RESOLUTION OF THE BOARD OF COUNTY �
COMMISSIONERS OF PITKIN COUNTY, COLORADO �
DENYING SPECIAL REVIEW APPROVAL FOR THE
SEPARATE DEVELOPMENT OF LOT 3
� LIME VILLAGE SUBDIVISION

WHEREAS, James Mollica is the record owner of Zots
2 and 3, Lime Village Subdivision, Filing No. l, according
to a plat thereof of record in Book 4 at Page 14 of the records
of the�Pitkin County Clerk and Recorder; and
Wf�REAS, the owner has requested permission to separately
develop Lot 3 pursuant to the provisions of Section 7.22(a)
, of the Pitkin County Land Use Code permitting the separate
development of substandard contiguous lots under single
ownership upon special review approval, taking into con-
sideration "(1) whether the lot or parcel as platted, including
� subdivision amenities, substantially satisfies Subdivision j
. Regulation in effect at the time such review is made,
considering health, safety (e.g. fire hazards), spaciousness �
and compatibility in the area; (2) the degree of non-con-
formity with zone district requirements and other lots in
the area; and (3) whether improvements already exist and � ��
thus, whether additional density would be incurred by the
}
lot separation", and �

WHEREAS, upon review of the application the Board of �
County Commissioners has found that:

1. Lot 2 is fully improved and Lot 3 has no improve- ;
ments and Special Review approval is being sought t

for the purpose of creating a separate additional ;

development site. Consequently, additional {

density will result from the proposed lot separation. ,

2. Lot 3 contains approximately 2.201 acres and is
located in an AF-1 zone district which establishes
a 10 acre mini.m�tm lot requirement. Consequently,
the lot is in extreme non-conformity with the zone
uistrict reciairements.
3. The 1ot is serviced by Little Annie Road which (a)
is not marked where it intersects with the C�stle
- \
Creek Road (making it difficult £or emergency
vehicles to find) and (b) £ails to meet the CSFS
and Pitkin County mini.mum standards in almost
every category: the road grade is excessive,
the road width (both roadbed and right-of-way)
are much less than the minimums, as are the radii
curvature in several places. The need for an
adequate roadway is accentuated given the Iocation
of the site and potential wildfire hazard. :
4. Although an interest in an existing water right
(weZl) has been demonstrated, the County Sanitarian
. advises that: (a) the water line (1 inch) is
inadequate according to standards established by
the Land Use Code, (b) the most recent pvmp test
of the well (already serving four homes� was 15
gpm, an amount insufficient to supply five homes '

with a system containing only 2000 gallons of �
�
storage and (c) there are several existing �
sanitary defects in the water system, including �
a loose seal on the well head and lack of �
disinfection. In addition, the Sanitarian advises �
that installation of an individual sewage disposal �
system on Lot 3 presents severe difficulties for �
while the soil is (probably) permeable and should `
�result in adequate perculation tests, the slope
(40$ and greater) makes the construction of a � '
conventional system impossible. The Sanitarian t

has concluded that the water and sewer systems
� cannot be made to satisfy existing,COUnty subdivision
and other land use regulations.
. 5. The area is composed of glacial material on slopes
of 40$ and greater. Soils conditions on the site
have raised a serious concern that, in the_event ,.
the site becomes unduly wet (due to over watering
or improper drainage) excessive seepage into the
surficial deposits could transform the hillside
(otherwise stable) into a mobile hillside.
AND WHEREAS, given the foregoing, the Board of County
Commissioners has concluded that i,ot 3 does not substantially �
satisfy existing County subdivision regulations, is in
extreme non-conformity with existing zone district requirements,
and, if developed, would result in additional density, all in
derogation of the objectives and criteria of Section 7.22 of
the Pitkin County Land Use Code.
NOW, TAEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Pitkin County, Colorado, that the Special
{ Review application for the separate development of Lot 3,
Lime Village Subdivision be, and hereby is, denied.
