The following Ordinances:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF
PTTK[N COUNTY, COLORADO, ESTABLISHING FEES FOR THE
COMMUNTTY DEVELOPMENT DEPARTMENT AND REPEALING AND
REPLACING ORDINANCE 022-2006
Ordinance No. -2008
RECITALS
1. Pitkin County pcopoaes to set fees fo� the Commmity Development Deparhnent
that are consistent and fair to the public and reflect the expense incuered in
providing such services to [he public.
2. Certain fees cunen[ly charged for development review no longer retlect the cost
of providing the necessary levels of such services. The policy of [he Pi[kin County
Boazd of County Commissioners is [ha[ development shall pay, in full, the cos[ of
development review in Pitkin County. Long Range planning shall be funded
[hrough the generalfund.
3. Paymen[s due to the County for obligations due to sales and tax aze no[ regarded
as fees and therefore not included in the Ordinance. The Ordinance does not
reflect an encompassing fee schedule.
4. Planning fees are proposed to be increased by 8% this year, with the fees ro be
reviewed annually rather than making large increases every several years.
5. The Intergovemmental Agreement behveen the County and the City of Aspen
Community Development Depaztrnents requ'ves that building fees be consis[ent
with the City of Aspen in order to make the building permitting prceess seamless
for the public.
6. The BOCC considered the proposed fees at a first reading on January 23, 2IX18, and
voted to approve the proposed fees on second reading and public heazing on
Febniary 13, 2008.
7. The BOCC finds that adoption of this ordinance is necessary for the immediate
preservation of the public health, safety and welfare of the citizens of Pitkin CounTy
and, therefore, declazes this ordinance to be effective immediately.
NOW, THEREFORE, BE IT ORDAINED by the BOCC that it dces hereby
adopt fees for the Community Development Depardnent as follows:
1. Planning, Zoning and Refeaal Agency fees shaR be based on the attached fee
schedule (Exhibit A).
2. Building permit fees shall be based on the attached fee schedule (Exhibit B).
3. Mechanical permit fees shall be based on the a[tached fee schedule (Eahibit
C�.
4. Plumbing permit fees shall be based on the attached fee schedule (Exhibit D).
5. (nternational Fuel Gas Code explained in Ezhibit E.
6. National Electric Code Pertnit Fees permit fees explained in Exhibit F.
Z Conhactor Licensing Fees shall be based on the attached fee schedule (Ezhibit
G).

The following guidelines shall be used for the adminisna[ion of the fee structure set forth
above:
l. Fees charged for [he processing of applications, which fall into more than oce
type of application, shall be cumulative. In the event [hat the fees that eesult &om
accumula[ion are fowd by the Community Development Director to be excessive
in reladon [o the number of hours i[ is anticipa[ed to require [o prceess the
application, the Community Development Depar4nent may waive or adjust the
accumulation requiremen[.
2. Additional chazges shall be billeA on an hourly basis beyond the base fee only if
� [he time exceeds the average by more [han 20 % in the prwessing of an
application.
3. Public Notices for Code Amendments will be billed for acNal costs.
4. Additional charges shall be computed at the rate of two hundred and forty-nine
dollars ($249) per hour of additional Community Development Department staff
time required
5. The Communiry Development Department shall identify, prior to or at the time of
submission of a land use application, whe[her an application is to be referted [o
the Planning Engineer, Housing Office, Environmental Health and Natu[al
Resources Divisioq Floodplain Administrator, A'vport or RFfA. Additional
charges will appty as shown below. Other agencies may require additional fees
for review of land use applications, which fees must be paid separately.
6. M applicant may request that the BOCC waive fces for projects serving a public
pwpose, proposed by a non-profit organization, or in order m dispute [he fee
chazged.

Purv CxECK Fees
A plan check fee shall be paid at the time of submitting the submittal documents for plan
review. Said plan review fee shall be 65° o of the building peemit fee.
Energy Code Fees
Energy code review fees are based on the building peanit fee and equal 10 % of the total
building pennit fee, with a minimwn charge of $30.00.
Fire Sprinkler Fees
Fire sprtnkler fees are based on [he valuation of the fire sprinkler sys[em and calculated
according to the Building Permi[ Fee schedule. The total Fire Sprinkler Pemiit fee is the
to[al of the permi[ and the plan check fees.
Excavation/Fowda[ion Fees
The excavation/founda[ion pertnit fee is 35% of the building petmit fee.
