September 5, 1950 with the following members present: T. J. Sardy, Chairman; Commissioners Orest A. Gerbae and Clarence 0. Quern; C. H. Larrow, County Attorney; Wm C. Stapleton, Acting Clerk. The minutes of the meetings held August 7, 1950, August 18, 1950 and Special Meeting held August 21, 1950 were read and approved. 1 The Reports of the County Clerk, Clerk of the District Court and Clerk of the County Court \ were approved. The following agreement was signed and ordered written in the minutes regarding maintenance of Independence Pass with the State Highway Department: 4/14/50 Pitkin County ll (Mtnce. on S. H. 82) --1 AGREEMENT THIS AGREEMENT, made this 17th day of April, 1950, between the COUNTY OF PITKIN, herein - after called the "County ", and the COLORADO STATE HIGHWAY DEPARTMENT, hereinafter called the i "Department," WITNESSETH that WHEREAS, through conference and correspondence, it has been / • (!determined that the County wishes the Department to maintain State Highway No. 82 between the !City limits of Aspen and the Pitkin -Lake County line at the top of Independence Pass, at the sole expense of Pitkin County for the season of 1950, and such arrangement is agreeable to the Department, NOW,THEREFORE, in consideration of the premises and of the mutual covenants hand agreements herein contained and the faithful performance thereof, the parties hereto promise and agree as follows: 1, The Department, with its own organi and equipment, will begin maintenance operaticns on State Highway No. 82 between the city limits of Aspen and the Pitkin -Lake County line at the too of Independence Pass, as soon as practical after this agreement is executed, and will continue same until the first deep snow of the season 1950 -51 closes the Pass, after which maintenance will be discontinued unless further maintenance under the terms hereof is arranged 'to be carried on by mutual agreement. gm - 27 9 2. Charges are to be made for actual expenses covering labor, material, supplies and rental of equipment, but no administration or overhead charges will be made against the County. 3. The County is to be billed monthly for the work done, and payment will be made promptly. If payment is not made within 30 days after presentation of bill, the State Treasurer is auth prized and requested, upon being advised of this fact by the Department, to pay said indebt- r adness and debit the same against Pitkin County's accumulated apportionment of the Motor Fuel Tax and Motor Vehicle License Fees. 1 4. This agreement shall not be deemed valid until it shall have been approved by the Cont- roller of the State of Colorado, or such assistant as he may designate. L-! Bids to be submitted to County Commissioners Pitkin County, Colorado October 2, 1950 at 1O:pO A.M. or left with the County Clerk prior to that date. Board reserves the right to reject any or all bids. The Proposed Budget for the fiscal year 1951 was submitted by the Budget Officer and ordered published for inspection to be adopted at the regular meeting to be held October 2, 1950.
