Tuesday, September 2, 1947, the Monday preceding being a legal holiday, with the'following members present: Clarence O. Quern, Chairman; George W. Smith, Commissioner; Crest A. Gerbaz, Commissioner; M. M. Neihardt, Clerk; C. H. Darrow, County Attorney. The minutes of the meeting held August 18, 1947, were read and approved. The offer for tax sale certificate and taxes up to and including 1945 on the Merrimac Lode, Inter Alia, was again tabled. The following offers for tax sale certificates and taxes up to and including 1945 were accepted: 45.00 for Cert 1812 of 1897 fob 1896 on Lots 1 -2-3 -4 Block 7, Riverside (Verna Sullivan 0 30.00 for Cert 55 of 1927 for 1926 on E2 Lot R and All Lot S, Block 98 (Mrs.W.K.Martz) 25.00 for Cert 52 of 1914 for 1913 on Lot 0, Block 59, Aspen (Frank Crock) The following offers for tax sale certificates and taxes up to and including 1945 were received and ordered published: 020.00 for Cert 25 of 1930 for 19290m 15/32 Dauntless Lode, Columbia 7666 020.00 forCert 66 of 1932 for 1931 on 17/32 Do On motion duly made, seconded and oarrted unanimously, the Resolution of, August 6, 1940 that all offers for tax sale certificates should be advertised with the prate offered, was rescinded. There being no County Surveyor due to the fact that no one was elected and qualified at the last General Election and no one had been appointed to fill the vacancy, Mr. Tom Walker of Glenwood Springs, a registered surveyor in the State, was appointed to the position' until the next General Election or Special Election called for that purpose. A bid of $120.00 was received for Lots 1 to 25 inclusive, Block 16, Riverside from A. L. Pierce. The Assessor appraised said lots at $250.00. Request was tabled. The amount of 0240.00 was accepted from Tony Vedic for a tract of land, being a part of Lux Placer, described as follows: Beginning- at- n- peinb- where - the- eenber- ±ire - ef - the Roaring- Pork - River- ereeees- the - Tine- fentended}- separating -tke- tracts - now- eeeepied -bS -said- � ' Pony- Vedieend- Anben-Kasteiie -f marked -by -a- fence }; - being 8erner - i; - thence (The true description to be furnished by the Surveyor) The Assessor appraised this property at $700.00. The Clerk was instructed to reply to a letter from the Lion's Club, stating that the holes in the Highway near the Hotel Jerome had been repaired. That other holes in the highway will be filled as soon as it is possible to get the oil, the equipment, etc. He was further instructed to call attention to the fact that some of the holes, notably the ones on Cooper Ave. near the Brown -Hoag building, appears to have been caused by the repairing of water pipes whereby the oil had been disturbed and not properly replaced. The following memorandum of Agreement was entered into with Dorothy Koch Shaw: A G R E E M E N T - THIS MEMORANDUM OF AGREEMENT, Made and entered into on this 2nd day of September, A. D. 1947 by and between DOROTHY KOCH SHAW,'of the County of Pitkin, State of•Co'lorado, hereinafter called the "Licensor," party of the first part, and THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF PITKIN, STATE OF COLORADO,hereinafter called the "Licensees," parties of the secon. part, WITNESSETH: WHEREAS, the Licensor is the owner and in possession of that certain real property, common ly known as the North Texas Millsite, U. S. Mineral Survey No. 3288, in the. Roaring Fork Min ing District, and also of Blocks Five (5) and Six (6), in the City and Townsite of Aspen, al in Pitkin County, State of Colorado; AND, WHEREAS, upon said real property or upon some part or parts thereof, there are situat• certain slag or mining concentrate and sampler tailings, which said parties of the second part desire to appropriate to the use of said County of Pitkin for road and highway purposes within said County of Pitkin; AND, WHEREAS, the Licensor is willing to permit the Licensees, their successors in office and assigns, to appropriate and make use of the said slag or mining concentrate and sampler tailings, in such quantities and at such times as they desire, within a period of five years from the date hereof, for the consideration as hereinbefore expressed; NOW, 'THEREFORE, for and in consideration of the premises, and of the sum of One Hundred Dollars ($100.00) in hand paid by the Licensees to the Licensor, kkzxreceipt of which Licens or hereby acknowledges, and of other valuable considerations, IT IS MUTUALLY UNDERSTOOD AND AGREED as follows: 1. That the Licensees, their successors in office an'd assigns shall have the license, right and privilege to appropriate and make use of any and all slag or mining concentrate I and sanpler tailings located upon the real property hereinabove described, in such quantitie- and at such times as they may desire, all during a period of five (5) years from the date hereof, without charge other than the said sum of One Hundred Dollars (100.00) so paid, 2. That the Licensees, in removing said slag or mining concentrate and sampler tailings, shall not destroy the natural contour of the hill and make no holes in said real property, the Licensees become destroyed r any holes dug i contour should o o B in so removing, and if the y y by the end of said five (5) year/ period, shall fill such holes and restore the contour as near as can be pracitcalbly done. 3. That the Licensees and their successors in office shall not assign any of their rights hereunder without first obtaining the written consent of the Licensor. 4. That no charge shall be made by Licensor, her heirs ofassigns for any slag or mining concentrate and samplet tailings which have been heretofore appropriated by said Licensees, their employees, servants, agents ._and representatives, it being understood that such remova was made with the express consent of Licensor, without consideration other than that define herein. Such prior removal was made in contemplation of this agreement, which covers such prior removal for the same considerations. Each and all the covenants and agreements herein contained shall extend to and become binding upon the heirs, executors, administrators, successors and assigns of the respective parties hereto. - IN WITNESS WHEREOF, the parties hereto have hereunto set their hands and seals on the day and year first above written, said parties of the second part signing by and through their Chairman hereunto duly authorized, attested by their Clerk under the official seal of said 4N County of Pitkin. The following letter and offer was received from Wm R. Shaw: Aspen, Colorado September 1', 1947 To the Board of County Commissioners Pitkin County, Colorado Gentlemen: As a compromise settlement for the taxes on the North Texas Millsite, Located in flit the Roaring Fork Mining District and being U. S. Minergl Survey No. 3266 and also the lands embracodj in Blocks 5 and 6 of Aspen Townsite and the streets and alleys contiguous thereto I submit the following offer: The sum of six hundred dollars being in full for all delinquent taxes, tax sale certificates sad and interest accruing thereon including the taxes for the year 1945. The above offer to include treasurer's fees for Aaapocmpntq, coy, w, The said sum of six hundred dollars to be pan as follows: One hundred dollars at the time of the acceptance of this offer and the balance of five hundred dollars to be paid by November the fifteenth, 1947, it being the intention of this offer that the tax sale certificates shall be assigned to me immediately and that the County Treasurer is to hold the same together with my promissory note bearing interest at one per cent per annum due and payable on the 15th of November, 1947. Said tax salecertificates being held by the County Treasurer as complete and full security for said note. £.tGs Respectfully submitted, William R.
