16, White Horse Springs; Subdivision Exemption for Lot �
Line Changes; Exemption from Fuli 7041 Review

WHEREAS, the Board considered the special review application of
Mr. Sutherland Dows at a public hearing on January 3, 1978, which ;;
application was for the separation of substandard-sized lots, Lots 14,
14a, 16, and T6a in the RS-20 zone distr9ct in White Horse Springs,
and
WHEREAS, the application is tied to a subdivision exemption
request to consolidate Lots 14 and 14a as well as Lots 16 and 16a
and change the boundary line between the newly configured Lots 14 and
16, and �

- ; WHEREAS, the application further requests exemption from the + -
� fuli 7041 review procedure under Section 5.40.06 on the grounds that
;
� an a]7uvial fan hazard as shown on the CSU maps is not present on i-ts
i
` site, and
�; WHEREAS, the Planning and Zoning Commission recommended approval
� at their November 16th meeting subject to the Board's approval of the
lot consolidation and to a restriction against further density and single
road access to the two iots, and
WNEREAS, the Board finds that the improvements already exist
a' and there will be no increase in density, that access and utilities are
; properly located on the lots, that the new lots 14 and 16 will be more
;j conforming with respect to size after the exemption is approved, and
;
` ;! that the alluvial fan hazard is not present on this site.
NOW TNEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS �

that specia7 review approval be and hereby is granted for the separation
' of Lots 14 and 76 in White Horse Springs subject to: �
� �i
�; 1. A restriction against any further development beyond �
t; .
the existing two single family dwellings.
Z. The access to the county road remaining as a single access t;
for Lots 14 and 16, the easement for which shall be ;i
�
recorded on the exemption plat. °

AND BE IT FURTHER RESOLVED THAT the subdivision exemption
request for deletion of the lot lines between Lots 14 and 14a and �
;
between Lots 16 and 16a and between Lots 14a and 16a and for the
revision of the boundary line between newly created Lots 14 and 16
be and hereby is approved as shown on the plat attached hereto and
incorporated herein as Exhibit A* Before recording the exemption
plat shall be submitted to the County Attorney for review and approval.
AND BE IT FURTHER RESOLVED that inasmuch as the alluvial fan + '
hazard is not present on the property, the application be and hereby �

is exempted from the full 1041 review procedures pursuant to 5.40.06. � ���
EFFECTIVE this 27th day of December, 1977.
