Vos Caudill, Pitkin County, CO ORDINANCE OF THE BOARI) OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, AMENDING ORDINANCE NO. 001-2001 TO REZONE PROP�RTIES IN THE NORTH FORK OF THE UPPER FRYINGPAN VALLEY TO RS-35 Ordinance No.�ld -2012 RECITALS 1. The Community Development Department ("Applicant") has initiated an amendment to Ordinance No. 001-2001 to rezone private lands in the North Fork ofthe Upper Fryingpan Valley to RS-35. 2. The private lands are lacated along and adjacent ta North Fork Road in the Upper Fryingpan Valley, and are depicted on E�ibit A. � 3. Ordinance No. 001-2001 created the Upper Fryingpan Valley RS-35 Zone District (UFRS-35) and rezoned "Parcel #2473-231-00-040, the Klan Nichols Trust in the North Fork of the Upper Fryingpan Valley within Pitkin County from AFR-10 to IJFRS-35." However, the map attached to the Ordinance that depicts the area subject to the rezoning includes other private parcels in the North Fork. � 4. Staff's research has shown that the map correctly reflects the intent of the Upper Frying Pan ! Valley Master Plan to rezone all of the private lands in the North Fork, and is proposing to amend ;,' Ordinance No. 001-2001 accordingly such that all of the private lands would be zoned RS-35 (the 2006 i'; Land Use Code changed the UFRS-35 zone district to RS-35}, ; 5. The parcel is zoned RS-30/PUD and contains 344.143 acres. 6. The Pitkin County Planning and Zoning Commission considered the proposed rezoning at a regularly scheduled meeting on February 14, 2012, and certified approval to the Board of County Commissioners by a vote of 4-0. 7. The BOCC considered the proposed rezoning on first reading at a duly noticed public hearing on March 28, 2012, and on second reading on April 1 I, 2012. 8. The BOCC fnds that the proposed rezoning is consistent with the Upper Frying Pan Valley Master Plan, which recommended the rezoning of the North Fork to reduce the allowable density and ta preserve open space, including wetlands, wildlife corridors and meadaws. 9. The BOCC further finds that the proposed rezoning is consistent with the policies and � regulations of the Pitkin County Land Use Code, and advances the public health, safety and welfare. 10. The BOCC further finds that the rezoning complies with Secs. 2-20-100 (Public Notice Requirements} and 2-40-10(e) (County Initiated Rezonings) of the Pitkin County Land Use Code. 11. The BOCC further fmds that the rezoning clarifies and corrects the intent of Ordinance No. 001- 2001 to rezone all private lands in the North Fork, and not just the Klan Nichols Trust parcel, ta RS-35.
