RE: MUSIC ASSOCIATION OF ASPEN 1
SUBDIVISION EXEMPTION `
�WHEREAS, the Music Asso�iates of Aspen have made application for I
_ � subdivision exemption for a boundary line adjustment pursuan�� to Section �
j
4.02.02.a2 of the Code for the purpose of purchasing a 5.442 acre tract of �
land from an adjacent property owner, Spar Consolidated Mining and Develop-
ment Company, which land would be consoldiated with Lot 1 MAA Fili.ng No. 1
(which subdivision is recorded at Plat Book 4, Page 466) located on Castle
Creek Road, and
WHEREAS, the boundary adjustment will not result in the creation
of any non-conforming lots or any more than the original number of parcels,
and
WHEREAS, the Board of Gounty Commissioners considered the request
at their May 26 public hearing, and � .
WHEREAS, the Board heard staff recommendations suggesting certain
r� conditions and modifications to the p7at.
� NOW, THEREFORE, BE IT RESOLVED by the Board of County Comnissioners
� that the request for subdivision exemption be and hereby is approved subject
y to the following conditions: �
� 1. That the plat be amended to show the proper trail easement along �
� the creek and across the footbridge.io �/h� Gn�2��ce �vadu%ccy.
� 2. That the p7at be amended to show the property to be purchased as �
part of Lot 1, MAA Filing No. 1 (Plat Book 4, Page 466), not as a A
separate parcel, and include language to that effect as deemed appro- �
� priate by the County Engineer and County Attorney. i
� �
3. That the Tanguage on the exemption plat be revised to clarify that
� the newly acquired 5.442 acre parcel to be consolida�ed with Lot 1
� shall be exempt from restrictions against any further development of 3
Lot 1, MAA Filing No. 1, as the latter is specified in MAA Filing No. 1. �

4. That the plat be reviewed and approved by the County Engineer and y
County Attorney prior to recording of the plat. �
