The policies of the Open Space and Trails Board allow investment in acquisitions outside Pitkin County �y�,,�/ where such will clearly complement our County system. The funds needed to complete the projed were previously earmarked and budgeted and this ordinance would redirect an expenditure. In 2004, The Aspen Valley Land Trust (AVLT) acquired the 42 acre Roush Property that is contiguous to ihe County's existing North Star interests. Pitkin County invested Open Space and Trails funds to purchase a conservation easement on ihe Roush property, appraised at $1,840,000, for $500,000, which bargain sale enabled AVLT to sponsor further conservation efforts that are of importance to Pitkin County. 6. BOCC Ordinance 042-2004 specified in paragraph 7 that $250,000 of AVLT's proceeds from the sale ot the Roush Conservation Easement would be allocated [o the purchase of a conservation easement on the John Nieslanik Ranch, located in Garfield County on the East Mesa, an agricultural land mass that continues into Pitkin County. That acquisition was completed in 2005. The remaining $250,000 was to be invested in further conservation on the East Mesa or in Piikin County. No further conservation acquisition opportunity has developed for the East Mesa. These tunds remain in the Open Space and Trails budget until AVLT identifies a project for this allocation. 7. On January 28, 2008, Pitkin County, and its partners Aspen Valley Land Trust (AVLT) and Town of Carbondale, were awarded a Great Outdoors Colorado (GOCO) legacy grant of $5 million to complete six projects in the Crystal River Watershed. These projects included the construdion of Phase I of the Crystal Trail and 5 conservation acquisitions by Pitkin County or its partners, including the County's purchase oT a the Powerhouse Parcel and Jensen Parcel and a conservation easement Cold Mountain Ranch, all in Pitkin County, and conservation easement on the Darien Ranch in Gunnison County by AVLT. 8. The GOCO grant application anticipates a significant applicant match in ihe purchase of a conservation easement on the Darien Ranch, which is located along Gunnison County Road 3, south ot the Pitkin County line and north of Marble. The 180-acre Ranch was the home ot the former Ute Meadows nordic ski area, and is traversed by the headwaters ot the Crystal River. Preservation of this scenic ranch will benefit residents of Pitkin County by protecting wildlife habitat, stream health and scenic quality, and avoiding sprawl in the upper Crystal Valley, and by leveraging state funds for several projects in and adjacent to Pitkin County. 9. The Pitkin County Open Space and Trails Board recommends that Paragraph 7 of Ordinance 042-2004 be amended to allocate ihe remaining $250,000 in AVLT proceeds from the purchase of Roush conservation easement to the acquisition of a conservation easement on the Darien Ranch, in partnership with AVLT, in order to secure funds from GOCO. � NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners of Pitkin Count Colorado, that: 1. The Board approves the recommended amendment for Ordinance 042-2004, reallocating $250,OOO.t purchase of a 95-acre conservation easement on the Darien Ranch. 2. Upon approval of the torm by the Open Space Director and County Attorney, the Chair is authorized t execute a contract for purchase ot a conservation easement on approximately 95 acres of the Darien Ranch. The Chair is further authorized to execute such other documents as may be necessary to finalize this iransaction, including the deed of conservation easement and any documents needed to secure grant assistance from Great Outdoors Colorado.
