11111 hill 11111111111111111111111111111 hill 11111111 8389 12:27P SILVIP DAVIS PITKIN COUNTY CO R 0.00 D 0.00 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO,GRANTING AN EXTENSION OF RECORDING THE AMENDED DEED RESTRICTION,OCCUPANCY,AND RESALE AGREEMENT FOR THE ASPEN VILLAGE MOBILE HOME PARK SUBDIVISION/PUD Resolution No. 126 -2001 RECITALS 1. Aspen Village Homeowners'Association, Inc.,a Colorado non-profit corporation, and the 150 Lot owners in Aspen Village Subdivision("Applicant")applied to the Pitkin County Board of County Commissioners("BOCC")for a 90 day extension to record the Amended Deed Restriction,Occupancy and Resale Agreement. 2. The Aspen Village Subdivision, Existing Mobile Home Park Parcel and the Mobile Home Park Expansion Parcel are legally described on the Plat of the Aspen Village Subdivision, recorded in Plat Book 39 at Pages 73-76, as amended by Plat recorded in Plat Book 48 at Page 17, and by Deed to State Highway 82 Parcel A-202 Revised, recorded as Reception No. 403214. 3. Pursuant to Resolution No. 165-2000,the BOCC granted to the Applicant approval for Major Amendments to Ordinance No.96-17,Ordinance No.96-18, Resolution No. 96-142 and Resolution No. 96- 143. As part of this Resolution,the Applicant was granted 90 days from the recording of Resolution No. 165-2000 to record the Amended Deed Restriction,Occupancy,and Resale Agreement. 4. The Applicant indicated to the BOCC that the 90 days time frame granted to record the Amended Deed Restriction, Occupancy, and Resale Agreement was unworkable due to the entities that needed to review the document and the time the homeowners need to approve and sign-off on the changes to the Amended Deed Restriction, Occupancy, and Resale Agreement. 5. The BOCC considered the Applicant's request at its regularly scheduled meeting on July 25, 2001 at which time evidence and testimony were presented with respect to this application. 6. The BOCC determined that the request to allow an extension is warranted and made the determination that the 90 days shall commence upon the County Attorney's review and sign-off of the Amended Deed Restriction, Occupancy, and Resale Agreement. NOW,THEREFORE,BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant an extension of the recording of the Amended Deed Restriction, Occupancy, and Resale Agreement for the Aspen Village Mobile Home Park, subject to the following conditions which shall run with the land and be binding on all successors in interest: 1. All conditions of Resolution No. 165-2000 shall remain in full force and effect. 2. The 90 days for recording the Amended Deed Restriction, Occupancy, and Resale Agreement shall commence upon the review and sign-off of the County Attorney.
