� LAND USE CODE (CONCERNING HOUSING GUIDELINES)

-,'� WHEREAS, the Board, at a public hearing noticed for and
,;�
� conducted on August 14, 1978, has considered various amend-
� ments to Section 5.30 of the Pitkin County Land Use Code
and, upon consideration, has determined to adopt the saMe,
NOW, TAEREFORE, BE IT RESOLVED by the Board o£ County
� Commissioners of Pitkin County, Colorado, that. the Pitkin
County Land Use Code be amended by the addition of Section
5.30.03 to read as follows:
5.30.03 Satisfaction of Requirement.
The proponent of a residential development
will be deemed to .have satisfied the re-
� quirements of this Section 5.30 if he shall:

a. Construct (or subdivide) within the
project, only one half of the allowable
density (or lots) and purchase (and
subsequently deed to the Pitkin County
Housing Authority) previously approved
� subdivision lots (constituting legal
building sites with utilities and roadways
in place) equal in number to the number
of new dwelling units to be constructed
(or single family lots to be subdivided)
by the proponent. The lots conveyed
to the Housing Authority shall meet with •
the approval of the Authority and Planning *
Office and shall be resold at such price
and in such a manner as to satisfy the
moderate income housing requirements of
this section; or.
b. Construct (or subdivide) within the
project, only one half of the allow-
able density (or lots) and purchase
(and subsequently deed to the Pitkin
County Housing Authority) fully con-
structed dwelling units (of substantially �
the same size, type and quality as the ,�`'
proponent proposes to develop} equal �
in number to the number of dwelling
units to be constructed (or single �
family lots to be subdivided) by the �
proponent. The dwelling units conveyed �
to the Housing Authority shall meet with
the approval of the Authority and Planning � �
Office and be rented or sold at such
price and in such manner as to satisfy �
the moderate income rental or ownership
requirements of this section.
