The Board of County Commissioners of the County of Pitkin, State of Colorado met at 10;00
A.M. August 18, 1955 with the following members present; C. 0. Quam, Chairman; T.J. Sardy,
'Commissioner; Crest A. Gerbaz, Commissioner; Wm C. Stapleton, Clerk.
Minutes of the meetings held August 2, 1955 and August 4., 1955 were read and approved.
Letter was received from Everett J. Lee, State Park and Recreation Board and placed on
file.
The following letter was directed to Mr. Everett Sollee, President, Crowley County Farmers
Assn., Ordway, regarding Frying Pany Diversion Project;

!Dear Mr. Sollee:
It has been brought to our attention that your Association is opposed to the construct-
ion of the Frying Pan Arkansas Diversion Project and is thusly on record. You are possibly
aware that this County is of similar opinion for the following reasons: (a) It creates
added competition for our already harrassed farmers. (b) The cost of the Scheme per acre
is prohibitive. (c) The cost of the water per acre foot is prohibitive. (d) It will in-
crease taxes both direct and hidden for all of us. (e) The State of Colorado will be
better served by using the water in its natural basis to develop its fantastic mineral re-
1 sources. (f) The economy of this county is largely based upon its rivers.
If it is possible for you and for us to cooperate for our mutual advantage we trust
you will advise us. We would appreciate it if you would mail us a copy or several copies of !I
resolutions adopted by your organization concerning your objections to this proposed legis- li
�l lation.

The following letter of authorization to the Forrest Service for a right -of -way was allowed:

Dear Sir:
You are hereby authorized by the Board of County Commissioners of Pitkin County, Colo-
rado to proceed with the construction of Woody Creek Road Extension across the following
mining claims:
Texas Lode Mining Claim U.S. Mineral Survey No. 12691 Woody Creek Mining
District:
Alps Lode Mining Claim U.S. Mineral Survey No. 12691 Woody Creek Mining
District:
belonging to Pitkin County in Section 10, T9S., R8)}W., 6th P.M.
If further authorization is necessary showing a proper description of the location of
the right -of -way this can be taken up with the Comm ssioners at the meeting of Sept. 6, 1955.

The following letter of agreement was received;
August 23, 1955

Aspen, Colorado
Gentlemen: I
As I discussed with you at your meeting of August 2, 1955, I requested permission to lay a
l pipeline upon and along the west side of the Cou #ty Road right -of -way north of Highway 82
and west of Castle Creek as the said road passes through the property owned by Michael Marol ;.
Pursuant to said request, I agree to do the following; ;!
1. Dig the trench for laying the pipeling at my own expense at a sufficient depth to pre-
vent freezing of said pipeline.
2. That I will back -fill said trench after the pipe is laid to the end that the right -of-
way be restored to substantially the same condition as existed prior to digging.
3. That I will at all times properly maintain said pipeline to prevent damage to the County l!
Road.
L{.. That I will, during the construction and while laying of said pipeline, reimburse the
County for any damage that may be occasioned or caused by my contractors or employees while
working on the project.
5. That I will file within 90 days with the County Commissioners a plat showing the lot
lay -out and the golf course lay -out together with easements for power lines and water mains,lll

said plat to be adequate for recording under the zoning resolution ordinances of the Count
of Pitkin and the laws of the State of Colorado and that I will at all times comply with county
zoning regulations respecting the sale and use of said property.
6. That in the event it is necessary for me to cross said county road with the pipeline, I
will during the opening of said road provide access to the public at all times causing as little
public inconvenience as possible; and that I will restore the road to its original condition. ti
7. That the work of laying said pipeling will at all times be done under the supervision
of and subject to the approval of the County Surveyor.
8. That in the event I shall fail to meet my obligations hereunder, then the permission
that may be granted hereunder on the County Road right -of -way may and shall be subject to J
revocation by the County Commissioners for Pitkin County.

Wm. C. Stapleton was appointed Budget Officer for the Fiscal Year 1956 at a salary of $125.00
per year.
Warrant No. 2619 Hospital Fund was ordered cancelled. Warrant was issued to Aubrey H.
Freeman, Glenwood Springs, in the amount of $20.00. Warrant No. 2619 A in the same amount
was issued to replace.
No further business appearing the Board adjourned to meet September 6, 1955 at 10:00 AM
