(emphasis ours) S WHEREAS, the charter further requires that a1T formal resolutions (a) be typed prior to Einal adoption, (b) be considered at two separate meetings, (c) and, on adoption, be published in full or by title, and WHEREAS, the Board finds these adoption procedures for land use applications to be inconsistent with the intent and purpose af the formal resolution procedure inasmuch as: (a) By requiring the processing of all land use applications as £ormal resolutions, the charter fails to distinguish between quasi-judicial activity and legislative action. The former _ consists of applying previously adopted criteria � � to specific reguests for development approval; while the latter concerns the adoption of a general rule or regulation, qeneric in its terms and application and ot general public � interest. � �� 'r (� i,' 1'. (b) The formal resolution procedure is not compatible with quasi-judi.cial actions inasmuch as: (1) There is no purpose served in considering the .matter at two readings inasmuch as, at the first reading, the Board will not have heard public comment and any decision to approve is without meaninq; while, on the other hand, it cannot deny approval ` and thereby refuse to proceed with the public hearing and seaond reading because o£ the applicant's right to full processing under the Land Use Code. (2) A proposed resolution cannot ordinarily be typed prior to second reading inasmuch as it contains findings of fact and conclusions arrived at by the Board at the close of a public hearing; and this hearing and the second reading are customarily scheduled for the same day. t3) There is little public good served in publishing the myriad of land use applications approved inasmuch - as the approval or denial is seldom of general _ public interest. (4) The state statutes and Land IIse Code already provide notice and hearing requirements for land use appliaations and these � requirements will guarantee the procedural due process which is the objective of the formal resolution pzocedure. ' � � .. �..... ,..... . �."'_.� �__:....� . . . . . . ..... , a.,, ).. k: NOW, TFiEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkim County, Colorado, pursuant to Section 8.1.1.2 of the Pitkin County Home Rule Charter, that said Board does hereby submit to the electorate at the November, 1978, Genera� Electiun, the following question: For the purgose of expediting the consideration of most land use applications, shall the Pitkin County Home Rule Charter be amended by the repeal , of that part of Section 2.8.1.1 of said Charter requiring that all actions of the Board of County � Commissioners granting or denying- in final form any land use application comply with the formal resolution procedures of the Pitkin County Aome Rule Charter7 BE IT FURTHER RESOLVED that it is the purpose of this proposed amendment to expedite development apgTications and ; intended that all land use applications be reviewed as may now (or hereafter) be otherwise requir.ed by state or local laws and/or requlations; and, further, that all actions concerning land use which are truly legislative in nature will be taken only in conformance with the formal resolution � procedures of 5ection 2.8.1.1 of the Pitkin County Home Rule Charter.
