its June 21, 1978 meeting forward to the Board of County �'•

WIiEREAS, the Board of County Commissioners did consider�, '�
the same on first reading on June 26, 1978; set the matter �
for public hearing on August 14, 1976; conduct said public �

hearing; consider the recommendations of the Commission and � _
Planning Office, and comments of the public; and determine �

that adoption of the proposed amendment is appropriate, `.�
NOW, TSEREFORE, BE IT RESOLVED by the Board of County t�� .
Commissioners of Pitkin County, Colorado, that Section 7.22 a. �

of the Pitkin County Land Use Code be repealed and reenacted �
as Sections 7.22 a. and 7.22 b. to read as follows: ;�

Section 7.22 Exceptions. The following exceptions
shall apply to permitted use of ;i
substandard-sized lots and parcels. �;

a. Any lot which is substandard as ~ -
to area and/or width situate within �r:�
a platted subdivision which did not ;!
require and did not receive approval °�'
by the Planning and 2oning Commission ';�.
and the Board of County Commissioners
pursuant to those County subdivisions
adopted in the Commissioners' Resolu-
tion 72-17 (or any amendment thereto)
shall be considered separately
developable for the purpose of erecting
�c�•_ (or maintaining) one single £amily
dweZlinq on each such lot (without
regard to the fact that contiguous
lots may be owned by the same person)
if the same shall be processed as
and receive approval as a use by
Special Review pursuant to Section

� 6.03 of this Code. The reviewing �
agencies shall, in addition to the
criteria otherwise established by
this Code for Special Review
approval, consider the following: _
(1) the number of substandard lots
developed in the area and the effect
of separate development on the char-
� acter of th� neighborhood and purposes
of the zone category; (2) the extent
to which the lots comply with existinq
subdivision requlations; (3) the -
effect of separate development on
available utilities, roads and other
public services; (4) any physical
limitations of the lots; (5) the
configuration of the lots as it
affects their suitability for
separate development; (6) the degree
_ of economic loss to the owner if
� separate.development permission is
: not granted (including a consideration
of the value of the lots if separately
developed vis-a-vis their value if
used in conjunction with each other);
(7) the history of acquisition (in-
, cluding a consideration of the purposes
of the purchase and whether or not the
lots were involuntarily acquired) ;

and (8) the historical use of the lots.
� b. Any lot, which is substandard as
� to area and/or width situate within a
platted subdivision which was
� required, by reason of the adoption of
said Resolution 72-17 (or any amendment
� thereto), to be and was approved by
the Planning and Zoning Commission
and the Board of, County Commissioners
shall be considered separately �
developable for the purpose of
maintaining or constructing one '
• single-family dwelling on each such w
lot, without regard to the fact that
contiguous lots may be owned by the
same person.

And, accordingly, that Section 7.22 b. be relettered
7.22 c.
Adopted by the Board of County Commissioners at their
rec�il,ar meeting held August 14, 1978, to be effective immediately.
