The zone dishict is intended to allow only very low impact resource or residential uses on such lands. The zone district includes lands previously zoned UFRS35, and the regulalions applirable to such lands remain unchanged. EXHISIT G 7-20-100: HISTORIC PRESERVATION (a) Purpose and Intent The puryose of this Sec. 7-20-100 is to promote the general welfare by providing for the recognRion, proteMion, enhancement, perpetuation antl continued use of histonc sttes, structures, buildings, features antl areas that conUibute to the unique quality of the landscape in Pitkin County far the folbwing reasOns: (1) To encourege public knowledge, understantlin9 and appreciation for the broad historic trends Nat have shaped the couriry's historic antl scenic charecter. (2) To pmvide a meUanism to iden6fy and preserve the distinctive historic antl amhitectural characteristics oi our heritage, which represent [he important elements of the counrys cukural, social, economic, political, and architectural history. (3) To conserve antl vnprove the value of propeRy recognizeQ as significant and encourage their productive, ewnomical and sustainable ieuse. (4} To safeguard the hisror�c architecNrel antl cultural resources that support tourism and the economic welfare of the community. (5j To provide a mecharrism to resolve conFlicts 6etween the preservation o( important historic resources and cul[ural landscapes antl the 9rowing pressures o/ development and altemaGVe land uses. (b) Recognition of Historic Resources - Three-Tiered System The first step for the preservation of the county's signficant historic resources is the identifration of the sites, structures, builtlings antl areas associated with fhe counry's histork development and then a sysiematic public process to determine Meir value to t�e community. This process is intended to provide a means of deciding and communicating which propertes are in the pubiic interest to protect. The three-tiered system for recagnitiart takes into account the relative imporlance of Ne range of histonc resources that exist in the county. The basic level of recognition by the County is listing on an inventory. Listinq on the Pitkin County Historic Invemory has no regulatlon associated with d(with the exception of a demolition pertnit as required on all propertie; in the County), unless the property owner voluntarily agrees to regulation, and there are selectetl incentive programs availsble to inventory properties. (c) Hisroric Invenrory IMormation Information mainfained by Pitkin County as part of ihe Pitkin County Historic Inventory will include, but not be limited to: (i) historic �esource name; (ii) historic property type classi(catioq (iii) address, (iv) documentstwn of significance, (v) photogrephs, (vi) Gountlanes, as applicable, antl (vii) ownership. (2) PITKINCOUNTYHISTORICREGISTER It is recognized that there exist some historic properties that possess a level of historic, architecturel or culturel sign�cance; integrity, visual prominence and/or high value to the community such that they are of greater importance and clearly tllsUnguishable from other histonc resources. The Pitkin County Histonc Register is hereby espblishetl to ensure the protectio� of and encourage the preservation and enhancemeat of these sgnifica�t histo�c resources. (a) Critxla tor Oeslgnatlon to Me Histone Register Properties may be desgnated ro the Historic Register through resolution of the Board of County Commissioners after a One-Step Rewew process, as descnbed in Sec. 230. 30. Properties eligible for designation to the Histonc Register inclutle individual sires, strucNres, buildings, objects and featUres or collections of sites, structures, buildings, objects and features. These historic pmperties must meel the criteria and have the minimum level of documentation for listing on the Pkkin County Historic Inventory. Addi[ionally, to initiate the designation Drocess, a set of findings must be prepared documenting the higher le�el of signficance for the histonc resource(s�. Included in Ne analysis shall be in(ormation about: 1. Importance of the hisroric theme to which the resource is related to the Counry's history. 2. The number of other historic properties that this resource represents and how it is exemplary. 3. The resource's level of integrity of location, setting, desigq materials, workmanship, feeling and associafion. I. The qualRies of singularity such as rerRy, uniqueness, and age. 5. Visual promi�unce, 6. Role in communiTy evenis and celebrations. 7. If the work of a notable architect, builtler or craftsman, how this property compares with the body o�work producetl by the individual or frm. 8. If associated with a noW61e individual, how the pmperty illustretes their wntribution to the county, state or nation. (b) EHect of Designation to the Pitkin County Hlsforic Register From and after the adoption by the Board of Counry Commissioners of a resolution designaling a pmperty to the Pitkln Counry Historic Register, any tlemofdion, relocation, alteration, new wnsUUCtion or any olher development within the boundaries of [he tlesignatetl property is subject to provisions of Nis 5�tion. 1. Pitkin County will prepare tlesign guitlelines �or designated properties to offer assistance to pmpeRy owners and(or their representaUVes in unders�antling the physical characteristics that contribute to the Significance ot the hi5tonc property. The guidelines recognize that changes will occur to historic properties /or their con[inuetl use and functional viabiliry. Their intent is to provitle guidance In the planning of alteretbns and new cons[mc[ion such that the proposed work dces not adversely affect the charecler-dehning feaWres andlor diminish Ne signifcance ot lhe histonc properties. These guideline5 shall apply to exterior features only. The guitleiines shall be organized to inclutle (i) general guidelines that appty ro categories of properry types or historic arch�decNrel styles, antl pi) specific guidelines tailored to adtlress the unique qualities or characteristics of a partiafar site, strucNre, building, complex ot district. Until the design guWelines are adopted by the Board o! County Commissioners, the Secretary of the Inrerior's Standards for Rehabilitation shall be utilized to review altera[ions and new constmction. Y. For designated properties, the provisions and processes o( other County codes, sections and regulation standards may be modified, as described in Nis section, if it can be demonstrated that it will assist to maintain the historic and architectu�al charecter of the propeRy. Modifcations to zoning standards mus[ be approved by the 8oard of Counry Commissioners. 3. Desgnated properties wi11 be eligible and haue prionty to participate in County progrems related to financiai, developmentat, technical and promotional assistance that will serve to maintain, preserve and/or enhance their historic and architectural character. (3J TNE REDSTONE HISTORIC DISTRICT The [hird mechanism usetl hy Pitkin Gounty (or the recognition of sgnificant historic propedies is the Redstone Historic District. (a) The Redstone Hlstoric District was tlesignatetl by tfie County in 1980 by the Board of Counry Commissioners through [he establishment of an Hisloric Preservation (HP) overlay zone. (6J The Redstone Historic Preservation Commission was authorized by the Board of County Commissioners in 1994 to serve as a regulatory body responsible for the review and approval of all repair, alteration or new development within the historic district. The procedures and standards used in the review and approval of such work are set forth in the 200A Vitlage o( Redstone Design Guidelines. b� (eJ Specifc benefits have been developed that are available to property owners wiMin the distric� that will remain in eflect antl are not motlifetl by the adoption o! thi5 section o( this LacW Use CoOe. (c) Requirement for Certificate of No Effect and Certificate of Appropriateness (1) APPLICABIUTY �a) M appGCation for a builtling permit or a development permit for ezterior alterations, relocation or development of a property designated to the Pitkin County Histonc Register, shall be incomplete unless a Certificate of No EHect or a Certificate of Appmpriateness is submitted concurrently. (b) In the event work requiring a Certifrczte of No Effect or a Certificate of Appropriateness is being performed without such an approval, the Counry will conhact the person pedortning the work and require that all work cease. If the work continues, ihe Chief Building Official will issue a Stop Work Order. In the event that work is being perto�med that is not accordance with an approved Certifcate of No Eftect or Certificate ot Appropriafene5s, ihe ChiM Building Official wiVl issue a Stop Work Order. 7he Counry may seek an injunction to enforce a Srop Work Order. (c) The prwisions for Me Issuance of CeAificates ot No EHect or Appropriateness shall not be construetl to prevent ordinary maintena�ce or repair that does not change the design, materials or, architectural elemen4s or site features of a des�gnatetl property. Selected activities ere exempt ffom the review procedure5 includmg interior remodeling, exterior repainting antl paint color selection, and the repair of enterior walls with materials anE finishes to match the existing walls. (2J CERTIFICATE OF NO EFFECT An application for a Certificate of No ERect is subject to Atlministra0ve Review pureuant to Sec. 2-30-20(g)(14). If the Community Development Department detertnines that the proposed vrork is not elgiWe for a Certificate of No Effect, then the property owner must apply for and obtain a Certificate of Appmpriateness. (3J CERTIF/CATEOFAPPROPRIATENESS Art appl+cation for a Certificate ot Appropriateness is subject to Administratrve Review pursuant to Sec. 2-30-20(g)(75). However, it there are any issues about the appropnateness of fhe proposetl vrork, or if the project is of a magnitude that community input is desired, the Communiry Development Director may determine that the application is subject to a One- Step Review process before the Board of County Commissioners, pureuant to Sec. 2-30.30. (d) Avoiding Demolition Histonc properties are irreplaceable assets of a community. �nce demolished they are forever gone and can not be �eplaced. It is the intent of this section to preserve the histonc antl architeaural resources that have a demonstrated sgnificance to Pitkin County, to require reasonable measures to ensure that historic properties are not inadvertently or unnecessarity destroyed, and to require consideration of alternatives to their demolition. (f) DEMOL710NPERMITREqUIRED (aJ No pertnit shall be issued by the Chief Building Official or designee ro demolish a psoperty designated on the Pitkin County Historic Register or Ilsted on the Plticin County Historic Inventory antl for which a growch management ezemption for an additional single Namily tlwelling unit was granted prior to the 5th ot duty, 200fi wiUwut a Certificate of Demolition approval. (6J An application for a Oemoli6on Permi[ shall be subject to Atlministrafive Review pursuant to Sec. 230-20. If the Community Development Department determines t�at a Demolition Certificate cannot be issued based on those critena set fodh in Sec. 2-30- 2DI9)i�6), then the applicant may appeal that decision to the Board of CounTy Commissioners pursuant to Sec. 2-20-180. (2J APPEALS OF DENIAL OF DEMOLITION CERTlFICATE (a) In addition to those actions listed in Sec. 2-20-180, the Boartl of County Commissioners may delay the demol'�ion for a specified period of time or continue Ne applicatlon to obtain additional information necessary to consider the tlemolition request. (b) If a demolRion request Is tlelayed In an attempt to fnd an altemative to demolitioq the County will work: (i) with the property owner(s) to determine what types of assistance might be providetl by the Counry to retain the property andlor place it in produdive use; antl (ii) to investigate methotls of acquisition by a private, non-proffi or public entity that will preserve the property; and (iii) to make the larger community aware of the impending loss of the historic resources. (c) At the end of the specifed period of time for the delay of demolition, a report will be made to the Board of County Commissioners and (i) if no prudent or practicable altemative has been identifetl, lhe tlemolition permit will be issued in conformance with ihe pmcedures established in thls uction, or (li) if subsfannal fnancial, development or technical assistance has been offered by fhe County to the property owner or if an offer for purchase at fair market value of the pmperty is retused by the property owner, the application for demolition may be denied or the tlelay period extended. (d) If the demoliUOn request is denied because it dces meef the aforementionetl criteria, ihe applicant may request a tletermination that such denial constitutes a taking of private property pursuant to Sec. 2-40-150. (3) PROPERTIES FOR WHICX DESIGNATION TO THE PoTNIN COUNTY HISiORIC REGISTER NAS BEEN INITIATED (a) While N is the intent of this Sec. 7-20-100 to preserve historic properties that have been formaly recognized as significant through designation to ihe Historic Register, it is understood that the ider0ifica[ion, evaluation and tlesgna[ion of atl sites, sttuctures, buildings, objecls and disMCts wiNin the county ot importance to the general weHaie, economic prospenry and civic pride of the community is a� on�oing process.
