A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO,
ADOPTING CERTAIN CONSERVATION EASEMENTS INTO
PITKIN COUNTY OPEN SPACE&TRAILS CONSERVATION EASEMENT PORTFOLIO
RESOLUTION NO. 033 -2012
RECITALS
1. The Pitkin County Open Space and Trails Program was created in 1990 to acquire and
preserve lands possessed of significant scenic,habitat, and recreational values.
2. The County Home Rule Charter, at section 13.1.3,provides for the use of Open Space Funds
for"managing, maintaining, rehabilitating, and preserving County open space and trails
either acquired from the Open Space and Trails Fund or acquired from other sources and
designated from time to time by the Board of County Commissioners after consulting with
the Open space and Trails Board, but such revenue shall not be used to replace existing
funding for the maintenance of Open Space and Trails."
3. Title 12 of the Pitkin County Code, section 1-2,provides that designation of Open Space and
Trails shall occur pursuant to Resolution or Ordinance.
4. On February 16, 2012, The Open Space and Trails Board of Trustees recommend the
adoption of these conservation easement into the Pitkin County Open Space and Trails
conservation easement portfolio.
5. The Board of County Commissioners desires to designate certain properties and Pitkin
County Open Space and Trails in order to fund the long term stewardship of those properties
as contemplated by the Home Rule Charter at section 13.1.3.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado that:
1) The following conservation easements conveyed to Pitkin County;
a) Guenther-Larsen Conservation Easement(Urschel Tract C)recorded 2/28/2001 at
reception number 451944.
b) McCloskey Conservation Easement recorded 7/19/2005 at reception number 512575.
c) Rubey Subdivision Conservation Easement recorded 11/15/2007 at reception number
544082.
d) Ruedi South Shores P.U.D. Conservation Easement(s)recorded 12/30/1985 at reception
numbers 274436, 274437, 274438, 274439, 274440, and recorded 12/31/1985 at
reception number 274488.
e) Zoline Conservation Easement(s)recorded 12/21/1983 at reception number 255877 and
recorded 12/12/1984 at reception number 264588
are named, declared, and designated as Pitkin County Open Space and Trails conservation
easements.
