RESOLUTION OF TIiE BOARD OF COUNTY COMMISSIONERS OF PTTKIN . . � . . �`:r. r:;: COUNTY, COLORADO, ADOPTTNG STANDARDS FOR EMERGENCY MEDICAL �': �x �� SERVICES PROVIDED IN SAID PTTKIN COUNTY, COLpRADO �';: �� Resolution Np. 78-� � �( WfiEREAS, the General Assembly, at the First Regular F'� `�i Session of the Fifty-£irst General Assembly, enacted the '�,��,'- x� Colorado Emergency Medical Services Act, being Sections �" 25-3.5-101 throu h 25-3.5-506, C.R.S. 1973, and �. 9 WHEREAS, the legislative directive contained in said � Act is that the Boards of County Commissioners of each Colorado County shall adopt standards, requirements and procedures for the provision of emergency medical services within each county which shall best meet local needs, NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners.:•of Pitkin County, Colorado, that the following emergency med�cal service standards, requirements and t procedures are hereby adopted for Pitkin County, Colorado: �� 1. Beginning on January 1, 1978 (or the effective �� date of this resolution, whichever is later), no person =� , 1 shall provide public or private ambulance services within Pitkin County unless that person holds a valid license % I- i 3 to do so issued by: {a) The Board of County Commissioners of Pitkin County for any ambulance service based in Pitkin County; or (b) The Board of County Commissioners of the "; ''� county in which such ambulance service �.'� ,� is hased, if other than Pitkin County. 2. T. � � � authority to do so by making application to the Board of � County Commissioners, who shall approve the operation of the ambulanr.e service upon its being satisfied that the service � � meets the following requirements: � (a) Each ambulaace snall have passed the state motor vehicle inspection within the past year; . (b) Each ambulance shall contain equipment which meets or is equivalent to the minimum require- ments set forth in the latest edition of the American College of 5urgeons Comm�ittee on Trawna publication "Essential Equipment for Ambulances"; (c) Each ambulance is covered by a complying policy as defined in Section 10-4-703, C,R,S, 1973� (d) Each ambulance will be manned by two or more individuals, including the driver, : - authorized to operate the ambulanae (except • under unusual circumstances when only one authorized person is available); • (e} Each ambulance driver will possess a valid Colorado driver's license and a current American Red Cross advanced card; � And such additional requirements as sha11, from time to time, be established by the Board of County Commissioners. 3. The Board of County Commissioners shall issue a ' license to the applicant to provide ambulance service and a permit for each ambulance used (both of which license and permits shall be valid for twelve (12) months from the ��,y date of issuance) upon a findinq that the applicant's sta£f, ;'� vehicle and equipment comply with the foregoing requirements. r:'� . Any license or permit, unless revoked by the Board of County Commissioners, may be renewed by the Board on filing of an � application as in the case of an original application for � i `e i ��;. . 'a . , — �'l }'< �' � � �! � such license and permit, Ap�lications £or renewal shall be filed annually but not less than thirty (301 days before the date the license or permit expires. No license or permit , issued pursuant to this regulation shall be sold, assigned or otherwise transferred. 4. The Board of County Commissioners may gzant a cpnditional license to an ambulance service if such service is not, at the time of initial application, in compliance with the requirements of this regulation. The conditional license sha11 be valid for not less than thirty, nor more than ninety,_days and granted for the purpose of permittiag the applicant an opportunity to bzing the service, staff or vehicles into compliance. No conditional license shall be issued to an ambulance service beginning operation after January 1, 1978. Such conditional license shall require - the applicant to provide the Board of Covnty Comanissioners, with�in thirty (30) days o£ issuance{ with either a written plan of action for, or evidence of, compliance with this - regulation. 5. The provisions of this regulation shall not apply to any of the following; (a) The exceptional emergency use of a privately or publically owned vehicle, including search and rescue unit vehicles, or aircraft not ordinarily used in the formal act of transporting patients (provided that nothing herein shall be construed to exempt appli- cation of this regulation to those ambulances servicing mining operations located in Pitkin County). (b) A vehicle renderinq services as an ambulance in case of a major catastrophe or emergency when ambulances with permits based in the "r_ � e ! ! � ;�S i't: .;�;qx`-�,'. :��, r,..<.; ,�� E - t�p,^*�,�� ,ty�` _ _ ,�I, �} � h' � } � � � � ,. � :E � � area of the catastrophe or emergency are � insufficient to render the services required, � (c) Ambulances based outside this state which � are transporting a patient in Colorado. (d) Vehicles used or designed for the scheduled transportation of convalescent patients, handicapped individuals� or persons who � . � 4 would not be expected to require skilled :F i treatment or care while in the vehic2e. �. (e) Vehicles used solely for the transportation of intoxicated persons or persons incapa- oitated.by alcohol as defined in 5ection 25-1-302, C.R,S, 1973, but who are not other- wise disabled or seriously in�ured and who would not be expected to zequire skilled treatment or care while in the vehicle. 6. Upon a determination by the Board of County Commissioners that any person has violated or failed to comply with any provisions of this requlation, the Board may temporarily suspend, for a period not to exceed thirty (30) days, any license or permit issued pursuant to this resolution. The licensee shall receive written notice of such temporary suspension, and a hearinq shall be he18 no later than ten (10) ' days after such temporary suspension. After such hearing, the Board may suspend any license or permit issued pursuant to this resolution for any portion of or for the remainder of its life. At the end of such period, the person whose license or permit was suspended may apply for a new license or permit as in the case of an original application. Upon - a second violation or failure to comply with any provision of this regulation by any licensee, the Board of County Commissioners may permanently revoke such license or permit. � � 3� � �l � t %�.�._k ., -'�' � �'��`� �`�" _ ��*.Y; i': ��. 7. There is hereby eatablished an Ambulance Advisory Board to consist o£ five (5) nersons to be appointed by g the Board of County Commissioners to sit at will. Three members of the Advisory Board shall be nominated by the President o£ the Mediaal Staff of Aspen Valley Hospital and the remaining two members shall be member.s of the Public Safety Councii, who are not also members of the medical profession (including doctors, nurses, paramedics, EMTS, etc.). The Advisory Board shall; (a) Recommend desirable changes to this regulation _ including (but not limited to): � (1) those designed to reflect the unique characteristics and needs of Pitkin County residents (including both rural i and tourist aeeds); and (Z) those designed to reduce or eliminate ' , inconsistencies with or duplication of existing state and federal regulations applicable to ambulance services. (b) Advise the Board of County Commissioners in its appZication and enforcement of this Regulation when expert medical advice is necessary for an informed action by the Soard � of County Commissioners, 8.
