' RESOLUTION OF THE BOARD OF COUNTY � COMMISSIONERS OF,PITKIN COUNTY, COI,ORADO � AMENDING CERTAIN PROVISIONS OF THE COUNTY'S � ANIMAL REGULATIONS � Resolution No. 78- l0 3 � WHEREAS, the Board of County Commissioners, have deter- �. mined that it will promote the public health, safety and welfare to discourage unwanted litters (dog)Within Pitkin _ County and, on recommendation of the County Dog Warden, have considered and determined to amend the County's dog i regulations to that effect, { NOW, THEREFORE, BE IT RESOLVED by the Board of County } Commissioners of Pitkin County, Colorado, pursuant to their .2 authority given in C.R.S. 1973, Sections 30-15-101, et seq (as amended) that the "Pitkin County Dog Control Resolution ; of 1972", as amended, be further amended, as follows: � :{ Section 1 Section 2(b) be repealed and reenacted to read as follows: � � } (b) No dog over the age of six (6) months shall be � - ! kept, harbored or maintained within the County �; ' of Pitkin, Colorado, unless the owner, keeper or � person in charge of such animal shall bi-annually pay a designated agent of Pitkin County for col- lection (as may from time to time be determined by the Board of County Commissioners of Pitkin County) a license fee of fifteen ($15.00) Dollars for unneutered dogs (or Two ($2.00) Dollars for � neutered dogs) to be remitted to Pitkin County y 4 as directed from time to time by the Board of � • County Commissioners for each and every dog owned, kept or harbored. For purposes of this � paragraph 2, persons authorized to perform vac- cinations against rabies may be designated as ; agents of Pitkin County for the collection of license � fees hereunder. � Section 2 � � Paragraph 12(d) be amended by the repeal and reenact- t ment of subparagraph 1 to read as follows: 1. Section 3 �` Paragraph 12(e) be Yepealed and reenacted to read as � . follows: �.. .:: (e) in determining the appropriate penalty assessment for a violation of the "DOg Running at Large" section hereof, the.first offense shall be deemed the first niolation occurring after the date of issuance (and the anniversary thereof) of the license tag worn by the offending dog, or simply the first such violation in the case of an un- licensed dog. The numbering of such offenses shall be deemed to begin anew on the date a new bi-annual license is issued for a dog, and, again, on the anniversary of the da�e of issuance; provided that if such new license is issued fewer than eleven (lI) months from the date of issuance (or anniversary thereof) a former license was acquired hereunder, the number of such offenses sha11 not begin anew until the actual expiration date (or first anniversary thereof) of the former license.
