M., Monday November 3, 1947, with the following members present: Clarence 0. Quam, Chairman; George W. Smith, Commissioner; Crest A. Gerbaz, Commissioner; C. H. Darrow, County Attorney; M. M. Neihardt, Clerk. The following offers for tax sale certificates azubtzxaxxffipsxt xxxixi:xa}s were accepted; 910.00 on Cert 59 of 1922 for 1921 onW5 feet Lot F and All Lot E,Block C ( Neihardt) $25/00 on Cort 1284 of 1908 for 1907 on N./3 Lots A B C, Block 20 (Duroux) $35.00 on Cert 557 Of 1908 for 1907 on S.2 3 Lots A B C, Block 20 (Duroux) 4100.00 on Cert 1064 of 1907 for 1906 on Lots K,L,M, Block 46 (Garlington) The offer of 4150.00 on Cert 45 of 1925 for 1924 was not considered the full I II amount having been paid by the owner, Dick Hindman By motion duly made seconded and carried unanimously, sale was made to Humphrey's Gold (Corporation, 'e Colorado corporation, of that part of the Highland Placer and of the Riverside (Placer owned by the County, to be described by Metes and Bounds as fixed by the County Sur - Iveyor, and consisting of 62.45 acres, more or less. The appraised value as set by the County Assessor was $624.50 and the consideration of this conveyance was said amount of DI& $624.50. By resolution the County Treasurer was authorized and instructed to execute said deed. The following letter was received from the Holel Jerome: Mr.Clarence 0. Quam Chairman of the Board County Commissioners Aspen,Colo October 29, 1947 Dear Mr. Quam: We would like the permission of the County Commissioners of Pitkin County to put in an eight foot parking in front of the Hotel Jerome running the length of the block on Main Street between Mill and North Monarch. We have been informed by Mr. William V. Hodges, Jr. Who consulted Mr. John Marshall of the State Highway Department in Denver who advised it would be alright to go ahead if we can clear it with the City and County authorities and leaving a right of way approximately thirty feet on each side of street center or a total of sixty feet in all. If we extend a parking eight feet from the sidewalk, it would be more than thirty feet from the curb to the street center. We would like to install this arking for the purpose of beautifying the hotel block as we would plant the strip with shrubs, flowers, trees, etc. It would be our intention to eliminate parking in front of the hotel and perhaps encourage parallel parking in the rest of the block if the City Council and Commissioners would deem it advisabie. We are very anxious to do this work before freezing weather so we would appreciate as early action as possible. Yours very truly Chas 0. Bishop Manager. The Board by unanimous resolution deemed such action inadvisable and refused the request. Whe following resolution was unanimously passed: RESOLUTION RE FIRE- FIGHTING Nhereas: The sheriff and other county personnel have been doing certain work toward the pre - vention of forest fires in our county for which it is impractical to keep definite expense ecords, and l areas, the Federal Government, acting under the Clarke McNary Act, of 1942, partially re-. imburses certain co- operating agencies acting Mader the authority of an agreement with the tate Board of Forestry of Colorado for the protection of State and privately owned forest ands, and ereas: Pitkin County being one of the above mentioned agencies is entitled to recognition b f expenditures of time made by certain county paid personnel in carrying out fire prevention activities, e It Hereby Resolved by the Board of County Commissioners of Pitkin County, Colorado, seated in regular session this 3rd day of November, 1947, that a fire fund be hereby created in the ount of $200.00 annually for the purpose of fire prevention activities, outside town and ivic boundaries, within 'che said County of Pitkin. e it further resolved that all moneys hereby placed in said fund and all moneys received rom the Federal Agencies be transferred from the appropriation for fire fighting in the Miscellaneous Fund to the appropriation for Sheriff's Fees, as proportionate part of the expenses of that office for fire fighting. The following letter was received from the Aspen Skiing Corporation: oard of County Commissioners Pitkin County Aspen, Colorado entlemen: We have the following receipts in our possession showing payment of taxes on lazing Star Lode Mining Claim in Roaring Fork Mining District, U.S.Survey No. 5648: Number of Receipt Date Year Amount 1431 September 13,1946 1940 and prior years $ 8.75 1492 September 13, 1946 1941 4.14 1467 September 13,1946 1942 4.09 1460 September 13,1946 1943 4.04 1360 September 13,1946 1944 3.98 1077 September 13,1946 1945 4.10 These receipts are in the name of Harry A. Brown, who was acting at the time for Aspen kiing Corporation. When Mr. Brown paid these taxes, the Board of County Commissioners by •rder dated September 3, 1946, assigned to him tax sale certificate No. 2 issued at the sales • .f December 14, 1934. We were subsequently advised by John Herron that the Blazing a y q y Y la in Star claim was unpatented and'. g that we should not proceed to tax deed upon it, and Mr. Herron gave a right of way agreement for the chair lift. To the best of my knowledge Aspen Skiing Corporation has reimbursed Harry i:rown for the expense that he advanced on its behalf, but the Corporation has never been re- 196 pa d by the county for the amount of money that it received on these tax receipts for payment of taxes on a claim which should not have been taxed. By copy of this letter I am asking Mr. Watt to see if his office has any record of any repayment to Aspen Skiing Corporation. By copy of this letter to Harry Brown I am notifying him that it is the company's understanding that he has been repaid for all that he advanced on our behalf. Will it be possible for the Commissioners to repay the Skiing Corporation on the strength of the facts stated in this letter? The amount is small but it will be helpful to us. Very truly yours Wm V Hodges Jr On advise of taxxx.sk County Attorney that the law provides that possessory rights on mining claims are taxable, the Board,on resolution, decided the amount in question could not be legally refunded. The County Treasurer was instructed to deliver Tax Sale Certificate No. 170 of 1924 for 19 to John A. Beck on payment of assignment fee. This refers to E 25 feet of Lot Q and wrest 5 feet of Lot R in Block 59, Aspen. Mr. Chas F. Garlington was present in person and notified the Board that he was relinquishing the room formerly u..ed by him in his abstract business. This was in accordance with the following notice which had been posted on the door of said room on October 17, 1947 and re- mained posted until November 3, 1947: NOTICE TO QUIT To Chas. F. The above information is furnished as required by Section 21, Chapter 158, Session Laws of 1943. - Your attention is directed to Chapter 31, Session Laws of Colorado, 1945, which provides for a tax levy of six (6) mills on each dollar of assessed valuation on all sheep and goats, except those in feed lots, to be credited to the Predatory Animal Fund and forwarded to the State Treasurer. Also to Colorado Statutes Annotated, 1935, Chapter 1M0, Section 325, which provides that there shall be levied and collected a tax equal to one -tenth of one per cent upon the assess- ed valuation of all producing and non - producing metaliferous mining property, including lode claims, placer and mill sites, together with all improvements thereon, to be credited to the Metal Mining Fund and forwarded to the State Treasurer. WHEREAS, Section 7(a), Chapter 220, 1937 Session Laws of Colorado, provides that the Board J ul . Directors of the Colorado River Water Conservation District may levy not to exceed Two - tent s mill (0.20) upon all taxable property within the district, for the purpose of paying the ordinary expense of operation and administration of the Distruct, NOW THEREFOR BE IT RESOLVED, That the Board of Directors of the Colorado River Water Conser vation District, being fully advised in the premises, hereby adopts a levy of Fifteen- hund (-9: }6 dredths (0.15) mill upon each and ev60 dollar of taxable property within the counties of Delta, Eagle, Garfield, Gunnison, Mesa, Pitkin and Summit (the counties composing the_d.ist- rict), as the same was returned for the year 1947 by the several County Assessors and certi ied by the Colorado Tax Commission to the Colorado State Board of Equalization and by it adopted., for the purpose of paying the ordinary expenseof operation and administration of the Distri t. October 9, 1947 CIRCULAR NO. 6 - SERIES OF 1947 • COUNTY LEVY 1947 Board of County Commissioners, Pitkin, County Gentlemen: . This is to remind you that, as provided by Sec. 29, Ch. 142, C. S. A. 1935, County Budgets for Ordinary, Poor and Contingent purposes are limited to a levy of 4.0 Mills. Any levy in excess of this cannot be extended withott the prior approval of the Colorado Tax Commission. If the above mentioned levy is insufficient_to meet your needs, permission can be granted to levy not to exceed and ac'ditional 5 mills. For general school purposes a maximum of 5 mills can be levied on the assessed valuation of your county using the valuation as fixed by the State Board of Equalization, less the sum of $2,779.01 your Income Tax apportionment. Thus your maximum levy for the current year will be 2.921 mills for General School purposes. _ If the needs for increased levies are sufficiently explained in your application it will not be necessary for you to appear with your request in person. Eindly mail your county budget with the application. In setting up your funds for He- appraisal, you can either show this in the Assessor's appro- priation or set up a separate fund to be,designated as "Appraisal Fund ". Of course the amount appropriated becomes a part of your Ordinary County Fund. • In submitting your application, please base all levied on a valuation of $2,575,220, which is the valuation of your county as fixed by the State Board of Equalization for the year 1947. Darrowy the following resolution was unanimously passed and adopted, to -wit: WHEREAS, there is no duly qualified, licensed or acting abstracter within or for Pitkin County, Colorado; and, whereas, the owners of real property and persons having any interest in or against real property in Pitkin County, Colorado, are greatly inconvenienced and are being injured by the fact that there is no such abstracter; AND, WHEREAS, it has been represented to this Board of County Commissioners that the Abstracters' Board of Examiners of Colorado is ready and willing to issue an abstracter's license to one James C. Hiatt, of the City and County of Denver, State of Colorado, for ab- stacting in Pitkin County, Colorado, provided that this Board of County Commissioners will give to the said Hiatt, the exclusive right to the use of any and all abstract of title books belonging to Pitkin County, Colorado, with access to him, as well as to the general public, of all the public land records and to the public records in the custody of the Clerk and Recorder of Pitkin County, Colorado; AND, WHEREASW this Board of County Commissioners is desirous of correcting the existing situation and desires that the said Hiatt become duly licensed as an abstracter for Pitkin County, Colorado; AND, WHEREAS, there is available office space for an abstracter between the office of the Clerk and Recorder and the CommissionersS Chambers in the Court House of Pitkin County, Colo- rado, which this Board of County Commissioners is ready and willing to lease to the said Hiatt, subject to the conditions hereinafter stated, on the basis of a month to month ten- , ancy, at a rental of 42O.00 per month; - '', NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Pitkin, State of Colorado, that if the Abstracters' Examining Board of the State of Colorado will license James C. Hiatt, of the City and County of Delver, State of Colo- rado, as an abstratter, for Pitkin County, Colorado, the said County of Pitkin wilt grant unto the said Hiatt, the exclusive right and privilege to the use of any and all abstract indicexed, books and records, with free access to him, along with the general, public, to the public land records and other public records of said County of Pitkin, in the custody of the Clerk and Recorddr of Pitkin County, Colorado, but expressly under the direction, supervision and care of the Clerk and Recorder of Pitkin County, Colorado, for so long as the said Hiatt shall actually do abstract of title work in Pitkin County, Colorado, and maintain an office therein, provided that he shall be licensed as an ab- stracter and open his office for abstract work in Pitkin 'County, Colorado, within a period of sixty (60) days from the date hereof. BE IT FURTHER RESOLVED that Pitkin County, Colorado, will lease tuto the said Hiatt, subject to the above and foregoing conditions, that certain office space formerly occu- pied by Charles F. Darlington, as an abstracter, located between the office of the County Clerk and Recorder and the Commissioners' Chambers in the County Court House of Pitkin • County, Colorado, on the basis of a tenancy from month to month, atya rental of $20.00 per month, payable in advance, for so long as the said Hiatt shall be duly licensed as an abstracter for Pitkin County, Colorado, and during the time that he actually does abstract work for the public generally, maintains such space as an abstract office and pays the rent, unless such office space should be needed for county purposes at any time in the future, in which event, such lease may be cancelled upo4 the giving of statutory i notice.
