstate and foreign commerce, was granted by the Interstate Commerce Commission on September 22, 1941, in an order entered in its Finance Docket No.13356, Dated at Denver, Colorado, this 4th day of Octoberm 1941. SIEVERS, CLAIMANT vs. COUNTY OF PITKIN, EMPLOYER, and STATE COMPENSATION INSURANCE FUND, INSURER, RESPONDENTS, # 192244 ORDER Claimant appeared in person. Respondents appeared by Harold Clark Thompson, Atty. Hearing herein held October 8, 1941, at enver, Colorado, as ,provided by law. The facts established herein are as follows: Claimant suffered a strain of his back in an accident arising out of and in course of his employment on April 16, 1938. Om April 28, 1938, he returned to work at which time it was thought that he hadsustained no permanent partial disability. Claimant's condition has grown progressively worse, and on August 4, 1941, he was forced to leave work. However, he did not file any petition for further compensation benefits until August 19, 1941. It now develops t. =t claimant has sustained a ruptured intervertebral disk and has a high degree of disability. Claimtant was examined by three eminent physicians all of whom made the above diagnosis and recommended a laminectomy. They all testified that claimant was physically able to. undergo su'h an operation and same would not endanger his life. The Referee finds from the medical evidence that with corrective surgery claimant's permanent lisability could be reduced to 1O% as a working unit. The respondent insurance carrier offers. the surgery indicated which claimant flatly refused to accept and undergo. Under the circum- stances the Referee is of the opinion that claimant's permanent disability must be terminated as of this date, and his permanent disability fixed at the degree to which it might be reduce. with treatment. His average weekly wage is $21.00 His age is 51 years; his expectancy of life is 20.20 years. IT IS, THEREFORE; ORDERED: That the respondents pay compensation to the claimant at the rat- of $10.50 per week from August 20, 1941 to October 8, 1941, inclusive, for and on account of temporary total disability; thereafter at that sane rate until the further sum of $1,102.92 shall have been paid for and on max* account of permanent partial disability. FURTHER ORDERED: That respondents pay for the necessary medical surgical and hospital ex- penes incurred within four months, but not to exceed the sum of 0500.00 in value. The above information is furnished as required by Section 299, Chapter 142, Colorado Stat' utes Annotated, 1935: Your attention is directed to the Session Laws of Colorado, 1941, Chapter 42, Section 3, which provides for a tax levy of six (6) mills on each dollar of assessed valuation on all sheep and goats, except those-in feed lots, to be credited on the Predatory Animal Fund. Also to Colorado Statutes Annotated, 1935, Chapter 110, Section 325, which provides that there shall be levied and collected a tax equal to one -tenth of one per cent upon the assess ed valuation of all producing and non - producing metalliferous mining property, including led: claims, placer and mill sites, together with all improvements thereon, to be credited to the Metal Mining Fund. FROM COLORADO RIVER CONSERVATION DISTRICT Extract from the Minutes of the Meeting of the Board of Directors of The Colorado River Water Conservation District Held at Glenwood Springs, Colorado, October 7, 1941. The Board of Dorectors of the Colorado diver Water Conservation District, being in sass •n at Glenwood Springs, Colorado, on October 7, 1941, did, among octhe acts, proceed as follows The following resolution was offered by Mr. Lindstrom, who moved its adoption, and the motion was seconded by Mr. Whalen L Whereas Section 7 (a), Chapter 220, 1937 Session Laws of Colorado, provided that the Board of Directors of the Colorado River Water Conservation District may levy not to exceed two- tenths (0.2) mill upon all taxable property within the said district, for the purpose of paying the ordinary expenses of operation and administration. NOW THEREFORE BE IT RESOLVED, That this Board of Directors adopts a levy of two tent (0.2) mill upon each and every dollar of taxable property assessed within the counti of Delta, Eagle, Garfield, Gunnison; Mesa, Pitkin and Summit (the counties composing said District), for the year 1940, for the purpose of paying the ordinary expenses 1e' of operation and administration of the said District, and the Secretary of the Board is hereby directed to transmit to the Boards of County Commissioners of the counties aforesaid, a certified copy of this resolution. After some discussion the motion was put and the Directors voted as follows: Yea Lindstrom, White, Whalen, Nelson, Heuschkei Nay None and the resolution was declared adopted. DSar Mr. Heihardt: This is to advise you that the tax levy for the City of Aspen as set by the City Council for the year 1941 is as follows: General Fund 23 mills Redemption of Refunding Bonds 21 mills Hydrant and Water Rental 3 mills Total Levy 4 /inns This is a reduction of 2 mills from the 1940 levy, which was the same as the above except for 25 mills for the General Fund instead of 23 as at present. It will be seen from the foregoing levies that the Commissioners have left the total count, levy the same as for the current year.. It is estimated that there will be a deficit at the end of 1941 amounting to about $21,000 The proposed budget will reduce this deficit by $3,000.00 to $5,000.00 in 1942 unless there are unforeseen contingencies.
