Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO, APPROVING THE PT RANCH HOUSE LLC MINOR AMENDMENT TO SITE PLAN Administrative Decision No3l-2012 RECITALS Pursuant to Section 2- 20- 150(b) of the Land Use Code, PT Ranch House LLC ( "Applicant ") has applied to the Community Development Director of Pitkin County, Colorado ( "Director ") to amend the Site Plan approved pursuant to Hearing Officer Determination No. 13 -2008 to change the grading and landscaping along the northern property line. The proposed grading and landscaping will occur within the previously approved Activity Envelope B. The Applicant may build a house in the future within the Activity Envelope, but in the short term proposes to install a lawn sculpture and landscape around the sculpture. 2. The parcel is located at 1900 Castle Creek Road, and more specifically described in Exhibit A. 3. The parcel contains 2.95 acres and is a nonconforming size parcel in the AR -10 zone district. 4. The Hearing Officer approved the PT Ranch House LLC/PT Barn LLC Activity Envelope and Site Plan Review, Special Review and GMQS Exemption for a TDR Receiver Site and Caretaker Dwelling Unit, Lot Line Adjustment, Minor Plat Amendment and PUD Variance Amendment, pursuant to Determination No. 13 -2008. The Site Plan for the PT Ranch House LLC parcel is recorded in Plat Book 91 at Pages 44 -49. 5. The Director finds that the proposed amendment complies with the applicable provisions of the Land Use Code, and will not change the use of the proposed development or the basic character of the land, is consistent with action taken during the original review, does not increase off -site impacts or the allowable floor area, and will not endanger the public health, safety or welfare. 6. The Director further finds that the proposed tree plantings are similar in nature to those shown on the original Site Plan, with the primary change being the additional grading to create a landform along the driveway to create an open "bowl" where the sculpture will be placed. The landscaping will substantially screen the sculpture from adjacent properties and the adjacent driveway. THE DIRECTOR DOES HEREBY APPROVE the PT Ranch House LLC Minor Amendment for grading and landscaping, subject to the following conditions, which shall run with the land and be binding on all successors in interest: All conditions of Hearing Officer Determination No. 13 -2008 shall remain in full force and effect, except as amended herein. 2. Galena Street Aspen, CO. 81611 RE: Minor Amendment to a Development Permit for the PT Ranch House LLC Property at 1900 Castle Creek Road (PID# 2737 - 231 -03 -016) Dear Suzanne: Davis Horn Incorporated represents PT Ranch House LLC, the owner of a 2.95 acre property approximately four miles from downtown Aspen on Castle Creek Road and the applicant in this request. A vicinity map with the property's location is shown in Attachment 1. The applicant is proposing to amend the approved Site Plan for the property to change the grading and landscaping along the northern property line. There is an approved Activity Envelope where the grading and landscaping changes are proposed. In the short term, the applicant does not intend to build a house in this Activity Envelope, but wishes to have a lawn sculpture with a private viewing area surrounding. The enhanced landscaping and grading will create privacy and a meditative atmosphere surrounding the sculpture. The Activity Envelope will remain for a future home, but there are no short term plans for building the home. This land use application is addressed under the following headings: Background /Previo.us- Approvals, Proposal, Land Use Requests and Summary. BACKGROUND/ PREVIOUS APPROVALS The Activity Envelope and Site Plan for the subject PT Ranch House parcel is found in Attachment 2 to this application. The subject PT Ranch House parcel adjoins the Castle Creek Banks Partnership Lot Split PUD /Subdivision Lot 2 (CCBP Lot 2) and the two properties were planned together. Since the PT Ranch House parcel is not in the same subdivision as CCBP Lot 2, separate site plans were recorded for each. The parcel and lot are independent of each other and may be separately developed and separately conveyed. Sheets 3 and 5 of the recorded PT Ranch House LLC Parcel Activity Envelope and Site Plan (Attachment 2) depict the parcel and lot together to show the combined development plan. The CCBP Lot Split PUD /Subdivision Lot 2 Activity Envelope Site Plan is found in Attachment 3. The Determination is found in Attachment 4 and the approved Site Plan for the PT Ranch House LLC Parcel, recorded in June, 2009 in Book 91, at Pages 44 to 49, is found in Attachment 2. Hearing Officer Determination 13 -2008 (see Attachment 4) approved two new single family residences and a Caretaker Dwelling Unit (CDU) on the two properties, replacing the three previously existing residences. The Determination approved a new single family residence on what is now referred to as the PT Barn Lot (CCBP Lot 2) and a new CDU and an established Activity Envelope for a future free market residence on the subject PT Ranch House Parcel. The new residence on CCBP Lot 2 and the small residence on the PT Ranch House parcel are now under construction. At some point in the future, when the primary free market residence is developed on the PT Ranch House Property, it will be within Activity Envelope B and the small single family residence (now under construction) will become the approved CDU. PROPOSAL The applicant is proposing a Minor Amendment to a Development Permit in order to make changes to the approved landscaping and grading plans within the approved Activity Envelope B on the PT Ranch House parcel. The applicant does not intend to build the approved residence in Activity Envelope B in the near future, but they do wish to have a lawn sculpture in the middle of Activity Envelope B, with a private, landscaped viewing area surrounding the sculpture. The enhanced landscaping and grading will create privacy and a meditative atmosphere surrounding the sculpture. The Activity Envelope will remain for a future home, but there are no short term plans for building the home. Please refer to Attachment 5 which shows the landscape and grading plans with the minor amendments reflected. There will be more trees within Activity Envelope B and the grading plans create a small berm -like feature on the northern boundary between the lawn sculpture and the access drive which will enhance privacy and create a more meditative atmosphere surrounding the sculpture. LAND USE REQUESTS A pre - application conference summary is found in Attachment 6. As required in the summary, the following section of the Pitkin County Land Use Code will be addressed. Section 2- 120 -150 Minor Amendment to a Development Permit; A minor amendment to a development permit application must meet the following criteria found in Section 2- 120- 150(b) of the Code, as determined by the Community Development Director. The Land Use Code language is given in bold and the Applicant's response follows. -2- uJ0002 1) Consistent with actions taken during previous development approvals for the property; and 2) Does not change the use of the proposed development between residential, commercial and tourist accommodations uses; and 3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and 4) Does not constitute a new land development activity; and 5) Does not increase off -site impacts in the surrounding neighborhood; and 6) Does not endanger the public health, safety or welfare; and 7) Does not violate any Land Use Code standards; and 8) Does not substantially increase the need for on -site parking or utilities, or affect affordable housing generation; and 9) Does not increase the floor area of the use by more than five percent or decrease the open space on the site by more than five percent. The proposed amendment to modify the landscape and grading plans meets the above criteria for a Minor Amendment to a Development Permit. The landscaping and grading will be consistent with the original approvals, the residential use is not changed, the basic character is the same, there is no new development activity, it does not endanger the public in any way, nor does it violate the Land Use Code Standards, increase parking, utility or affordable housing impacts, increase floor area or decrease open space. More trees and different grading to accomplish more privacy and enhance the overall outdoor atmosphere surrounding the new outdoor art sculpture will contribute to a more desirable, rural atmosphere in the near future, in the years prior to the development of the approved residence within Activity Envelope B. The request meets this section of the Land Use Code. The proposed amendment will not negatively impact the adjacent property owner to the north or any other adjacent or nearby property owner. A letter from Mike Kaplan, the adjacent property owner to the north, indicates his support for the proposed Minor Amendment to a Development Permit. Kaplan's letter is found in Attachment 7 to this application. SUMMARY The Applicant owns a 2.95 acre property located at 1900 Castle Creek Road. The property was planned along with the adjacent Castle Creek Bank Partnership Lot 2 property to the south. The subject property is approved for a free market house and a CDU. A small new house is currently under construction and will serve as the free market house until such time in the future when the primary free market residence will be built within the approved Activity Envelope B. At that time, the small residence now under construction will convert to a CDU. The proposed Minor Amendment to a Development Permit is to allow changes to the approved landscaping and grading plans for the site, particularly along the northern boundary within Activity Envelop B. The landscaping and grading are to accommodate a lawn sculpture to be located in the center of -3- ®00 J the Activity Envelope and will enhance privacy around the art and will create a desirable area for viewing and enjoying the sculpture. The request meets the criteria for a Minor Amendment to a Development Permit. The property will still be subject to Housing Officer Determination No. 13 -2008. NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Community Development Hearing Officer that he does hereby approve the PT Ranch House LLC /PT Barn LLC Activity Envelope and Site Plan Review, Special Review and GMQS Exemption for TDR Receiver Site and Caretaker Dwelling Unit, Lot Line Adjustment, Minor Plat Amendment and PUD Variance Amendment, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1) The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2) The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Determination. The exterior of the residence shall utilize indigenous earth tone materials or colors and the roofs shall have a non - reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 3) Prior to submission of any building permit applications for the new residence, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. B) Complete a fireplaceAvoodstove registration form with the Community Development Department, if necessary, C) Submit a drainage and erosion control plan for review and approval by the Planning Engineer. If site disturbance exceeds one (1) acre, the.Applicant shall obtain a stormwater permit from the State of Colorado. D) Obtain a County access/driveway permit acceptable to the Aspen Fire Protection District and Planning Engineer for the extension of the driveway. Where utilities are to be extended within the driveway, utility line locations shall be showp on the drawings. E) Submit a construction management plan for review and approval by the Planning Engineer. Pay the applicable road and employee housing impact fees. F) Obtain a permit from Environmental Health and Natural Resources for the new on -site wastewater disposal system. The existing systems shall be properly abandoned. G) Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. The plan shall specify the native seed mix to be used, the rate at which it will be applied and the method of cover. H) Submit a landscaping, revegetation and tree removal/mitigation plan. All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. 5. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. 8. The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 10. All deadfall up to a one hundred (I00) foot perimeter shall be removed. 11. No new conifer trees shall be planted within ten (10) feet of a residence. 12. No flammable mulches shall be placed within two (2) feet of a residence. 13. The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B) Roofing: Class A covering or Class A Assembly as defined by the currently adopted Building Code. No wood shakes or shingles. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1. All roof coverings shall be constructed of non - combustible materials and installed on a Class A roof assembly. 2. All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3. Protrusions above the roofline, such as parapets, shall be prohibited. 4. Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5. All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. . C) Water Supply for Fire Safety 1.
