Snowmass Creek Outfitters LLC ( "Applicant ") has applied to the Pitkin County Board of County Commissioners (`BOCC ") for Special Review approval pursuant to Sections 4- 30- 040(Q), 2- 30 -30(h) and 2- 40 -20(c) of the Land Use Code to provide horseback riding tours at Capitol Creek Ranch and St. Benedict's Monastery. 2. The BOCC has determined that the proposed use complies with the criteria established in Sections 4-30 - 040(q) and 2- 30 -30(h) of the Land Use Code. NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant Special Review Use Approval to Snowmass Creek Outfitters LLC to provide commercial horseback rides on the Capitol Creek Ranch and St. Benedict's Monastery properties from May 15`h through September 300' for the 2012 through 2016 summer seasons, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and in the public hearing. 2. Horseback rides may occur up to five days a week with up to two rides per day. Each ride may accommodate up to 20 riders. Staging for rides shall be at the entrance of Capitol Creek Ranch off of Nicholson Creek Road and at the Monastery by the barn adjacent to Capitol Creek Road. All client parking shall occur in the staging areas. A port-a -potty and hand - washing facility shall be provided at both staging areas. 2. Food service for rides shall be provided from an establishment(s) with a valid Colorado Retail Food Establishment. 3. The Applicant shall carry and provide proof of adequate Liability Insurance, as required by the County for all times of operations during the 2012 through 2016 seasons. Applicant must notify the Community Development Director of any change of status to the policy during the active season. 4. Special Review approval by the Board of County Commissioners is required for commercial outdoor recreational uses that occur on a repetitive or continuing basis more than six (6) times in any twelve (12) month period and is subject to a U.S. Forest Service Permit requirement The Applicant proposes to conduct horseback rides from the last week of May to the last week of September. Rides would occur five days a week with two rides per day. Each ride could accommodate 1 -20 riders. The application was continued on May 9 due to a noticing error. APPLICANT: Snowmass Creek Outfitters LLC REPRESENTATIVES: Chris Wyckoff and Robb Van Pelt LOCATION: Capitol Creek Rd. ZONING /SIZE: The properties are zoned RS -30. The parcel is 2,220 acres. BACKGROUND: Snowmass Creek Outfitters LLC conducts horseback riding trips and hunting and fishing trips within the Maroon Bells /Snowmass Wilderness in the White River National Forest (Snowmass Creek Valleys), for which they are permitted by the USFS and hold a State of Colorado, Active Outfitter License, #2535. REFERRAL COMMENTS: Comments from Snowmass /Capitol Creek Caucus, Pitkin County Open Space and Trails, Aspen Valley Land Trust and Sheriffs Office are attached for reference. The Basalt and Rural Fire Protection District reviewed the application and has no concerns. CRITERIA FOR APPROVAL — SPECIAL REVIEW USES OR ACTIVITIES (SEC. 2- 30- 30(h)(2)) A. The Special Review shall consider: 1. The applicable County Master Plan; 2. County Land Use Policies in Chapter 1; 3. Let me know if you have any questions. According to the terms of the Capitol Creek Ranch South Conservation Easement, recorded 7/17/2003, and the anticipated terms of the North Conservation Easement, to be recorded in October, the general activities listed within the Special Review for Outdoor Recreational Use for horseback rides on Capitol Creek Ranch seems to be allowable. That being said, Pitkin County Open Space & Trails has a couple of requests; 1. Pitkin County Open Space & Trails would like more information on the "staging" area and more clarification on the map provided within the application. Once we have more information on the activities involved with staging we will be able to better gauge the compatibility. Also, it appears a staging area might be located on the South Conservation Easement. as well as the north portion of the property according to the map. It would be beneficial to have a map with a clear legend. 2. In addition to the above mentioned clarification, paragraph 3.12 (Leases) of the existing South Conservation Easement requires that all lessees or other parties agree in writing to comply with the terms of the Conservation Easement. The approval of this application should be conditioned upon receiving a signed written agreement from the lessee or party stating that they will comply with the terms of the Conservation Easement. In this location there is a large pull out which would make a very convenient easy location. Commercial passive recreational uses such as ..... guest ranch activities are also allowed. Aspen Valley Land Trust considers commercial horseback riding a commercial passive recreation use and has no objection to the proposal as submitted. The conservation easement does require that all lessees of the Capitol Creek Ranch provide a written acknowledgement that they agree to comply with the terms of the conservation easement. Special Review approval by the Board of County Commissioners is required for commercial outdoor recreational uses that occur on a repetitive or continuing basis more than six (6) times in any twelve (12) month period and is subject to a U.S. Forest Service Permit requirement The Applicant proposes to conduct horseback rides from the last week of May to the last week of September. Rides would occur five days a week with two rides per day. Each ride could accommodate 1 -20 riders. APPLICANT: Snowmass Creek Outfitters LLC REPRESENTATIVES: Chris Wyckoff and Robb Van Pelt LOCATION: Capitol Creek Rd. ZONING /SIZE: The properties are zoned RS -30. The parcel is 2,220 acres. BACKGROUND: Snowmass Creek Outfitters LLC conducts horseback riding trips and hunting and fishing trips within the Maroon Bells /Snowmass Wilderness in the White River National Forest (Snowmass Creek Valleys), for which they are permitted by the USFS and hold a State of Colorado, Active Outfitter License, #2535. REFERRAL COMMENTS: Comments from Snowmass /Capitol Creek Caucus, Pitkin County Open Space and Trails, Aspen Valley Land Trust and Sheriff's Office are attached for reference. The Basalt and Rural Fire Protection District reviewed the application and has no concerns. CRITERIA FOR APPROVAL— SPECIAL REVIEW USES OR ACTIVITIES (SEC. 2- 30- 30(h)(2)) A. The Special Review shall consider: 1. The applicable County Master Plan; 2. County Land Use Policies in Chapter 1; 3. The intent of the zone district in which it is proposed to be located; and OU00G1 �� d. The character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or shall enhance the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for development. Response: The Snowmass—Capitol Creek Valleys Master Plan is the primary applicable plan for this area. The Plan states, "While recreation opportunities abound within and adjacent to our area, we wish to maintain the primitive nature of these experiences." The goal of the plan with regard to Recreation and Tourism is to "preserve existing recreational opportunities within the Caucus Area, but discourage expansion of recreation other than small -scale commercial uses of agricultural and other open lands which are fully compatible with the surrounding rural residential land uses." The Plan also addresses "outfitting and guide services" recommending that the County and USFS work together to ensure that local outfitting businesses are operating within all applicable State and local regulations. The Snowmass- Capitol Creek Caucus supports the application. The Applicant has a valid State outfitter license and a USFS outfitter permit. The RS -30 zone district is intended to preserve environmental resources and maintain the rural lifestyle while allowing low- density single - family residential development. Recreational uses such as commercial horseback riding are allowed, subject to Special Review. Commercial outfitters have operated on USFS lands in the Snowmass — Capitol Creek Valleys for years. The BOCC granted special review approval to Capitol Peak Outfitters Inc. to provide horseback riding tours at the Monastery, pursuant to Resolution No. 093 -2005. The permit is valid through 2013, but Capitol Peak is no longer operating at the Monastery. The Monastery has now given permission to the Applicant to operate on Monastery property. Pitkin County Open Space and Trails has reviewed the Conservation Easement on the Capitol Creek Ranch and finds that the proposed use is allowed by the Easement. The Applicant has agreed to comply with the terms of the Easement. The Applicant met with Open Space and the staging areas are acceptable. Aspen Valley Land Trust, co- holder of the Easement agrees that the use is compatible with the Easement. A The location, size, design, and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimize adverse affects, including visual impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, air /water pollution or other impacts on natural resource, noise, vibrations and odor on surrounding properties. Response: As noted above, commercial outfitters have operated in the Snowmass — Capitol Creek Valleys for years. The Applicant limited commercial impacts on the Valley by providing small - scale, non - motorized horseback tours that are in harmony with the rural setting. The horses are boarded on the Monastery property on the west side of Capitol Creek Road, which limits the amount of vehicular travel in the area. The primary staging location for rides will be at the entrance of Capitol Creek Ranch off of Nicholson Creek Road. There is an existing pull out that can accommodate client parking and outfitter vehicles. A secondary staging area will be located at the Monastery by the barn adjacent to Capitol Creek Road; parking can be accommodated in the ranch yard. Horseback rides on Capitol Creek Ranch and the Monastery will occur on existing trails on the properties and will have limited impacts on adjoining properties. Trash will be removed from the properties and disposed of off -site. Ou0002 The primary impact will be from client vehicles travelling to the staging areas. It is difficult to determine the exact impact until the Applicant operates and determines the actual demand for these rides. Staff recommends that the Applicant be required to record the number of trips, clients and vehicles and provide this information annually to Community Development, so staff can evaluate the specific impacts and possible mitigation. C. There must be adequate public facilities and services to serve the special review use, including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection, emergency medical services, hospital and medical services, drainage systems and schools. Response: A port-a -potty and hand - washing facility will be provided at the staging areas at Capitol Creek Ranch and the Monastery. The Applicant has demonstrated that access to emergency services is available via cell phone. The Pitkin County Sheriff's Office supports the application, subject to the following conditions: no emergency access shall be blocked and no parking is permitted on County roads. Basalt Fire did not have any concerns. D. An application for a special review use must demonstrate to the Board of County Commissioners that the proposed development will not 1. Materially endanger the public health safety or welfare; and 2. Substantially injure the value of adjoining or abutting properties. Response: Staff has no information that would indicate that the proposed use will endanger the public health, safety or welfare, or injure,the value of adjacent properties. The Applicant's General Liability Insurance limits are adequate. The Applicant has listed the county as an additional insured on the updated policy. USE SPECIFIC STANDARDS — OUTDOOR RECREATIONAL USE, OTHER (SEC. 4- 30- 40(0)) A. Special Review Approval is required when the following conditions apply: 1. In all zone districts, any outdoor recreational use that is not listed separately and that is subject to a U.S. Forest Service permit requirement Response: Snowmass Creek Outfitters LLC has a valid U.S. Forest Service permit. County special review approval is requested to operate on private property. B. The BOCC is approving the Special Review based on a proposed use that exceeds the following thresholds: 1. Involves more than ten (10) persons on a given property/road at any given point in time; and/or Response: The Applicant has stated that the maximum number of clients on a trip would be twenty (20) with one guide per six (6) guests. Utilizes parking spaces for any single vehicle with a passenger capacity of more than ten (10) persons; and/or Response: The Applicant does not directly provide transportation for clients, but clients could be transported in vehicles with a passenger capacity of more than ten (10) persons. The parking areas on the Capitol Creek Ranch and the Monastery have the capacity to park larger vehicles. 3. Utilizes any given property/road more than twice a day; and/or Response: The Applicant proposes two trips per day, five days a week. Therefore, the proposed use would impact Capitol Creek Road and the subject properties more than twice per day. 4. Utilizes any given property/road more than thirty (30) days per year. Response: Although the total number of days the proposed use may operate is dependant on the number of clients interested in rides, the Applicant proposes approximately four (4) months of operation during each summer for an average of eighty (80) days per year. LIMITATIONS OF USES BY SPECIAL REVIEW (SEC. 2- 40- 20(C)) A. Special Review Use Limitations under the Pitkin County Land Use Code pursuant to Sec. 2- 40 -20(c) include: 1. If the Community Development Director determines that the use is not in conformance with the provisions of the Special Review Use approval, the Community Development Director may recommend to the original review authority that it consider the withdrawal of such approval. Failure of any person operating a use under a Special Review Use approval to submit such a statement within the period specified above shall be considered a violation of the provisions of the special review approval and may be sufficient cause for withdrawal of the approval 4. Approval Withdrawal Procedure: The decision- making body shall consider and act on approval withdrawal after a public hearing. Our rides will commence the last week of May and conclude at the end of September; the start date could start in June and end in August depending on the snow. Our hours of operation differ with each day and every client. We will start as early as Sam and end our day around 5pm. We can accommodate anywhere between 2 — 20 clients on a ride. Brother Raymond has given his permission to "update and extend" the permit that was held by Capitol Peak Outfitters. This permit expires in 2013, and thus we are asking for a 5 - year permit for the Monastery and Capitol Creek Ranch, which would run through the 2016 season. We pasture our horses on the northeastern side Monastery property (1210 Monastery rd Snowmass, CO 81654), but do not conduct any sort of commercial business because we have forest service permits that allow us full use of the Snowmass Creeks. This is where all of our rides are held. We have a tack /storage room, a portal potty, and a trailer parking area where we keep our horses. SCO's main staging point will be at the entrance to CCR, however we will have a second staging area on the monastery that will be used for special circumstances. When entering the Capitol Creek Ranch there is a large pull out that can easily accommodate parking for clients, employees and Snowmass Creek Outfitter vehicles. Let me know if you have any questions. According to the terms of the Capitol Creek Ranch South Conservation Easement, recorded 7/17/2003, and the anticipated terms of the North Conservation Easement, to be recorded in October, the general activities listed within the Special Review for Outdoor Recreational Use for horseback rides on Capitol Creek Ranch seems to be allowable. That being said, Pitkin County Open Space & Trails has a couple of requests; 1. Pitkin County Open Space & Trails would like more information on the "staging" area and more clarification on the map provided within the application. Once we have more information on the activities involved with staging we will be able to better gauge the compatibility. Also, it appears a staging area might be located on the South Conservation Easement as well as the north portion of the property according to the map. It would be beneficial to have a map with a clear legend. 2. In addition to the above mentioned clarification, paragraph 3.12 (Leases) of the existing South Conservation Easement requires that all lessees or other parties agree in writing to comply with the terms of the Conservation Easement. The approval of this application should be conditioned upon receiving a signed written agreement from the lessee or party stating that they will comply with the terms of the Conservation Easement. In this location there is a large pull out which would make a very convenient easy location.
