HomeMy WebLinkAboutBOCC Packet 06272012 Consumer Protection ServicesAGENDA ITEM SUMMARY REGULAR MEETING DATE: June 27, 2012 AGENDA ITEM TITLE: RESOLUTION AUTHORIZING PITKIN COUNTY TO PERFORM CONSUMER PROTECTION SERVICES ON BEHALF OF THE COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT STAFF RESPONSIBLE: Cindy Houben, Community Development Director ISSUE STATEMENT: The Board is asked to approve continuation of the County's Consumer Protection Program for a one year period under an Intergovernmental Contract issued pursuant to Pitkin County's Master Contract with the Colorado Department of Public Health and Environment (CDPHE). Copies of Intergovernmental Contract, Routing Number 13FFA44792, are on file in the Clerk and Recorder's Office. BACKGROUND: Since the late 1960's, the office of Environmental Health and Sustainability, formerly Consumer Protection Division, of the CDPHE has contracted with Pitkin County to perform consumer protection services which include the inspection of restaurants, schools, childcare facilities, and summer camps. Managing this program at a local level has proven to be very effective in efforts to maintain working relationships with the regulated community and to protect public health. LINK TO STRATEGIC PLAN: Livable and Supportive Community KEY DISCUSSION ITEMS: Currently, two (2) Environmental Health staff perform the County's obligations under the program, with approximately 0.5 FTE allocated to this program. The scope of work for fiscal year 2013 includes approximately 183 inspections. The scope of work is consistent with previous years. The Town of Snowmass Village and the Town of Basalt pay the County $8300 and $5000, respectively, for the County's performance of the Consumer Protection Program within their jurisdictions. These payments are in addition to the amount received from CDPHE (performance of 90% of the scope of work results in a payment of $12,478.48 to the County) and licensing fees. BUDGETARY IMPACT: The Consumer Protection Program makes up 59 % of the Environmental Health revenue budget. RECOMMENDED BOCC ACTION: Approve the Resolution accepting Approved Intergovernmental Contract, Routing Number 13FFA44792, to perform consumer protection . services. RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO AUTHORIZING PITKIN COUNTY TO PERFORM CONSUMER PROTECTION SERVICES ON BEHALF OF THE COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT RESOLUTION NO. -2012 Whereas, Pitkin County and the State of Colorado, acting through the Department of Public Health and Environment, are duly constituted governmental entities; and Whereas, Pitkin County, acting through its Environmental Health Department, desired to continue to provide services described in Intergovernmental Contract Routing Number 13FFA44792, including, but not limited to inspections of retail food establishments, schools, child care centers and summer camps; inspection of mobile home parks, campgrounds, motels or hotels after a complaint is received; and timely response to environmental health emergencies, and to perform these services from July 1, 2012 through June 30, 2013; and Whereas, the State desires to pay a sum not to exceed $12,487.48 for such service, provided that such services are performed in a satisfactory and timely manner; and Whereas, the Pitkin County Board of County Commissioners and the Colorado Department of Public Health and Environment are authorized to execute the Intergovernmental Agreement on behalf of the respective parties; and Whereas, both parties have determined that it is in the best interests of the citizens of Pitkin County that they enter in to the Intergovernmental Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that it does hereby authorize the Chair to execute the attached Intergovernmental Agreement.
