SILVIA DAVIS RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO,GRANTING AN EXTENSION FOR RECORDING THE AMENDED PLAT FOR
THE VACATION OF A PORTION OF RUBY MOUNTAIN DRIVE IN THE CRYSTAL RIVER
PARK SUBDIVISION

RECITALS
1. Steven and Stephanie Litz(Lot 3),Richard and Donna Hopkins(Lot 4),J.Patrick Luke(Lot 5),
Mark and Elizabeth Mueller(Lot 6), Steve and Lynne Cordova(Lot 7),CRV Properties Ltd. (Lot 41),
Carolyn and Philip Gaylord(Lots 42&43),Elizabeth Bushey(Lot 44),Margaret Rooney and Christopher
Arnold(Lot 45),Lisa Dupre(Lots 46&47)and Neill and Nancy Taylor(Lots 48 &49),("Applicants")
have applied to the Pitkin County Board of County Commissioners(`BOCC")for approval of the vacation
of a portion of Ruby Mountain Drive in the Crystal River Park Subdivision that has never been constructed
and does not need to be constructed in the future.
2. The portion of Ruby Mountain Drive to be vacated runs behind Lots 41-49 and Lots 3-7.
3. The BOCC granted approval of the road vacation pursuant to Ordinance 016-2001 on April 11,
2001. As part of this Ordinance,an amended plat was to be recorded 30 dates from the approval of the
Ordinance. Due to minor delays in the routing process of the plat for signatlres,the Applicants were unable
to record the amended plat in the assigned amount of time. The Applicants request an extension for the
recording of the plat until October 1,2001.
4. The BOCC considered the Applicant's request at its regularly scheduled meeting on September
26,2001, at which time evidence and testimony were presented with respect to this application.
5. The BOCC finds that the request for extension is appropriate.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant approval for the extension of filing the Ruby Mountain Drive Road Vacation
amended plat, subject to the following conditions:
1. All conditions of Ordinance No. 016-2001 shall remain in full force and effect.
2. The Amended Plat shall be submitted for recording by October 1, 2001.
APPROVED ON THE 26TH DAY OF SEPTEMBER 2001.
