F.ESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO, GRANTING A REQUESTED
DUPLEX BY SPECIAL REVIEW TO ERANK GOI,DSMITH
- RESOLUTION NO. 78-�t
WHEREAS, Prank Goldsmith has submitted an application far
approval, pursuant to the use requirements of 5ection 3.03 of
the Pitkin County Land Use Code, of a special review request for
a duplex use of property owned by Mr_ Goldsmith located on
Wright Road, P.ed Mountain, Pitkin County, Colorado, and
WHEREAS, the County Sanitarian has reviewed the proposal
with respeot to water supply, sewage disposalr air and water '
quality impacts, and has found that the water is provided by �
the City of Aspen and is of excellent quality, sewage disposal
is provided by the Aspen Metropolitan Sanitation District, and
there are no significant air or water quality degradation effects
anticipated, and
WHEREAS, the Planning and Zoning Commission considered the
request April 5, 1978, at which time the application was denied
because of conflict with the Growth Management objectives and
road impact.oE further duplex development on Red Mountain, and
WHEREAS, the Board of County Commissioners has reviewed
the recommendation of the Commission and the evidence and testimony
presented with respect to the applicationr and has found: "
1. This application in itself has a small road impact,
however, at some point the road capacity threshhold will �
be crossed. j

2. ihe owner is an employer who intends to rent to his �
employees.
NOW, THEREFORE, BE ST RESOLVED BY THE BOARD OF COUNTY �

COMMISSIONERS OF PIKTIN COUNTY, COLORADO, that it does hereby �
grant special review approval to Frank Goldsmith for a duplex
use of his property on Red Mountain in the R-30 zone district ,
conditional upon the following: �
1. ^he property is to be covenanted against future �

condominiumization. ±
