HomeMy WebLinkAboutbocc.res.035.1972 RESOLUTION THE BOARD OF PITKIN COUNTY COMMISSIONERS PITKIN COUNTY, COLORADO 7c •33 The next matter to come before ,the Board of County Commissioners of Pitkin County, Colorado was the matter of the ' j purchase by the County of the following described real property "ft situate in the County of Pitkin, State of Colorado, hereinafter referred to as the "subject property": • low Lots 5 and 6 in Block 19, East Aspen Additional , Townsite Entry, according to the Plat thereof recorded as Document No. 108353, in Ditch Book 2A at Page 252 of the records for Pitkin County; to- . gether with a strip of land lying Northerly thereof and bounded on the West by the West line of Lot 5 • . projected Northerly to the South line of the road as constructed and in use on December 10, 1959, • bounded on the East by the Easterly line of Lot 6 projected Northerly to the South line of said road; bounded on the North by the South line of said road as now constructed and in use, bounded on the South by the North line of said Lots 5and 6, and described in Deed 'recorded April 12, 1960. in Book 190 at page 299. County of Pitkin, State of Colorado. It was pointed out to the Board that this property, present, ly occupied by the Pitkin Title Company, had been offered to the. County by Mr. Samuel W. .'Howell, a former County Commissioner for • the purchase price of $58,000.00. This price was established by virtue of an appraisal of the subject property made by.Edward W. Morse of the real estate firm of Mason and Morse,in Aspen, -Colorado. The County Attorney, Leonard Oates, pointed out to the Board that any purchase of the property by the County would be subject to the ,existing lease with Pitkin Title Company, which provides .f or monthly lease payments by that firm in the amount of $300.00 until 1974, and thereafter $350.00 per month during a lease option period for additional five (5) years, expiring in the year 1979. It was pointed out that negotiations had been held between the County''and Pitkin Title Company and that the Pitkin Title Company' waS willing to assign its lease to the pro- perty• to the County effective November 1, 194 for and in con- . . •! 0./20." sideration of the sum. of •$17,900.00, which amount represented • the amount of money which they would have to pay for rental of other and comparable property less their present rental, i.e. • 1 the value on a square foot basis of comparable i q p property less the I i value of the subject property at a square foot value. By this arrangement the County would receive an assignment of the existin_• I lease, and by purchase of the subject property would be in a position to cancel the lease which in effect would be a lease with itself. County Attorney Oates pointed out to the Board that by virtue of Article XI,' Section 6, of the Constitution of the +.. State of Colorado, as amended, that because the seller, Mr. Howel , wanted a down payment of $14,500.00 on the purchase price and the balance amortized over .ten (10) years in equal annual installment-, plus 6% per annum on the unpaid balance, and further•provide for no prepayment in the first three years, that it would be necessar to submit the question of such a loan arrangement to the voters before entering into the transaction. Whereupon, upon motion I duly made and seconded, and based upon the preambles hereinafter set forth, the following Resolution was adopted: WHEREAS, the facilities of the Pitkin County Courthouse are presently inadequate to :service the expanding functions of County' government in Pitkin County, Colorado, and WHEREAS, a acute need is presently recognized with respect to'court facilities situate on the second floor of theiPitkin County Courthouse, and ' . WHEREAS, the purchase of the Samuel W. Howell property situate adjacent to and northeasterly of the existing Pitkin County' Courthouse would greatly relieve the shortage for court facilities in Pitkin County, Colorado, and AU WHEREAS, this Board has found and determined that the purchase of the lease of Pitkin Title Company to the subject ..r property would be in the best interests of Pitkin County, and ' I WHEREAS, this Board has determined that the question of the purchase of the subject property by the County for the consideration and under the terms above specified should be submitted to the voters of Pitkin County as required by the Constitution of the State of Colorado, . : NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Pitkin County, Colorado, that the offer of the I Pitkin Title Company to assign to the County, their lease to the subject property for the consideration of,$17,900.00, be and the same hereby is accepted, and that the County pay to Pitkin Title Company that amount, receiving therefor an assignment of said lease• and assuming by that lease the terms, conditions and obliga- 1 tions thereof, and BE IT FURTHER RESOLVED, that the following question be 'wr placed upon the ballot at the general election to be held ■ November 7, 1972, to be voted upon by the qualified tax paying electors of Pitkin County, Colorado: Should Pitkin County purchase, for the utilization by the County for public purposes, at a $58,000.00, $14,500.00 y p pu p price of down, the balance amortized over 10 years in equal annual pay- ments plus 6% interest on the unpaid balance, the following described real property situate in Pitkin County, Colorado: Lots 5 and 6 in Block 19, East Aspen Additional Townsite Entry, according to the Plat thereof • recorded as Document No. 108353, in Ditch Book 2A at Page 252 of the records for Pitkin County; • together with a strip of land lying Northerly thereof and bounded on the West by the West line , • • • of Lot 5 projected Northerly to the South line of the road as constructed and in use on December . • 10, 1959,, bounded on the East by the Easterly line of Lot 6 projected Northerly to the South line of said road; bounded on the North by the South line • of said road as now constructed and in use, bounded on the South by the North line of said Lots 5 and 6 and described in Deed recorded April 12, 1980 in Book 190 at page 299.
