THIS AGREEMENT, made this ~ day of t~ a,~;~q, , 19 by and between Raymond Auger (hereinafter referred to as Aug r), and Arsula DePugh Reedy (hereinafter referred to_as Reedy); I Recitals - 1.1 Real Property: Reedy is the owner of the real property more specifically described in Exhibit "A". 1.2 Agreement to Supply Water: Auger, in an agreement recorded in Book 251, at Page 104, agreed to provide and maintain Reedy's oredecessor in title, one Andrea Schwaighofer, with a potable water system for the sum of $2,000.00, which system was to be completed by September 17, 1971. As of the execution of this document, this has not been completed as agreed to by Auger. 1.3 Interest in Real Property: Auger claims some rights, title and interest in the above-described property by an unrecorded easement agreement made with Andrea Schwaighofer, attached hereto as Exhibit."B". 1.4 Consideration: The consideration for this agreement is the mutual benefit each party is to derive from the provisions herein. II Basic Agreement 2.1 Completion of Water System: Auger agrees to complete the installation of a water well system in a workmanlike manner so that it is capable of servicing a residence to be constructed on the real property described in Exhibit "A", this system consisting of and limited to a storage tank, float switch and pump with built-in pressure switch of a quality at least equivalent to the followino: 250 Gallon Galvanized Storage Tank Grainger float Switch Cat. No. 4 x 173 Sears Pump, Cat. No. 421425016 Auger shall provide at his cost the labor and materials needed to connect and make operable the elements of this system and to connect this system to the well in place at the time of this agreement, and to the electrical system of the residence. .. ~ .~:_ „~- _. _ i.. ~~. ;~ 2.2 Limitations of the S stem: Auger is not responsible for any excavation work, pipes or plumbing for the connection of the well to the residence unless the residence is built directly above the well. Auger agrees to complete the system described in Paragraph 2.1 within thirty (30) days of installation of an electrical panel in the residence. 2.3 Warranties as to the S stem: Auger warrants that the system provided for in Paragraph 2.1 will be built in a workmanlike manner. Reedy agrees and understands that Auger makes no guarantee as to the flow rate, water table and other characteristics or components of the well, including the well pump. 2.4 Payment to quaer: Upon completion of the system provided for in Paragraph 2.1 to Reedy's satisfaction, Reedy shall pay Auger the sum of $100.00. 2.5 Quit Creed: Auger, for the consideration mention in Paragraph 1.4 and 2.3 above, agrees to execute a Quit Claim Deed, a copy of which is attached as Exhibit "C", conveying any right, title and interest he might have in the real property described above arising out of Exhibit "B" or any other document. 2.6 Waiver of Claims:. Upon completion of the system mentioned above, Reedy agrees that the agreement recorded in Book 251, at Page 104, shall be null and void as regards to Auger's duty to provide a potable water system for the real property. And further, Reedy shall waive any right or claim he might be entitled to pursuant to such agreement. III Miscellaneous 3.1 Disclaimer of Representations: Reedy acknowledges that Auger, by execution of this agreement, makes or intends no explicit or interest of representations or insurances regarding her ability to obtain a building permit for the above- .described property or the suitability of the same for construction of a single- family residence. 3.2 Bindin_ g ~{{ect: This agreement reflects the entire agreement of the parties and all prior agreements that the parties have merged herein.
