' y; ��, . t� �' ,�F�° RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, j REQUESTING THE DISTRICT ATTORNEY TO '' REPRESENT COUNTY OFFICERS (EXCEPT THE BOARDj '� IN TFIE DEFENSE OF ANY CIVIL SUIT OR CIVIL :s - ;� PROCEEDING BROUGHT AGAINST SUCH OFFICERS 1 �� Resolution No. 78- �`p +a WHEREAS, the Colorado statutes provide (in part), with "� �� respect to the obligations of the District Attorney's o£fice � to County officials, that (C.R.S. 1973, Section 20-1-105) �� Opinions to countV officers -. re resentation. (1) The � district attorney, upon request of any county officer .� of any county within his district, without fee, shall give his opinion in writing upon all questions of law E� having reference to the duties of such officer which �� may be submitted and shall file and preserve in his �� office a co of all such o �� PY pinions. � (2) The district attorney, upon request in the form ��� of a resolution by the board of county commissioners �� of any county within his district, shall represent any r� . county officer enumerated in article 10 of title 30, �`' C.R.S. 1973, or the employees of any such officer in the �'� defense of any civil suit or civil proceeding brought i� against such officer in any court of this state or any 4 federal court if such action directly relates to the �� duties of the county officer, and ,* :� V7HEREAS, it has been the custom of the District Attorney �� ;� to represent the County's elected officials (except the Board ;<; '� of County Commissioners) but there is no written resolution �; to this effect as called for in C.R.S. 1973, Section 20-i-105(2) •� , (Y (and the District Attorney has requested such resolution so as �; to eliminate any question as to his authority to so act), NOW, THEREFORE, BE IT RESOLVED by the Board of County � ::3 Commissioners of Pitkin County, Colorado, that the District , Attorney's office is hereby formally requested to represent the Pitkin County Clerk, Coroner, Sheriff, Assessor and Treasurer (and their employees) in the defense of any civil suit or proceedings brought against such officer in any court in this state (or any federal court) if such action directly relates to the duties of such County officer. 4� �h �`r Y<; :.�`�...--..r�:,:� �a: � - �N{ _ _� -� ' ',; ., , , , .; .. .. .,. :-, - .. . , ;__, ,,:.._.: ;� � : � : ,: � . � BE IT FURTHER RESOLVED that the obligation to represent � the County Treasurer shall end on July l, 1978, the date on which her office is abolished pursuant to the provisions of the Pitkin County Home Ruie Charter.
