The Board of County Commissioners of Pitkin County, Colorado, met at 10:00 A. M.,
Monday, March 3, 1947, with the following members present: Clarence 0. Quern, Chairman; George
W. Smith, Commissioner; Orest A. Gerbaz, Commissioner; C. H. Darrow, County Attorney; M. M.
Neigardt, Clerk.
The minutes of the meeting held February 18, 1947, were read and approved.
The following offers for tax s a l e certificates and taxes up to and including 1945
were accepted; the intention of the Board being to accept said sums in lieu of all taxes
penalties and interest on said property, over which Board has control:
$5.00 on Cert 1547 sold 1896 for 1895 taxes, describing Lot 6, Block 5,Connors(Sweargngin)
105.00 on Cert 33 sold 1946 for 1945 taxes,describing American, Four Johns, Free Coilha!e- end -bue
and Lucky Lodes, Frying Pan 9707 (Garlington)
The following offers for tax sale certificates aid taxes up to and including 1945
were received and ordered publishedL
$10.00 on Lots 11 and 12, Block 3, Oklahoma
$10.00 on Lot 8, Block 3, Oklahoma
A eports of County Judge, Clerk District Court & County Clerk were received and filed.
The Clerk was instructed to send the following bills:

Francis Kalmes was elected as a member of the Board of Trustee, of the Pitkin County Public
Hospital to fill the vacancy caused by the resignation of W. F. Callahan (Mr.- Callahan's
term having expired the second Tuesday in January 1947, the Election of Mr. Kalmes was
declared by the Board to be for a period of five years or until the second Tuesday in Januar•
1952).
The following letter was received:

The Board of County Commissioners Pitkin County Aspen, Colorado -
Gentlemen: You are advised that because of the shortage of State Highway funds with *doh 'o
match available Federal funds at the time the State Highway Advisory Board met in December t•
prepare the 1947 Budget, it was found advisable to reduce that deficiency to a minimum by nog
only reducing the State maintenance cost but also by discontinuing the contribution of this
D epartment to your County for maintenance.
We regret very much that it does not appear practical for this Department to continue this
contribution. In an analysis of the various counties' share of the State funds allocated
on the basis of State Highway mileage in your County, we do not find that it is less than m:
other counties that have had no Highway Department contribution to their maintenance costs.

On motion duly made seconded and carried unanimously, the Board entered its earnest pro-
test against this action of the State Highway Department, by adopting the following resoluti. :
RESOLUTION
WHEREAS, portions of State Highways No. 82, 104 and 133, are situate within the territorial
limits of Pitkin County, Colorado; and whereas, it has been the practice in the past for Pit in
County, Colorado, to keep up and maintain such highways insofar as located within the limits of aakatx
said County, in as good condition as possible, by payment of one -half the cost thereof by sa d
County, and by contribution from the Colorado State Highway Department of the other one -half thereof;
AND, WHEREAS, during the World War II years the said highways became in bad disrepair becaus= of
the lack of road materials and labor to keep the same in a good state of repair; and, wherea-
said County of Pitkin has during said years, kept such highways in.the best repair possible,
vonsidering the additional cost as well as the scarcity of materials and labor; and, whereas
said highways have because of said World War II conditions, become in bad state of repair in
general and are in need of more maintenance than ever before;
AND, WHEREAS, Colorado State Highway No. 82 is used more at the present time than it had bee
tor more than at any time during the past thirty years, because of intensive winter and summ:r
tourist business at Aspen, the County seat of said Pitkin County; and, whereas, because of
the great development of winter sports in said County, said Colorado State Highway No. 82 wi
be used much more than now used;
AND, WHEREAS, winter sports development in Pitkin County, Colorado, has cause wide publicity : xxika
for the State of Colorado, throughout the United States and even abroad, and has caused Breag
numbers of people to come into the State of Colorado for winter sports attractions; and,
whereas, it is necessary that the highway leading from the City of Glenwood Springs, Colorad.,
to the City of Aspen, Colorado, being Colorado State Highway No. 82, be kept in a good State
of repair for the travelilhm public to and from Aspen;
AND, WHEREAS, this Board of County Commissioners is in receipt of a letter from State High-
way Engineer of Colorado, Mark U. Watrous, in which he has informed said Board that the Colo _
rado State Highway Department would discontinue contributing its share of the cost for main
tenance of said Colorado State Highways in Pitkin County, Colorado; and, whereas, there are
no Federal Aid Highways in Pitkin County, Colorado, such that with the contemplated action
by said Colorado State Highway D epartment, the said County of Pitkin would be obliged to st: •
alone in the maintenance of all Colorado State Highways within Pitkin County, Colorado;
AND, WHERT,AS, IF THE Colorado State Highway D epartment should discontinue its contribution o
maintenance costs for said State Highways in County, Colorado, it will take about six
months for said County to receive the amount formerly contributed, per annum, from the new
increase in gasoline tax in the State of Colorado, and because of the increased costs of mat -r-
lais and labor for highway maintenance, said County of Pitkin will be in deplorable conditio
with reference to its State Highways, since said County needs more moneys for maintenance of
its said highways than ever before due to the reasons above stated;
AND, WHEREAS, this Board of County Commissioners is of the opinion that the proposed action
by the Colorado State Highway Department in discontinuing the payment of its share of mainte-
nance costs of said Colorado State Highways in Pitkin County, Colorado, is unfair to and dis
criminatory against Pitkin County, Colorado, and should be condemned;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Pitkin, ata
Stateof Ccic•_- dam, that the proposed action by the Colorado State Highway Department to dis-
continue its contribution for the maintenance of Colorado State Highways No. 82, 104 and 133,
wit}jin Pitkin County, Colorado, is unfair to and discriminatory against Pitkin County, Colo-
rado, and would throw the entire cost of maintenance os all such highways, insofar as within
the limits of said County, upon said County of Pitkin, and would cause great injury to such
county as a whole; that such action on the part of said Colorado State Highway should be and
is hereby condemned; and that the general public of Pitkin County, Colorado, should be informed
with reference to the subject.
AND IT IS HEREBY ORDERED that this resolution be entered in the recorded proceedings of this
Board of County Commissioners, and that a copy hereof, duly certified by the Clerk of said
Board, be by him delivered to Mark U. Watrous, Colorado State Highway Engineer, at Denver,
Colorado.

The following affidavit was received:

Thomas F. Beck, of lawful age, being first duly sworn, upon his oath deposes and stags
That he is the owner of Tax Sale Certificate No. 201, issued in 1900 for taxes of 19*
for Lot R in Block 52 of the City and Townsite of Aspen, County of Pitkin, State of Colorado
That the said Tax Sale Certificate was assigned to him on December 22, 1915; being
Assignment Certificate Bo. 5887;
That the said Tax Sale Certificate and Assignment Certificate have been lost and
probably destroyed;
That he has never assigned, sold or otherwise transferred said Tax Sale Certificate;
That he desires the County Treasurer to issue a tax sale certificate copy in lieu of
that which has been lost and to assign said copy to the said Thomas F. Beck.
That he prays the Board of County Commissioners of said Pitkin County, Colorado, to
instruct said County Treasurer to issue and transfer such copy of tax sale certificate as
aforesaid;
That he will protect the said Board of County Commissioners and said County Treasurer
against any liability to them or him that may result from such order and issuance of copy ani

On motion duly made seconded and carried the County Treasurer was authorized and
instructed to issue a copy of Tax sale Lertificate No. 201, sales of 1907 for 1906, and to
assign said copy to Thomas F. Beck, in lieu of the original$' which was purchased by said
Thomas F. Beck, but which had been lest and not transferred.
No furth :r b -iness appearing, the Board adjourned.
