RESOLUTION N0. 78 �
RE: Lewitz 1041 Exemption Application
WHEREAS, application has been made for exemption from the full
1041 Special Review Procedures, and authority for such request exists
under Section 5.40.06b. of the Pitkin County Land Use Code, and
; WHEREAS, this application pertains specifically to the need �
; for mitigation of a geolo9ic hazard on a building site owned by Mr.
i Cecil Lewitz in the area of Smuggler Mountain, and
; WHEREAS, detailed investigations as to proper building design
have been conducted by Mr. Nick Lampiris�a consulting geologist, and
his recomnendations have been made available to Pitkin County and the
applicant, and
.� WHEREAS, it is the opinion of both Mr. Lampiris and the Colorado
� Geological Survey that any problems present on the site could be
mitigated by proper engineering foundation design, and .
� WHEREAS, this Board considered extensive presentation and site
� characteristics from the applicant's attorney and consulting geologist
. � on January 9, and January 13, 1978.
� NOW THEREFORE BE IT RESOLIIED that the Lewitz building site, which
;
is part of the Cora Lee Mineral Survey No. 5304, as amended, be exempted
� from the full Special Review Procedures under the authority of Section
}
5.40.06b. of the Pitkin County Land Use Code subject to the following
conditions: �
1. Walls of the side of the home facing the source of mudflows
be designed to resist forces of several hundred pounds per
square foot.
• 2. The berm be constructed so as to deflect mudflows south- �
ward away from the house. �

: 3. To withstand any downsiope movement, the foundation be �
designed as a unit to accept potential movement of one (1) $
centimeter per year without significant failure. '

4. That any water well be placed low on the property, and � .
` that solid waste disposal be located below the house �
�
site and finally approved 6y the County Sanitarian.

; 5. No outside irrigation be allowed. ;

} 6. P�sitive drainage be provided away from'the structure �
� to prevent any ponding of water, particularly on the
up-hill side of the structure.

7. That utilities be constructed in a way so as not to - �
rupture. i `

AND FURTHER BE IT RESOLVED that adequate designs be presented I
to meet the requirements of the above seven (7) points to the Pitkin !
County 8uilding Inspector prior to the issuance of building permit for i
