RESOLUTION OF THE BOARD OF COUNTY,
COMMISSIONERS OF PITKIN COUNTY, COLORADO,
GRANTING AN EXTENSION OF TIME FOR THE
PROCESSING OF THE METCALF SUBDIVISION
Resolution No. 76-�
WHEREAS, on August 8, 1978, the Board of County
Commissioners granted general submission approval for the
Metcalf Subdivision, .subject to the following conditions:
l. . Full compliance with Section 5.09 of the Pitkin
County Land Use Code to include individual well
adjudication for each lot;
2. That lots be convenanted against dogs;
3. That an electrical service plan be adopted as
� recommended by Holy Cross; and that
4. Two lots offered for sale under PMH guidelines,
AND WHEREAS, provisions of the Land Use Code provide,
with respect to the timely processing of subdivision (and
_ other) applications that (Section 6.03.04 d. 4. ii.):
Approval of the general submission shall be
valid for one (1) year from the date of Board
approval. If, within that time period, no required
subsequent submission has been filed, or sub-
stantial action in reliance taken, approval shall
expire unless for good cause shown, the Board
extends the time period .
AND WHEREAS, the applicant did, at the Board's meeting
held August 14, 1978, request an extension of time under a
Section 6.03.04 d. 4, ii. and did demonstrate that:
l. The applicant has commited to permanently prohi.bit
dogsjand to restrict the initial (and subsequent)
sale price of two lots within the subdivision,
and has thus satisfied the second and fourth •
conditions noted above. �
2. The applicant has procured an electrical service
plan in conformance with condition number three.

3. The applicant has contracted for a necessary �
hydrology report in anticipation of filing for
individual well permits as required by the first
condition.
� 4. In addition, the applicant has been delayed in
completing necessary mapping inasmuch as it was
required to be done by air.
AND WHEREAS, given the foregoing the Board has concluded
that the applicant has taken steps in reliance of the general
submission approval, and has shown good cause for the delay
in further processing the application,
, NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Pitkin County, Colorado, that it does,
pursuant to Section b.03.04 d. 4. ii_ of the Pitkin County
Land Use Code,grant an extension of one year (from the date
of approval of this resolution) for the filing of the Detailed
Submission of the Metcalf Subdivision, under section 6.04
of said Code.
