RESOLUTION OF THE BOARD OF COMMISSIONERS
OF THE PITKIN COUNTY HOIISING AUTHORITY
DECLARING THE NEED TO CONDEMN CERTAIN
PROPERTIES OWNED BY WILLIAM DOUGLAS STALEY
Resolution No. 78- pw -
WHEREAS, the Pitkin County Housing Authority, organized
pursuant to the provisions o£ Section 29-4-501 et seq., C.R.S.
1973, has initiated the devel.opment of a 37 unit condominium
project called the Midland Park Subdivision within Pitkin
County, Colorado, and
WHEREAS, the completion of the development will require
the installation of subsurface utilities on adjacent land
being a part of the Riverside Placer, U.S.M.S. 3905 Am., and
owned by William Douglas Staley, and
WHEREAS, previous negotiations for acquisition with the
owner have proved unsuccessful making acquisition.of the required
i easements by exercise of the power of eminent domain necessary,
� ; and

WAEREAS, Section 29-4-505, C.R.S. 1973, permits the Authority
to exercise all powers given to city housing authorities which
include (by reference) the power to acquire by condemnation �
any real property necessary to carry out the purposes of the �
�
�
Authority, and '�
WHEREAS, such statutory authority to condemn, however, is �
�
condition upon the Authority`s declaring, by resolution, that �
�
acquisition by condemnation is necessary to carry out the �

purposes of the Authority, and �
WHEREAS, the Authoritg wishes to make such declaration `:�
�
for the purpose of permitting the initiation of condemnation >

proceeding on its behalf, ;

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners �
