Pursuant to Subsection 2 -30 -20 and 4 -30 -50 (i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ( "Director ") may approve a Temporary Commercial Use Permit for commercial activities or special events. 2. Cheryl Sovich (hereafter, the "Applicant ") has applied for approval of a Temporary Commercial Use Permit to operate a wholesale landscape business from the Aspen Quick Mart site at 31336 Highway 82 for the summer of 2012. 3. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4 -30 -50 (i) of the Land Use Code. NOW, THEREFORE, BE IT DETERMINED BY THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY THAT the Cheryl Sovich Temporary Commercial Use Permit is approved, subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. Temporary Commercial Uses of more than 72 hours duration no longer require Board approval and may be approved administratively. APPLICANT: Cheryl Sovich, Runaway Shovel, Inc. (hereafter, "Applicant "). LOCATION: Aspen Quick Mart, 31336 Highway 82, Don and Linda Crouch, Owners BACKGROUND: Applicant desires to conduct her wholesale landscaping business with a base of operations on vacant "yard" space at the Quick Mart. A permit for this operation has been approved for the last eight summers, and the Applicant is requesting that the same level of activities be allowed again this summer. Ms. Sovich has operated a landscaping business in the valley for 21 years. Finding an upvalley base of operations has been problematic. Prior to 2004, Ms. Sovich was operating out of a residential property in Woody Creek. Neighborhood concerns led to a County "Notice of Violation" and removal of operations from that site. Ms. Sovich has been looking for a permanent site where zoning would allow such use. Ms. Sovich has been unsuccessful in finding a suitable location to date, which is why she is again seeking temporary use of the Quick Mart location for this summer. Discussions with the Aspen Village HOA have resulted in some new traffic management protocol which will be utilized again this year: Pick up trucks and trailers will be loaded before 8:00 AM and either moved off the site or moved to the "park& ride "; Deliveries will take place after 9:OOAM to the extent practicable; No more than three trailers will be left on the property overnight; Lessee's personal vehicles will be left in the "park & ride" or in the diagonal Quick Mart spots. The proposed operation is located adjacent to the Quick Mart building on a vacant grassy area. There is one temporary shade hoop house structure and a wire fence to enclose the operations for security and protection of plants from the wildlife. There will be no retail sales. The only signage is to notify people that no retail sales take place on the premises. Deliveries will off load from the Quick Mart paved areas. Business vehicles will park in the Quick Mart parking areas. -4 Z STAFF COMMENTS: Pursuant to Subsection 4 -30 -50 (i) of the 2006 Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: 1. Public Safety (if necessary); 2. Public Parking; 3. Site set -up, maintenance and clean -up; 4. Emergency services. Additionally, temporary structures must conform to applicable building codes and other County regulations. Each of these requirements is addressed, in turn, below. Public Safety: No special arrangements are necessary. Public Parking: There will be no retail operations and no "public" accessing the site. Business vehicles will use portions of the Quick Mart parking areas, not "grassy areas ". Site Set -Up. Maintenance and Clean -Up: Applicant will restore site after breakdown in November. Emergency Services: No special emergency services are necessitated. Conformance with Building Code: A building permit is required for the shade hoop structure.. P 0 Box 567, woody creek, CO 81656 March 23, 2012 Dear Lance, RE: TEMPORARY COMMERCIAL USE APPLICATION FOR ASPEN QUICK MART — 31336 HWY 82, ASPEN, CO 81611 This is the start of our 215` year operating the Runaway Shovel and the 91h application to operate from the above location at the Quick Mart. As in the past we will have the same 5 crews of 4 guys in each truck or van. I will need three spaces for my trailers and will park them overnight, one under the spruce and the other 2 in the designated spaces. All trucks and one trailer go home at night and the crews show up at 7.30 to hook up trailers and go to the dump before the day begins. The van returns to re -load with flowers and containers during the day from May to August but the trucks generally only come back at the end of the day. We receive deliveries from mid May — August, from 3 — 5 deliveries a week with delivery trucks from semis to U hauls. In the past few years we have not had deliveries after August. We will continue to try and get our deliveries after 9am so as to avoid the congestion in the morning. We will set up the same shade hoop house with fence and gates for security and in poor weather we have had to pull over plastic to protect the plants overnight. We will remove the shade covers as soon as the stock is low but at the latest end September. We need no signage except to direct the public that we do not retail. Each year we have plants stolen and this past season even tools off the trailers went missing so we shall be locking down more this season. Our season begins in earnest from April 14 to October 15 2012. There is a small crew that will water at lam when we have the flowers delivered. We work Monday through Saturday in high season and no Saturdays as the needs are reduced but there will always be a waterer over the weekends to keep our flowers in prime condition. The crews return from 6 — 7pm on work days to unhook trailers. AQM is primarily a staging area for us, we meet in the mornings, load trucks and trailers with bagged goods or plants. We plant containers on site and receive deliveries of plants and some supplies like potting soil and bark. The location continues to be very convenient for us and we are grateful to have the site available to us. We had a good year last year but are once again hoping for a return of 2007 and a bumper year!!!
